US Census

Most people have gotten their Census over the past few days and many are shocked at all of the questions.
Many are wondering what they have to legally answer…  Tip: On #9 for Race - Check the "Other" box and write in "AMERICAN". I heard that on Rush today.

Here are some answers and tips from Judge Andrew Napolitano on the Census Questions:

Most people are aware that our Constitution calls for “counting” us every ten years. No problem. But, as most of us have discovered to our concern and dismay, our Federal Government has overreached their Constitutional authority in nearly every aspect of our lives. They do it by shredding the Constitution and enacting statutes that cannot be supported by the Constitution. Now is the time to challenge them in one the most peaceful methods of Civil Disobedience.

Please join millions in preventing this continued Federal Government overreach and be prepared by knowing your rights and to handle the situation. If you have children in our lovely Government-run schools, talk with them about their rights and make sure they understand you don’t give away private information as they are using the schools to gather data as well. And, on college campuses they are using incentives to get students to give up their rights. Educate your children.

REMEMBER, GOVERNMENT MUST HAVE CONSTITUTIONAL AUTHORITY AND IF THEY CANNOT SUPPORT THEIR DEMANDS BY THE CONSTITUTION, THEY HAVE NO RIGHT TO PRIE INTO YOUR PRIVATE LIFE – ASKING YOU QUESTIONS YOU WOULD NEVER TELL A STRANGER, YOUR NEIGHBORS AND MANY FAMILY MEMBERS.

They can threaten to fine you and even quote unconstitutional Statutes, but they cannot follow through on the threats because they know it violates the Constitution. If they threaten you, say “fine, just send me the paperwork fining me which I will in turn use to sue the Federal Government for violating my Constitutional Rights.” They’ve gotten away with a lot because of threats and intimidation. Don’t let them succeed!

To prepare yourself:

1. Decide now that the ONLY question you will answer is Head Count. When you receive the form, answer only Question 1 and mail it back. You have fulfilled your Constitutional duty.

2. Obtain a copy of the Constitution and highlight the section. It’s Article 1, Section 2, Clause 3. “The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct.”

Note: “as they shall by Law direct” does not mean they can ask more questions. It only means how the law directs they obtain the head count.

3. If you receive phone calls or a personal visit from a Census worker, be prepared with the Constitution and some questions of your own. Turn the tables on them. Be polite and professional. A lot of these people are young people just doing a job to earn some money. Just stand firm in your convictions and you may educate a young person about his or her own rights.

4. Here are the questions, depending on what they say to you:

QUESTION: The Constitution authorizes the government to obtain a head count of the number of people living in the U.S. every ten years, but does not authorize the taking of private information including names of individuals. I fulfilled my constitutional duty and told you how many people live at this dwelling. From where does the Census Bureau derive Constitutional authority to demand personal information?

QUESTION: The Fourth Amendment of the U.S. Constitution prohibits government search and seizure of private information without a court warrant based on probable cause. Current Census Bureau policies violate that Amendment, do they not?

QUESTION: By what Constitutional authority does the Census Bureau threaten penalties for failure to provide personal information, which violates the Fourth Amendment?

THERE IS NO CONSTITUTIONAL AUTHORITY FOR THE “AMERICAN COMMUNITY SURVEY” WHATSOEVER WHICH THEY ARE NOW SENDING TO 250,000 EVERY MONTH.
You do NOT have to answer that at all and should refuse to mail it back, talk to them on the phone or answer the door.

QUESTION: What Constitutional Authority does the Census Bureau have to collect information every month of every year from private citizens? (and repeat your statement above about the Fourth Amendment).

Further Statement which you can send back with the Census form only answering Question 1: "I hereby affirm that the provisions of Title 13 ....requiring me to disclose my race, personal financial data, birth date, or any other personal, Private information to the Bureau of the Census, an agency of the United States government, constitutes an unreasonable, unwarranted search of my person, house, papers, and/or effects, and a governmental invasion of the sanctity of my home and the privacies of life. As such, these provisions violate the Fourth Amendment of the US Constitution, and are thus wholly void and I am not bound to obey them.
I have completed the only those sections of the Census form pertaining to the Constitutionally-mandated actual enumeration. I have thus fulfilled my obligation to the attainment of the actual enumeration of the populace of the United States.

