Closed Chrysler dealers to drive Obama’s eligibility

Seeking damages for lost businesses, will question administration's 'authority'

Two lawyers have joined forces to assemble a case challenging in U.S. bankruptcy court the federal government’s use of Troubled Asset Relief Program funds to bail out Chrysler and in doing so may have created a scenario that finally will bring to a head the issue of Barack Obama’s eligibility to be president.

The attorneys are Leo Donofrio, who has launched cases directly challenging Obama’s eligibility, and Stephen Pidgeon, who also has worked on the issue.

Their new case questions the authority by which the federal government and administration officials intervened in the auto industry, specifically allocating some $8 billion-plus to Chrysler, which later was forgiven.

Pidgeon told WND the clients in the case are former Chrysler dealers who lost their businesses as part of the “restructuring” of the automobile company. They have been damaged with the loss of their businesses, and the case alleges the Obama administration, through its use of TARP money, influenced Chrysler’s outcome.

Donofrio told WND the core issue is the disbursement of TARP funds to the auto maker that were intended to help banks and financial institutions. The previous Treasury secretary had indicated such expenditures were not appropriate, and, in fact, a congressional effort to authorize the expenditures failed, he said.

So, along with a bankruptcy court challenge, a “quo warranto” case is being filed in Washington, D.C., demanding to know by what authority administration officials set up the financial arrangements with Chrysler and handed out taxpayer money.

As part of the demand for information about the authority used, Donofrio confirmed, there will be questions about Obama's eligibility to be president. Donofrio contends that since by Obama's own admission his father never was a U.S. citizen, Obama was born a dual citizen. The framers of the Constitution, he argues, did not consider a dual citizen to be a "natural born citizen" as required for the presidency.

The burden, then, would shift to Obama and his administration officials to document their constitutional authority for their decisions and their handling of taxpayer money.

If the president cannot document his eligibility to occupy the Oval Office, his presidential task force had no authority to act at all, the case contends.

Pidgeon told WND the plaintiffs in the case are the former Chrysler dealers, and their interests will be paramount.

The goal is "to get them restored," he said, and "put them back where they were before their contracts were rejected."

"Our clients are not in this action as 'birthers,'" he said, citing a term used for people who question Obama's constitutional eligibility. "Our clients are here to seek redress for wrongs."

But the case may open doors that have been closed in other disputes over Obama's eligibility. Most previous cases, at one point or another, have been dismissed because the plaintiffs do not have "standing" – they have not suffered direct injury for which they have a reasonable expectation of seeking redress.

In the case of the dealers, they have suffered financial loss because of circumstances that developed with the government's intervention in the auto industry.

According to columnist Devvy Kidd, the case is "complicated."

She explained a "quo warranto may be issued from the United States District Court for the District of Columbia in the name of the United States against a person who within the District of Columbia usurps, intrudes into, or unlawfully holds or exercises, a franchise conferred by the United States or a public office of the United States, civil or military."

That means quo warranto applies not just to eligibility but to the "exercise" of authority through public office, she said.

She noted the 2nd U.S. Circuit Court of Appeals already has described as "interesting and unresolved" some of the questions raised in a related case that did not involve the dealers. In that case, once again, the appellants did not have "standing."

"The Chrysler dealers have the requisite injury – loss of their franchises – to meet the standing requirements," she wrote.

The formal paperwork in the filings is expected to be submitted to the courts within days on a motion to reconsider the bankruptcy court's decisions and the quo warranto pertaining to the authority of Obama and his appointees.

WND previously has reported on many cases brought over the issue of Obama's eligibility, including one at the 3rd U.S. Circuit Court of Appeals that alleges Congress failed in its constitutional duties by refusing to investigate the eligibility of Obama to be president.

The case is being handled by attorney Mario Apuzzo for lead plaintiff Charles F. Kerchner Jr. and others against Obama, the U.S., Congress, the Senate, House of Representatives and former Vice President Dick Cheney along with House Speaker Nancy Pelosi.

The case focuses on the alleged failure of Congress to follow the Constitution. That document, the lawsuit states, "provides that Congress must fully qualify the candidate 'elected' by the Electoral College Electors."

The case asserts "when Obama was born his father was a British subject/citizen and Obama himself was the same."

The Constitution also provides, the lawsuit says, "If the president-elect shall have failed to qualify, then the vice president elect shall act as president until a president shall have qualified."

The Obama eligibility cases have cited Article 2, Section 1 of the Constitution, which states, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President."

Some of the lawsuits question whether he was actually born in Hawaii, as he insists. If he was born out of the country, Obama's American mother, the suits contend, was too young at the time of his birth to confer American citizenship to her son under the law at the time.

Other challenges have focused on Obama's citizenship through his father, a Kenyan subject to the jurisdiction of the United Kingdom at the time of his birth, thus making him a dual citizen. The cases contend the framers of the Constitution excluded dual citizens from qualifying as natural born.

Further, others question his citizenship by virtue of his attendance in Indonesian schools during his childhood and question on what passport did he travel to Pakistan three decades ago.

Adding fuel to the fire is Obama's persistent refusal to release documents that could provide answers and the appointment – at a cost confirmed to be at least $1.7 million – of myriad lawyers to defend against all requests for his documentation. While his supporters cite an online version of a "Certification of Live Birth" from Hawaii as his birth verification, critics point out such documents actually were issued for children not born in the state.

The ultimate questions remain unaddressed to date: Is Obama a natural born citizen, and, if so, why hasn't documentation been provided? And, of course, if he is not, what does it mean to the 2008 election or the U.S. Constitution if it is revealed that there has been a violation?

WND also has reported on another case that was dismissed by U.S. District Judge David Carter in California. It also now is heading to the appeals level.

Among documentation not yet available for Obama is his kindergarten records, Punahou school records, Occidental College records, Columbia University records, Columbia thesis, Harvard Law School records, Harvard Law Review articles, scholarly articles from the University of Chicago, passport, medical records, files from his years as an Illinois state senator, his Illinois State Bar Association records, any baptism records and his adoption records.

Because of the dearth of information about Obama's eligibility, WND founder Joseph Farah has launched a campaign to raise contributions to post billboards asking a simple question: "Where's the birth certificate?"

The campaign followed a petition that has collected more than 480,000 signatures demanding proof of his eligibility, the availability of yard signs raising the question and the production of permanent, detachable magnetic bumper stickers asking the question.

The "certification of live birth" posted online and widely touted as "Obama's birth certificate" does not in any way prove he was born in Hawaii, since the same "short-form" document is easily obtainable for children not born in Hawaii. The true "long-form" birth certificate – which includes information such as the name of the birth hospital and attending physician – is the only document that can prove Obama was born in Hawaii, but to date he has not permitted its release for public or press scrutiny.

Oddly, though congressional hearings were held to determine whether Sen. John McCain was constitutionally eligible to be president as a "natural born citizen," no controlling legal authority ever sought to verify Obama's claim to a Hawaiian birth.

The old company, renamed Motors Liquidation, is selling off its assets to pay creditors a tiny fraction of what they are owed....".

Don't know if they would have gotten the same deal on a plant in Detroit. Whatever it was, it would be a business decision that I don't know the details of.

GM May Need More U.S. Job Cuts as Buyouts Fall Short

Aug. 3 (Bloomberg) -- General Motors Co. may have to cut more U.S. hourly jobs after an offer of buyouts and early retirements fell about 7,500 workers short of the reorganized automaker’s target.

The possibility of layoffs was disclosed today by Sherrie Childers Arb, a spokeswoman, in an interview after GM announced that more than 6,000 United Auto Workers members, or 11 percent of the hourly workforce, left the company on Aug. 1.

GM’s latest voluntary exits pushed the total of U.S. hourly workers leaving through buyouts and retirement offers to about 66,000 since 2006. The biggest domestic automaker is shrinking its workforce to match reductions including the shutdown of 14 U.S. plants and 3 warehouses by the end of 2011.

“It’s not surprising they didn’t reach their goal,” said Dennis Virag, president of Automotive Consulting Group Inc. in Ann Arbor, Michigan. With U.S. unemployment at 9.5 percent in June, “workers are more reluctant to accept a buyout because the prospects for other employment are more challenging.”

GM aims to eliminate 13,500 hourly positions in 2009, trimming that payroll to about 40,500 jobs, said Tom Wilkinson, a spokesman. Detroit-based GM began the year with about 61,000 U.S. hourly jobs and cut that total to about 54,000 at the end of April with buyouts and early retirements.

Moving Jobs

Any layoffs probably wouldn’t total 7,500, Childers Arb said. Some employees are likely to leave on their own or retire rather than relocate once GM shuffles work among its facilities, dropping jobs in some locations while keeping others, she said. GM hasn’t said where the job cuts will take place.

Hourly workers who took the buyout and retirement offers are receiving cash payments of $20,000 to $115,000 as well as $25,000 vehicle vouchers.

Chief Executive Officer Fritz Henderson is also paring the U.S. salaried workforce and chopping its eight domestic brands in half.

GM left a government-backed bankruptcy on July 10 as a new company whose largest shareholder is the U.S. Treasury. Losses at predecessor General Motors Corp. totaled $88 billion since the company last posted an annual profit in 2004.

Catastrophe - IT'S TIME TO TAKE BACK OUR COUNTRY

Now. It's that simple. It's that urgent.