Any fine or other sanction that is levied by any office or organization stemming from the unconstitutional provisions of Title 13 in connection with my response to this or any other Census-related questioning will be challenged in a court of law."

We must hold the Federal Government accountable to the Constitution and this is one of the best ways to take a stand for the Bill of Rights guaranteed by the U.S. Constitution.

Census Bureau Severs Ties With ACORN – Intentionally Structured as a Criminal Enterprise

Check out this US House of Representatives staff report on ACORN and see for yourself:

http://www.docstoc.com/docs/11079244/Is-ACORN-Intentionally-Structured-as-a-Criminal-Enterprise

Census Bureau Severs Ties With ACORN

The Census Director has sent a letter to the National Headquarters of ACORN notifying the group that the Census Bureau is severing all ties with the community organizing group for all work having to do with the 2010 census.

"Over the last several months, through ongoing communication with our regional offices, it is clear that ACORN's affiliation with the 2010 Census promotion has caused sufficient concern in the general public, has indeed become a distraction from our mission, and may even become a discouragement to public cooperation, negatively impacting 2010 Census efforts," read a letter from Census Director Robert M. Groves to the president of ACORN. "Unfortunately, we no longer have confidence that our national partnership agreement is being effectively managed through your many local offices. For the reasons stated, we therefore have decided to terminate the partnership," the letter said.

"Unfortunately, we no longer have confidence that our national partnership agreement is being effectively managed through your many local offices. For the reasons stated, we therefore have decided to terminate the partnership," the letter said.

The news follows the firing Friday of two more ACORN employees after new hidden-camera footage showed workers for the group advising a couple posing as a pimp and prostitute how to subvert the law.

Ranking Member of the House Committee on Oversight and Government Reform Darrell Issa (R-Calif.) reacted to the news Friday night, applauding the decision by the Census Bureau.

"ACORN had no business working on the Census. ACORN’s partisan election efforts and its involvement in criminal conduct rightly disqualified it from working on the non-partisan mission of the Census to accurately and honestly count the U.S. population," Rep. Issa said.

ACORN had previously been tapped to help with low level data gathering for the 2010 census. A copy of the director's letter has been sent to Congress and relevant committees, as well as ACORN.

Two more ACORN workers were fired Friday after a second video surfaced, this time showing staff members in the community organizers' Washington office offering to help the undercover man and woman acquire illegal home loans that would help them set up a brothel.

Those firings came less than 24 hours after another pair of ACORN officials, from the group's Baltimore office, were canned for instructing the "pimp" and "prostitute" how to falsify tax forms and seek illegal benefits for 13 "very young" girls from El Salvador that pair said they wanted to import to work as child prostitutes.

Both of the encounters were videotaped on a hidden camera wielded by 25-year-old independent filmmaker James O'Keefe, posing as the pimp — tapes that have ignited calls for investigations of ACORN, the Association of Community Organizations for Reform Now.

The group's leaders said Friday they were "appalled and angry" at what their staffers had done, but insisted the videos were part of a political "smear" campaign and not representative of the institution as a whole.

"But that does not excuse the behavior of the employees," wrote ACORN's president Alton Bennet and executive director Mike Shea. "We have fired them and are initiating an internal review of practices and reminding all staff of their obligation to uphold the highest legal and ethical standards."

O'Keefe, the filmmaker who exposed ACORN's employees, was accompanied by 20-year-old Hannah Giles, who posed as a prostitute. On a videotape of their visit to ACORN's Washington's office, they are seen receiving guidance to establish the woman as the sole proprietor of a bogus company to mask the nature of her business.

"She's not going to put on (the loan application) that she's doing prostitution ... she doesn't have to," a now-fired ACORN staffer says. "You don't have to sit back and tell people what you do."

Illegals Will be Counted in the U.S. Census… and Will Distort Representation and Elections

California could get nine House seats it doesn’t constitutionally rate because illegal aliens will be counted in 2010, concluded an opinion piece in The Wall Street Journal.

The forthcoming census, which determines the apportionment of House members and Electoral College votes for each state, will be counting all persons physically present in the country -- without regard to the legality of their status.