GLENN: Okay, so I'm reading the story in Pravda, American Capitalism Gone With a Whimper. They are taking us that it's happening at breathtaking speed because we're sheeple, that Russia, they already went through this, and you need to learn the lesson. And this is what they say is happening. First the population in America was dumbed down through a politicized and substandard education based on pop culture rather than the classics. Americans know more about their favorite TV dramas than the drama in D.C. that directly affects their lives. True. They care more for their right to check down a McDonald's burger or a Burger King burger than for their constitutional rights and then they turn around and lecture us in Russia about our rights and about our democracy? Pride blind the foolish.

That line sticks out to me: Pride blind the foolish. We're arguing over things we should not be arguing about. The other line that sticks out to me is the substandard education based on pop culture rather than the classics. I was with George Wythe University who was the guy who was really the mentor to Thomas Jefferson and James Madison, and Thomas Jefferson had a way of education, and it's all based in the classics. At George Wythe University, they only have textbooks. They only use the classics. I've seen the difference.

Pravda goes on and says, "Then their faith in God was destroyed until their churches, all tens of thousands of different branches and denominations were for the most part little more than Sunday circuses and their televangelists and top protestant mega-preachers were more than happy to sell their souls in flocks to be on the winning side of one pseudo-Marxist politician or another. Their flock may complain but when explained that they would be on the winning side, their flocks were ever so quick to reject Christ in hopes of earthly power. The final collapse came with the election of Barack Obama. His speed in the past three months have been truly impressive. His spending and money‑printing has been record‑setting, not just in America's short history but in the world. If this keeps up for more than another year ‑‑ and there is no sign that it will not ‑‑ America will best resemble the Weimar Republic and, at worst, Zimbabwe."

My friend, I have told you these things were coming. I tell you now, they are coming. We must educate ourselves and be involved and put down our differences and connect with ‑‑ make a vow to yourself today that there are Democrats out there, if you're a Republican, that there are Democrats out there that truly get it. They don't hate America. There are Democrats now that are saying in their own circles, they don't want to say anything. I really, truly believe not enough people are reaching out to the other party and to the independents as well. They are saying to each other, this is crazy. This can't... but they want to believe. There's nothing, there's nothing wrong with being wrong. What's wrong is being wrong and then not admitting that you were wrong and just keep going down the path because you're too proud. Pride blind the foolish. The media elite will ask me, "Where were you when George Bush..." well, for the first half, blind. For the second half, speaking out. It doesn't matter. I'm not on any side. Are you? When it really comes down to it, are you on any side other tha n your children's side? The minute the Democrats say, "Whoa, Marxism, oh, wow," and they turn around and they say small government, I'm with them. I'll call myself a Democrat. I don't care. Minute the Republicans do it, fine. If the it's the, you know, polka dot purple people eater party, then guess what button I'm wearing. I don't care.

Let's just start speaking the truth to each other. These past two weeks have been the most breathtaking of all, Pravda continues. First came the announcement of a planned redesign of the American Byzantine tax system by the they thieves who used it to bankroll their thefts, loss and swindles of hundreds of billions of dollars. These make our Russian oligarchs look more than ordinary street thugs in comparison. Yes, the Americans have beat our own thieves in sheer volumes. These men, of course, are not elected panels but made up of appointees picked from the very financial oligarchs of their henchmen who are now gorging themselves on trillions of American dollars in one bailout after another. They are also usurping the rights, duties and powers of the American congress. Again congress has put up little more than a whimper to their masters. And then came Barack Obama's command that GM's president step down from leadership of his company. That is correct, dear reader of Pravda. In the land of pure free markets, the American president now has the power, the self‑given power to fire CEOs, and we can assume other employees of private companies, at will. Come hither, go dither, the centurion commands his minions. More advice to us and then to the people of Russia from the e ditorial this weekend in Pravda, next.

GLENN: So this weekend I'm reading an article out of Pravda, an editorial, American Capitalism Gone With a Whimper, and it has so much in it. They are warning us against Marxism and saying that it is coming at a breathtaking speed here in America. The article continues, "So it's no surprise that the American president is followed up with his bold move of declaring that he and another group of unelected chosen stooges will now redesign the entire automotive industry and will even be the guarantee of automotive policies. I'm sure that if given a chance, they would happily try to redesign for the whole world. Prime minister Putin less than two months ago warned Obama and the U.K.'s Blair not to follow the path to Marxism; it only leads to disaster. Apparently even though we suffered 70 years of this Western‑sponsored horror show, we know nothing, as foolish drunken Russians. So let our wise Anglo‑Saxon fools find the folly of their own pride. But again the American public has taken this with barely a whimper, but a free man whimper. So it shouldn't be any surprise to discover that the Democratically congress of America is working on regulation that would give the American treasury department the power to set fair minimum salaries, evaluate performance and control how private businesses give out pay raises and bonuses. Barney Frank stresses that this only a ffects the companies that receive government monies. But it is retroactive. And taken to a logical extreme, this would include any company or industry that has ever received a tax break or incentive. The Russian owners of American companies ‑‑ listen carefully, America. The Russian owners of American companies and industries should look thoughtfully at what is happening in America and look at the option of closing their facilities down and fleeing the land of the Red as fast as possible. In other words, divest while there is still value left. The proud American will go down into his slavery without a fight, beating his chest and proclaiming to the world how free he really is. And the world will only snicker.