Set for big gains thanks to illegal populations is not only California but Florida, Illinois, Nevada, New Jersey, New York and Texas, according to the Census Bureau’s 2007 American Community Survey data.

California has 5,622,422 noncitizens (or ‘legal’ residents/aliens) in its population of 36,264,467. Based on a round-number projection by the WSJ authors of a decade-end population in the Golden State of 37,000,000 (including 5,750,000 noncitizens), California would have 57 members in the newly-reapportioned U.S. House of Representatives.

“However, with noncitizens not included for purposes of reapportionment, California would have 48 House seats (based on an estimated 308 million total population in 2010 with 283 million citizens, or 650,000 citizens per House seat),” noted the report authors.

Meanwhile, using a similar projection, the authors noted that Texas would have 38 House members with noncitizens included. With only citizens counted, it would be entitled to 34 members.

Getting counted might seem at first blush a good thing for illegals, but there is a movement afoot to encourage illegals to boycott the 2010 census.

As reported this week by sjnewsco, Rev. Miguel Rivera, head of the National Coalition of Latino Clergy and Christian Leaders (CONLAMIC), urged the boycott on attendees at a meeting of local migrant workers and sympathizers held at a Salvation Army facility in South Jersey.

CONLAMIC has been behind the boycott campaign "Legalization before Enumeration" throughout the country.

"We realize that the census is very important in setting Congressional districts and determining the distribution of funds," Rivera said. “The problem is, there is no other alternative in applying pressure to Congress to achieve fair and comprehensive immigration reform."

Furthermore, Rivera and other CONLAMIC leaders argued that officials have used previous census figures to persecute undocumented aliens.

Being counted, they say, has not been a positive thing.

While Rivera and his group express a very pragmatic interest in keeping illegals out of the count, the WSJ authors see the issue as one of Constitutionality.

“The Census Bureau can of course collect whatever data Congress authorizes. But Congress must not permit the bureau to unconstitutionally redefine who are ‘We the People of the United States,’” the authors argued.

Dr. Elizabeth Grieco, chief of the Census Bureau’s Immigration Statistics Staff, told the WSJ that the 2010 census short form does not ask about citizenship because “Congress has not asked us to do that.”

For sure , there has been a significant evolution from the kind of census envisioned by the founding fathers, noted the authors.

In 1790, the first Census Act provided for the counting of “inhabitants.”

“’Inhabitant’ was at that time a term with a well-defined meaning, maintained the authors.

As the Oxford English Dictionary expressed it, an “inhabitant” was one who “is a bona fide member of a State, subject to all the requisitions of its laws, and entitled to all the privileges which they confer.”

Op-Ed: Obama's Census Castrates Caucasians

Op-Ed: Obama's Census Castrates Caucasians

Op-Ed: Obama's Census Castrates Caucasians

By Dr. Paul L. Williams Saturday, June 27, 2009

imageThe TheLastCrusade.org
It’s invasive.
It’s corrupt.
It’s rigged.
It’s unconstitutional.

Its purpose is the legislative transformation of the United States of America into a land where conservatives, Christians, and Caucasians will become political castrados.

It is biased and prejudicial.

It serves to channel billions of dollars into bogus political actiongroups, such as Acorn.

It promotes gay rights and same-sex marriages.

It is a document that was not something drafted by the Berkley chapter of the Barbra Streisand Fan Club or the Alec Baldwin wing of the American Civil Liberties Union.

It is President Barack Obama’s 2010 Census Form.

The form asks if you have a house with running water, if you have a flush toilet, if you go to work by ferryboat or trolleycar, if you are mentally challenged, if you are of Hispanic, Latino, or Spanish origin, and if you are a white, black, negro, African American, American Indian, Asian Indian, Chinese, Filipino, Japanese, Korean, Vietnamese, Native Hawaiian, Guamanian or Chamorro, Samoan, Fijian, or Tongan

It asks if you have hot and cold running water, a sink with a faucet, a frigerator, a bathtub or shower, a stove or range, and a flush toilet.