Now, there are going to be those who dismiss this coming out of Pravda as political games. They will dismiss this as, "Well, of course they are saying that because they want to destroy America." Whatever. Sometimes there's a great amount of truth in an imperfect messenger. There is an awful lot of truth in this editorial. We'll include it in our free e‑mail newsletter. Don't have to agree with it, don't have to agree with everything in it. Some of the stuff is pretty harsh. But let's just make sure that the last sentence isn't true. The proud American will go down into his slavery without a fight, beating his chest and proclaiming to the world how freely he truly is. That is why I say we must stop arguing back and forth about the parties because we're not seeing the real issues. They are giving you the scraps off the table and we beat our chest and we say, "We're free. No, but I like freedom because the Republicans." "No, no, the Democratic freedom is better." They are both slavery. One's just slavery light and the other is socialism. The world will only snicker because of our arrogance for so long. Let's just think the unthinkable. Think of it as an actual possibility so we can avoid it. And unite together and rediscover who we truly are, not what we've allowed ourselves to become.

American capitalism gone with a whimper - Pravda

Wow… Is this really how we want to go out… without a fight??

It must be said, that like the breaking of a great dam, the American decent into Marxism is happening with breath taking speed, against the back drop of a passive, hapless sheeple, excuse me dear reader, I meant people.

True, the situation has been well prepared on and off for the past century, especially the past twenty years. The initial testing grounds was conducted upon our Holy Russia and a bloody test it was. But we Russians would not just roll over and give up our freedoms and our souls, no matter how much money Wall Street poured into the fists of the Marxists.

Those lessons were taken and used to properly prepare the American populace for the surrender of their freedoms and souls, to the whims of their elites and betters.

First, the population was dumbed down through a politicized and substandard education system based on pop culture, rather then the classics. Americans know more about their favorite TV dramas then the drama in DC that directly affects their lives. They care more for their "right" to choke down a McDonalds burger or a Burger King burger than for their constitutional rights. Then they turn around and lecture us about our rights and about our "democracy". Pride blind the foolish.

Then their faith in God was destroyed, until their churches, all tens of thousands of different "branches and denominations" were for the most part little more then Sunday circuses and their televangelists and top protestant mega preachers were more then happy to sell out their souls and flocks to be on the "winning" side of one pseudo Marxist politician or another. Their flocks may complain, but when explained that they would be on the "winning" side, their flocks were ever so quick to reject Christ in hopes for earthly power. Even our Holy Orthodox churches are scandalously liberalized in America.

The final collapse has come with the election of Barack Obama. His speed in the past three months has been truly impressive. His spending and money printing has been a record setting, not just in America's short history but in the world. If this keeps up for more then another year, and there is no sign that it will not, America at best will resemble the Wiemar Republic and at worst Zimbabwe.

These past two weeks have been the most breath taking of all. First came the announcement of a planned redesign of the American Byzantine tax system, by the very thieves who used it to bankroll their thefts, loses and swindles of hundreds of billions of dollars. These make our Russian oligarchs look little more then ordinary street thugs, in comparison. Yes, the Americans have beat our own thieves in the shear volumes. Should we congratulate them?

These men, of course, are not an elected panel but made up of appointees picked from the very financial oligarchs and their henchmen who are now gorging themselves on trillions of American dollars, in one bailout after another. They are also usurping the rights, duties and powers of the American congress (parliament). Again, congress has put up little more then a whimper to their masters.

Then came Barack Obama's command that GM's (General Motor) president step down from leadership of his company. That is correct, dear reader, in the land of "pure" free markets, the American president now has the power, the self given power, to fire CEOs and we can assume other employees of private companies, at will. Come hither, go dither, the centurion commands his minions.

So it should be no surprise, that the American president has followed this up with a "bold" move of declaring that he and another group of unelected, chosen stooges will now redesign the entire automotive industry and will even be the guarantee of automobile policies. I am sure that if given the chance, they would happily try and redesign it for the whole of the world, too. Prime Minister Putin, less then two months ago, warned Obama and UK's Blair, not to follow the path to Marxism, it only leads to disaster. Apparently, even though we suffered 70 years of this Western sponsored horror show, we know nothing, as foolish, drunken Russians, so let our "wise" Anglo-Saxon fools find out the folly of their own pride.

Again, the American public has taken this with barely a whimper...but a "freeman" whimper.

So, should it be any surprise to discover that the Democratically controlled Congress of America is working on passing a new regulation that would give the American Treasury department the power to set "fair" maximum salaries, evaluate performance and control how private companies give out pay raises and bonuses? Senator Barney Franks, a social pervert basking in his homosexuality (of course, amongst the modern, enlightened American societal norm, as well as that of the general West, homosexuality is not only not a looked down upon life choice, but is often praised as a virtue) and his Marxist enlightenment, has led this effort. He stresses that this only affects companies that receive government monies, but it is retroactive and taken to a logical extreme, this would include any company or industry that has ever received a tax break or incentive.

The Russian owners of American companies and industries should look thoughtfully at this and the option of closing their facilities down and fleeing the land of the Red as fast as possible. In other words, divest while there is still value left.

The proud American will go down into his slavery without a fight, beating his chest and proclaiming to the world, how free he really is. The world will only snicker.

California Mess is a Microcosm of What's in Store for the Rest of Us

RUSH (LIMBAUGH): In California today, voters are going to go to the polls to decide the fate of six ballot initiatives.  Four of them would, if they pass, raise taxes on Californians.  The Governator is not there.  The Governator is in Washington along with Jennifer Granholm to celebrate the announcement by Obama today of these new auto emissions rules.  They're going to add about -- well, if they're going to say $1,600 to the cost of the American family, double it at least by the time we get to 2016. 

Schwarzenegger has pushed heavily for all six ballot measures.  They are designed to close California's $15 billion budget shortfall.  But as the Heritage Foundation points out in a great story called Californication: "Even though Schwarzenegger's legacy depends on the passage of these initiatives, he will not be in California tonight to see the results. The Los Angeles Times reports: 'His absence in the face of widely forecast defeat drew mockery from his foes.' Instead Schwarzenegger will be in Washington, DC, where he is scheduled to join President Barack Obama at the White House to celebrate the federal adoption of auto emissions standards that mirror standards previously adopted by California."

Now, this is being called a win for California.  The LA Times here is saying that the Governator succeeding in getting California emissions adopted for the nation is a big win for California.  Well, that may be, folks, but it is a huge loss for the rest of the nation, and it may just be the first of many losses for the rest of the nation.  Heritage Foundation points out today that for decades, California's been a leader in public policy innovation.  Stick with me on this 'cause this is where the rubber meets the road here.  A generation ago, 25, 30 years ago, California was at the forefront of a taxpayer revolt that eventually helped elect President Reagan and usher in three decades of prosperity.  California is still exporting its public policy ideas.  So how is California's experiment with the green economy going?  Do you know what Channel 4 in LA has discovered?  LA is called the greenest city in the country (laughing)  and they have discovered that the street lights are on 24/7.  The street lights are on in the daytime, and customers and citizens have been complaining about this waste, and the city hasn't been doing anything about it, they've been looking to blame the contractor or blame the department of public works or some such thing. 

But it's even better than that.  LA, the greenest city in the country, California with all of these great auto emissions standards, California imports more energy than any state in the country.  When you drive through that state you're going to see solar panels everywhere, and you will see windmills everywhere.  You are going to see cars on the highways everywhere.  You're going to see traffic everywhere as you know it, and yet California imports more energy than any state in the country.  As a result of that, it has some of the highest energy costs in the country, including the second highest commercial sector energy prices.  Only Hawaii, which is ocean bound, has higher rates.  Now, in addition to all the greening that's gone on in California resulting in the largest amount of energy imports in the country, California's unemployment rate hit 9.3% last December.  That was up from 4.9% in December 2006.  There are now one-and-a-half million Californians out of work.  The state has the fourth highest housing foreclosure rate in the nation.  California has lost more businesses than any state in recent years.  California is facing a $40 billion budget deficit.  In some small towns, unemployment is now running close to 35%, rivaling unemployment rates during the Great Depression.  And what is the benefit to the environment of all of this?  Absolutely zilch, zero, nada. 

All of this economic pain supposedly for environmental gain has resulted in zero environmental gain.  This is the exact same formula that the Waxman-Markey energy tax legislation offers the United States, cap and trade.  It is the exact same thing this nation is headed for.  It has been a disaster for California; it will be a disaster for the nation at large and as a whole.  But you know how insistent Californians have been.  They've got their own fuel emissions standards; they have their own fuel mixtures and blends.  California imports more energy than any state in the country. 

Now, you might say, "Well, yeah, but, Rush, they got more population."  Well, they're also the greenest.  They have embarked on policies to reduce the need to import.  What is the whole impetus behind Obama's cap-and-trade program?  To reduce our dependence on foreign oil, to make us less susceptible to people who hate us and what's California showing us?  It's a microcosm of what is ahead for the United States of America.  They import more energy than any state in the country.  Unemployment through the roof; budget deficits through the roof; six ballot initiatives today, four of which would raise taxes.  The governor out of town; doesn't want to be anywhere near there when the results come in tonight. 