It asks if you use coal, gas, oil, electricity, or solar energy to heatyour home or apartment, if you are deaf or blind, if you are mentally challenged, if you have a physical disability, if you are employed, self-employed, or retired, if you have troubled dressing or bathing, if you have difficulty walking or climbing the stairs, and if you speak a language other than English at home.

It asks your income, your educational level, and the time you leave your home in the morning.

But infinitely more telling is what the new census form doesn’t ask.

It doesn’t ask if you are a citizen of the U.S.A., if you are an immigrant, or if you are a Muslim.

Naturally, the questions are in English and Spanish, lest anyone think that America is an Anglo nation. Many stand in violation of the Constitution which states that a national census should concern itself solely the number of individuals in a household.

For this reason, Minnesota Rep. Michele Bachmann is refusing to answer the “very intricate” and “very personal” questions.

But there are problems with the Obama census beyond the intrusive nature of the comprehensive survey.

To assist in the hiring of census takers, the Obama Administration has opted to partner with the following special interest groups (not one of which represents the despised race of whites who settled this country):

  • ACORN
  • 100 Black Men of America
  • African American Women‚ Äôs House of Imagene (sic) Shelter
  • American-Arab Anti-Discrimination Committee
  • Arab American Institute
  • Asian American Federation
  • Asian American Justice Center
  • Asian and Pacific Islander Coalition on HIV/AIDS
  • Association of Professors and Scholars of Iranian Heritage
  • Boat People SOS
  • Hispanic Alliance for Prosperity Institute
  • Hispanic Federation
  • Fundacion Azteca
  • Latino Justice PDLDEF
  • Mas New Mexico
  • Mexican American Legal Defense and Education Fund
  • Minority Access
  • National Alliance for Hispanic Health
  • National Alliance of Black School Educators
  • National American Indian Housing Council
  • NAACP National Voter Fund
  • NAACP (National Association of Colored People)
  • National Association for Black Social Workers
  • National Association of Colored Women‚Äôs Clubs
  • National association of Hispanic Federal Executives
  • National Association of Hispanic Publications
  • National Association of Latino Elected Officials
  • National Association of Negro Business and Professional Women‚Äôs Clubs
  • National Black Chamber of Commerce
  • National Black Child Development Institute
  • National Black Justice Coalition
  • National Black Leadership Forum
  • National Coalition on Black Civic Participation
  • National Congress of Black Women
  • National Federation of Filipino American Associations
  • National Hispanic Leadership Institute
  • National Hispanic Business Information Clearinghouse
  • National Latino Research Center
  • National Minority AIDS Council
  • National Puerto Rican Coalition
  • National Puerto Rican Day Parade
  • Rainbow Push Coalition
  • U.S. Hispanic Chamber of Commerce
  • Voto Latino

Get the picture? Notice a racial bias?

These agencies will be paid millions in taxpayers’ dollars to assist the President in conducting the census and to make sure that all minorities are included in the official count.

Not one of the groups represents the despised race of white Europeans who settled this country and gave their sweat and blood to make it the most prosperous nation on earth.

Excluded from the list of census partners are such groups, as the American Legion, theVeterans of Foreign Wars, the Daughters of the American Revolution, the Elks Clubs, the Rotary Clubs, the Moose Lodge, and, of course, the Friendly Sons of St. Patrick.

This racial bias inherent in the census has raised the concern that the results will be rigged - - a concern that has been intensified by Mr. Obama’s selection of Robert M. Groves, a sociology professor at the University of Michigan,

Republican legislators have expressed alarm because Mr. Groves’s specialty is statistical sampling — roughly speaking, the process of extrapolating from the numbers of people actually counted to arrive at estimates of those uncounted and, presumably, arriving at a realistic total.

If minorities, immigrants, the poor and the homeless are those most likely to be missed in an actual head count, as Mr. Grove presumably believes, and if political stereotypes hold true, then the statistical sampling of the 2010 census will produce a windfall for the Democrat Party.

This result is certain since the census results as gathered by the above groups coupled with Mr. Grove’s calculation of the missed head count will determine which states gains seats in Congress and which ones lose them, as well as the allocation of federal dollars to states and cities based on population.

The Obama budget serves to ensure that the United States will be broke.