The polls indicate that these things are going to go down in flames, that despite all, Californians don't want to pay higher taxes, even the majority lib population out there because they're starting to say, "It's not our fault, it's not our fault.  The fact that we're not paying enough taxes is not the reason why you people in Sacramento can't control your spending."  So all of these liberal do-good ideas, all of these feel-good things, all of these proposals and ideas that are going to make California the beacon of the country and show us the way on energy independence, have all failed miserably.  Schwarzenegger is in Washington today to join Obama in spreading the same kind of energy policy nationwide that California has adopted for years, and this is being called in the LA Times a big win for California.  Nothing could be further from the truth. 

BREAK TRANSCRIPT

RUSH:  Liberty Township, Ohio, this is Adelee, nice to have you on the program.  Hi.
CALLER:  Hello, Rush.  I was just calling you to say that Europe uses nuclear power so if we were actually trying for energy independence we wouldn't be going for the wind or the solar.  If we are trying to follow what Europe does, we'd be using nuclear power.

RUSH:  Well, especially it's a good point about France.  France is big into nuclear power, but you raise a good point here, Adelee.  There's a way to reduce our dependence on foreign oil tremendously and there's a way to reduce the use of coal and that's nuclear.  Oh, no, we can't have nuclear.  Why?  Because nuclear, well nuclear, we'll all melt, radiation, we'll die of radiation poisoning.  We know that because of a movie called The China Syndrome in which Jane Fonda starred.  That movie killed the nuclear industry and it was done on purpose.  But there is an added reason why we don't go nuclear, and I want to take you back to my example.  Obama is going to have us all driving putt-putts -- they get 35 1/2 to 39 miles a gallon -- by 2016.  The purpose: use less oil, use less gasoline.  This is to reduce our dependence on foreign oil.  We don't like those sheiks in the oil-producing states in the Middle East and we don't like being vulnerable so we're going to go driving little putt-putts.  At the same time we do this, guess what we're going to do?  We are going to save the planet from whatever this hoax climate change is.  But then, understand something. When we're all driving these putt-putts and using less gasoline, that is going to equal less sales tax revenue, gas tax revenue, both to the feds and to the states.  Any time you use less of a product, the tax take from it is less, so one of two things is going to happen.  They're either going to have to raise taxes, which is the next step to come, raise taxes on gasoline.

Folks, this is the point.  It is not that anybody at this press conference today, from Obama to Carol Browner or anybody else, they don't care about being dependent on foreign oil.  There are ways that are much more efficient and make much more sense than 35 or 39 miles to the gallon in a putt-putt to reduce our use of foreign oil.  They want the use of oil to continue.  They just want the money for it.  They don't want the sheiks getting the money, and they don't want foreign oil companies getting the money; Obama wants it.  Washington wants the money.  This is the first step, the universal or a national fuel efficiency standard is the first step toward them shifting the expenditure of dollars for oil overseas to Washington, one way or the other.  Another thing that's going to happen here is that we're not going to use less oil.  If we do, then you're going to see an appropriate contraction and decline in your standard of living and in the overall national economy. 

You do not grow an economy by making things more expensive for average people to utilize.  You do not grow an economy by raising the cost of living and with tamping down the standard of living.  You don't do that.  What you do is you encourage and facilitate the growth of government which is going to be collecting all of the revenue that would normally be used as disposable income in your own family.  They're going to get it.  The states are going to get it, the federal government is going to get it, and you're going to have less of what you earn because you're going to be spending more of it, even though you're told today that you're going to have to drive a car that gets 35 to 39 miles a gallon and, voila, you're going to be using less gasoline.  If you think that's going to add up to a lot of savings, you wait.  We've already seen the evidence.  In North Carolina they had a drought, so they reduced water usage.  They did the same thing here.  Had a drought, you can only use water once a week.  Then they found out wait, wait a minute, our taxes from the water utility are going way down, so they raised the rates, water prices, if you will, utility prices in North Carolina and Florida, after they enforced less usage.  Same thing is going to happen here. 

In fact, it's already happened in California.  When people already started buying putt-putts on their own and started using less gasoline, didn't take long for Sacramento to realize that their gas tax revenue was down.  So they started talking about how to raise taxes, and in California today, after all of these brilliant, massive economic improvements, after all of this cutting-edge environmental improvements, all of these green adds, windmills and solar panels and new formulations of gasoline, California today, which imports more energy than any state in the country, and today there are six ballot initiatives, people going to the polls in California and four of them are to raise taxes after all of these steps were taken to save the state, to save the planet, to save the country, to save on our environmental expenditures.  And it just hasn't worked, has it?  So what you're seeing in California today is a little microcosm of what's headed our way, now specifically since Obama and Carol Browner have announced this silly nationwide CAFE standard tailpipe emissions limit and mileage of 35.9 miles per gallon. 

Now, I know some of you saying, "Rush, what is wrong with cars that pollute less?" Nothing.  There's not a thing in the world wrong with that.  But that's not what this is about, folks.  None of what Obama says is his motive is his motive.  His motive is designed to get you on board and in love with the idea of how much he cares about saving the planet, the country and you.  This is all about increasing revenue to the states and the federal government while at the same time taking money away from you and having a little bit more control over what you do.  If you want to drive a putt-putt you ought to be able to drive a putt-putt, but if you don't want to drive a putt-putt you shouldn't have to drive a putt-putt.  Once they make us all start driving putt-putts then they're going to say you can't get the big TV you want or whatever it is.  There are going to be limits on it because it's destroying the country or the planet or somehow it's unfair to those who can't have it, you name it. There will be limits.

Senior creditors: Chrysler deal violates 5th Amendment

If the Obama administration expected the senior creditors of Chrysler to fold their tents under political pressure, they may have gotten a rude shock today.  Thomas Lauria, who accused the White House of threatening the creditors withn humiliation at the hands of the White House press corps, has filed a motion to halt the administration’s machinations on behalf of the UAW in the Chrysler bankruptcy.  Lauria and his allies claim that the Obama administration has violated the Constitution in their bid to devalue the senior creditors’ holdings on behalf of junior creditors, and have some precedent to support the allegation.

The heart of the argument starts on page 8 (via HA commenter Outlander):

III. The Taking of Collateral through a Direct or Indirect Use of TARP Authority is Unconstitutional.

13. The Treasury Department relies on TARP as the purported authority to justify the disparate treatment under the 363 Sale, even though TARP was enacted after the Senior Lenders’ liens on the Debtors’ property were already in place. The Supreme Court long ago recognized, however, that a secured creditor’s interest in specific property is protected in bankruptcy under the Fifth Amendment. Louisville Joint Stock Land Bank v. Radford, 295 U.S. 555, 594 (1935). That case involved a Depression-era statute that was intended to help bankrupt farmers avoid losing their land in mortgage foreclosure. The statute in Radford provided that the bankrupt debtor could achieve a release of the security interests either (i) with the lender’s consent, purchasing the property at its then appraised value by making deferred payments for two to six years at statutorily-set interest rates; or (ii) by seeking from the bankruptcy court a stay of the proceedings for up to five years during which time the debtor could use the property by paying a rent set by the court, which payments would be for the benefit of all creditors, with a purchase option at the end of that period. Id. at 856-57.

14. Justice Brandeis noted that the “essence of a mortgage” is the right of the secured party “to insist upon full payment before giving up his security [i.e., the property pledged].” Radford, 295 U.S. at 580. In invalidating the statute, the Court stated that “[t]he bankruptcy power . . . is subject to the Fifth Amendment,” and that the pernicious aspect of this law was its “taking of substantive rights in specific property acquired by the bank prior to the act.” Id. at 589-90 (emphasis added). Thus, Congress could not pass a law that could be used to deny to secured creditors their rights to realize upon the specific property pledged to them or “the right to control meanwhile the property during the period of default.” Id. at 594. That is precisely what the Treasury Department would have Chrysler do here, with respect to the Chrysler Non-TARP Lenders’ property rights that were acquired prior to the enactment of TARP.

15. Relying on purported authority provided by TARP, the Treasury Department is demanding that Chrysler’s assets be stripped away from the coverage of the Senior Lenders’ liens – thereby impairing the rights of the Senior Lenders to realize upon those assets – so that those assets may be put in New Chrysler and used to the benefit of unsecured creditors in this proceeding, who will then be paid much more than the Senior Lenders. But, even assuming that TARP provides the Treasury Department with authority to provide funding to the Debtors and impose the transfer of collateral away from the Senior Lenders, TARP was enacted long after the Senior Lenders contracted with the Debtors and received senior liens on the Debtors’ property. Radford specifically disallowed the use of a law to retroactively alter existing liens on property.

16. Here, the proposed sale of the Debtors’ assets will leave the Senior Lenders with a diluted pool of assets and no further interests in the operating assets covered by their specific liens. The Constitution forbids this application of a law retroactively to undercut the Senior Lenders’ pre-existing property rights in favor or inferior creditors.

17. Finally, that the Treasury Department would take these unconstitutional actions to help the United States address difficult economic times is not an answer. Indeed, the same justification was expressly rejected in Radford, where Justice Brandeis noted that a statute which violated secured creditors’ rights, but which was passed for sound public purposes relating to the Great Depression, could not be saved because “the Fifth Amendment commands that, however great the nation’s need, private property shall not be thus taken even for a wholly public use without just compensation.” Id. at 602.

18. What is really striking here is that what is being proposed by the Sale Motion would strip the Collateral away and allow it to be put to use as new capital in New Chrysler for the benefit of existing and other creditors – even though the Chrysler Non-TARP Lenders have been given no opportunity to realize upon that Collateral to the point of full repayment ahead of at least $14 billion of selectively identified unsecured creditors.