His foreign policies will serve the cause of the Muslim world to the detriment of Israel.

And his census will make sure that the time of the Judeo-Christian standards and culture in the land of the free and the home of the brave will come to an end.

The chickens have come home to roost.

More tomorrow

Common Sense Congressman

Freshman Congressman Jason Chaffetz from Utah is one of the few common sense people in the halls of Congress right now. One of the bills he's proposing would save taxpayers millions, and it's a great idea. Instead of hiring thousands of people to conduct the census, why not use another program that already has employees visiting houses each and every day -- the United States Postal Service. A common sense idea that makes so much sense it will certainly be shot down by Congress. Listen to Glenn's conversation with the Congressman:

Cot-Side Chat: Democrats Spend Taxpayer Money, Unchecked, Without Debate (Glenn Beck and Cong. Jason Chaffetz)

We have Congressman Jason Chaffetz on the phone who I have to tell you has come up with, you want to talk about common sense, here's common sense. The census is a nightmare and the census should not be ACORN or its subsidiaries or anything like it, they should not be getting money to do the census. And he brought up an idea in congress, and are you introducing this bill today?

CONGRESSMAN CHAFFETZ: Well, I'll be introducing it later this week but we just unveiled it today. Yeah, I'm excited about it.

GLENN: Okay. Explain what it is.

CONGRESSMAN CHAFFETZ: Well, on the one hand you have the census who is going to go out and hire some 750,000 people to count all Americans, and they are engaging with partners like ACORN to go out and find all these people to go and count everybody in America. But I also sit on the subcommittee that deals with the post office which is suffering from a huge financial crisis itself. Well, they happen to have 760,000 postal employees who are already charged with going to every home in America. So why would we be going out and getting, engaging ourselves with the likes of ACORN when we already have federal workers who already go to all these homes?

GLENN: May I total common sense. Now let me play Washington with you, okay?

CONGRESSMAN CHAFFETZ: Sure.

GLENN: The unions will stop the postal workers from doing that.

CONGRESSMAN CHAFFETZ: You know what, I laid the groundwork with the unions. They love this. There's attrition happening at the post office right now. Mail volumes are way off. They are upside down by billions of dollars. So for them to go through the training and the payment. Remember, the census was given some $11 billion in order to execute the census. That's money that they could use. Otherwise their membership is going to be depleted. They are going to have to lay people off.
GLENN: So in other words, we would be fixing two problems.

CONGRESSMAN CHAFFETZ: Yeah.

GLENN: That's why this will never pass, Jason. You're a freshman this year. That's why you are making too much sense. That won't work. They will find some way.
CONGRESSMAN CHAFFETZ: It's a little too simple. But I'm hoping that the freshman naivety will pay off. I can't imagine why we wouldn't do this.

GLENN: So this week you guys are going to vote in the house on cap and trade.
CONGRESSMAN CHAFFETZ: Yeah.

GLENN: You sit there and you deal with all of the stuff going on with, you know, with the post office. Is it true that congress spends more time debating post office stuff than cap and trade?

CONGRESSMAN CHAFFETZ: Oh, no, absolutely. I mean, we have post offices which are rightly named and it's per the Constitution, but we get 20 minutes to debate a post office. Most of this will happen with less than 5 minutes debate. Amendments that are offered on all these appropriations for the trillions of dollars we're going to spend, we're going to have one of the largest single tax increases in the history of the United States in this cap and trade and yet we're not given 20 minutes to debate that. It's insane. It is absolutely insane.

GLENN: Is it going to pass?

CONGRESSMAN CHAFFETZ: I'm afraid that they have cut too many deals on the side with Democrats who are weak kneed and that it probably will. And there will be some Republicans in there as well, but I tell you, this scares the living daylights out, between this and the move on healthcare, that

GLENN: What is in this bill that scares you?

CONGRESSMAN CHAFFETZ: Well, we were looking, for instance, at schools in Utah. They are going to have, it looks like $10,000 per school as a new cost for their energy. Now, at a time when we're losing jobs and we've got to make America more competitive and we've got to remember that manufacturing is a good thing in this country. This tax, it fundamentally changes the equation and hurts and harms America and our competitiveness on a global scale. It's a new tax. I want everybody to understand that the president said 95% of Americans weren't going to get a tax increase. 100% of Americans are going to get a tax increase with this.