One might think that a Constitutional scholar like Barack Obama would have already known that, but either this precedent escaped him or he doesn’t care about it at all.  Brandeis acted to uphold contract law, especially in the face of a government interest in paying off politically-connected unsecured creditors ahead of the senior creditors.  There is no other reason for Brandeis to make that decision, as only government could insert itself into the contractual relationship during a bankruptcy proceeding — just as Obama has done with Chrysler.

Lauria’s argument seems very compelling here, especially given Brandeis’ rather clear assertion that bankruptcy proceedings have to fall within the 5th Amendment — and that government can’t implement a taking to satisfy its own arbitrary aims by ignoring the relationship of the creditors to the default.  We’ll see whether the court rebukes Obama.

Car Designer In Chief

WASHINGTON -- The Constitution enumerates three requirements of those who would be president (they must be natural-born citizens, at least 35 and a resident within the country for 14 years) and now the government's thrashing about in the economy imposes a fourth: Presidents must be able to speak pluperfect nonsense with a straight face, lest the country understand what the government is doing. Obfuscation serves political salvation when what the government is doing includes promising that if Chrysler will sell itself to Fiat, U.S. taxpayers will lend that Italian firm $6 billion. (Will someone please explain to me how we are saving the U.S. auto industry by having Chrysler sell itself Fiat and then lending Fiat $6billion???  Why 

aren't we retaining Chrysler as a U.S. company, help them find, not appoint, new innovative management and then lend them another $6 billion of U.S. taxpayer money, if we insist on going on this auto bailout route?)

Barack Obama displayed reality-denying virtuosity last week when, announcing the cashiering of General Motors' CEO, and naming his replacement, and as the government was prompting selection of a new majority of GM's board of directors, and as the government announced the next deadline for GM to submit a more satisfactory viability plan than it submitted at the last faux deadline, and as the government kept the billions flowing to tide GM over until, well, whenever, the president said: "The United States government has no interest in running GM."

Actually, his administration prefers to do that rather than allow bankruptcy to infuriate the United Auto Workers union, which was pre-emptively grateful to Obama's administration with lavish contributions to candidate Obama. The president supposedly showed "toughness" in sacking a conspicuous member of a particularly unpopular little cohort, CEOs of big corporations. He will need more grit if, as his administration hints, this time it is serious, that its patience is wearing thin, that someday GM could face "controlled" or "prepackaged" or "surgical" bankruptcy. One suspects that those adjectives intimate that it will be faux bankruptcy, gentle in dealing with the UAW.

Last November, five months and $17.4 billion in auto bailouts ago, this column noted: "Some opponents of bankruptcy say: GM must not be allowed to fail before it perfects batteries for its electric-powered Volt, which supposedly is a key to the company's resurrection. This vehicle was concocted to serve GM's prolonged attempt to ingratiate itself with the few hundred environmentally obsessed automotive engineers in Congress. They have already voted tax credits of up to $7,500 for purchasers of such cars -- bribes that reveal doubts about consumer enthusiasm for them at a price that would reflect cost."

In December, GM, by then a mendicant groveling before its congressional masters, ran a full-page newspaper ad apologizing for having "disappointed" everyone, vowing to stop selling so many "pickups and SUVs" (which were 11 of GM's 20 most profitable products in 2008), and promising "revolutionary new products like the Chevrolet Volt." Another ad, which appeared before December and is still running, features a car attached to an electric cord, and says the 

Volt amounts to "reinventing the automobile."

Last week, in an unenthralled summary of GM's "viability" plan, Obama's administration said: "GM earns a large share of its profits from high-margin trucks and SUVs, which are vulnerable to a continuing shift in consumer preference to smaller vehicles. Additionally, while the Chevy Volt holds promise, it will likely be too expensive to be commercially successful in the short term."

The stunning shift in consumer preferences that should make the White House's freshly minted auto experts feel vulnerable has been reported under headlines such as "Like a Rock: Hybrid Car Sales Plummet" (Wall Street Journal, Dec. 9) and "Hybrid Car Sales Go from 60 to 0 at Breakneck Speed" (Los Angeles Times, March 17). Absent $4 gasoline, customers, those nuisances with their insufferable preferences, do not want the vehicles the politicians want them to want, even with manufacturers now offering large rebates and other incentives.

The two best-selling vehicles in America this year are large pickup trucks (Ford F-Series and Chevy Silverado). In February, Toyota sold 13,600 Tundra and Tacoma pickups and 7,232 Priuses. It sells the Prius at a loss, which it can afford to do because it makes pots of money selling pickups. Has the Car Designer in Chief, aka the president, considered the possibility that what he calls "the cars of tomorrow" will forever be that?

His administration cannot be faulted for failing to do well what cannot be done well -- industrial policy, wherein the political class, with negligible experience in commerce, flounders. The administration can, however, be faulted for trying. The government's wallow in the automobile industry, under this and the previous administration, merits a hockey coach's evaluation of his team: "Everyday you guys look worse and worse. And today you played like tomorrow."