GLENN: What do you mean that they are charging a new the schools have an energy

CONGRESSMAN CHAFFETZ: Well, if you look at what the utilities are expected to do in terms of jumping up in their costs, I mean, it takes electricity to run a school and so we've gone back and taken the numbers and tried to do an analysis and figure out, well, what's it going to cost each school in Utah in their bills for just electricity, and it looks like it's in the neighborhood of, like, $10,000.

GLENN: What is it going to be for the average? What about the average person?

CONGRESSMAN CHAFFETZ: Well, the average person is going to at least the analysis we did in the State of Utah, we're looking at hundreds of dollars per month in new expenses. I offered a bill that said let's require the utility companies to actually have to articulate on their bill what the cost of this increase is going to be because I mean, that's the goal. The goal of this bill is to raise energy prices. If you've raised energy prices, you use less. And but that is just the wrong formula for America.

GLENN: Jason, how do we survive, how do we no, no, I'm not going to waste time on that question. Let me ask you this: There are eight million people within the sound of my voice right now and yours, and they are tired of calling and being ignored. They don't feel like anybody in Washington is listening to them. What gets the attention in Washington? What can they possibly do? What should they do?

CONGRESSMAN CHAFFETZ: Flush the toilet, you know? It's not everybody else's congressmen but yours. You've got to go look hard at your congressmen and your senators and figure out where they are on these issues and hold them accountable and work hard to make sure that you make a change within that district because
GLENN: What do they do for this Friday we're having the largest tax increase ever, according to your numbers, with the cap and trade. What do they do to stop it?

CONGRESSMAN CHAFFETZ: They've got to bombard their members of congress with faxes and e mails and telephone calls that does get their attention. They have got to write letters to the editor and get it on the Internet and expose what this really is. They have got to wake up and actually take action. And it does have an effect. It really does.

GLENN: Okay. Jason, thank you very much. We'll talk to you again.

CONGRESSMAN CHAFFETZ: Thanks, Glenn.

GLENN: Congressman Jason Chaffetz. Thank you so much, we'll talk again.

Hmmm… What a great idea, saving millions of taxpayer dollars; using a known reliable source to take the census instead of ACORN a questionable entity already under investigation on several fronts; and asking the one and only question that is the government’s business as part of the census… How many people live here…!!!

Rep. Bachmann Refuses To Fill Out 2010 Census

(AP) - Posted by Prerana Swami

Minnesota Rep. Michele Bachmann told the Washington Times that she and her family will not be fully filling out the 2010 census forms.

Bachmann, a Republican, said her family will only be indicating the number of people in the household, because "the Constitution doesn't require any information beyond that."

Bachmann believes the upcoming census to be "very intricate" and "very personal" and expresses concerns about ACORN's involvement in the data collection. The community organizing program came under scrutiny after charges of voter registration fraud during the 2008 presidential elections.

"I think what the threat of ACORN would be deluding the ballot box and the effectiveness of our vote," she said. "They will be in charge of going door to door and collecting data from the American public, this is very concerning."

Bachmann also expressed frustration at the president's backing for ACORN, saying he has supplied $8.4 billion to ACORN since he has come into office, a number that far surpasses the $53 million given in the past 15 years.

"ACORN has received $53 million from 1994 to today, but now, since President Obama has come into office, he is making available $8.5 billion – with a 'b' - to ACORN, an organization that is repeatedly under indictment for voter fraud in multiple states across the country," Bachmann said. "This is the last organization that should have the taxpayer's wallet open to them but unfortunately, under President Obama, he is multiplying the amount of money available to them."

Bachmann has claimed the $8.5 billion available multiple times, but it should be noted that the St. Petersburg Times' affiliated fact check Web site, Politifact.com, disputes its accuracy.

According to the U.S. Census Bureau, Bachmann may be in trouble if she fails to fill out the entire census. Spokeswoman Shelly Lowe told the Washington Times that anyone over the age of 18 must fill out all the questions and any such person who refuses to answer "any of the questions" faces a $5,000 fine.
