Obama Not Only the Food Stamp President but also the Gun Sale President

Just as more food stamps are issued daily, weekly, monthly, and yearly since President Obama has been in the White House, so has the purchase, storage, interest in and training in the use of guns and ammunition.

Gingrich has a point in painting Obama as an entitlement president… the food stamp president, said Robert Rector, senior research fellow at the conservative Heritage Foundation. Spending on income-based programs, such as food stamps, has increased by one-third to $900 billion under Obama. There are 70 such programs.

A record 44.7 million people -- or 1 in 7 Americans -- were on food stamps last year.

The food stamp rolls have swelled more under Obama's tenure than under his recent predecessors. Also, his 2009 Recovery Act allowed even more people to sign up.

The number of people in the Supplemental Nutrition Assistance Program has soared to an average 44.7 million in fiscal 2011, up 33% from fiscal 2009. Obama's stimulus act made it easier for childless, jobless adults to qualify for the program and increased the monthly benefit by about 15% through 2013.

In fiscal 2011, the federal government spent more than $75 billion on food stamps, which provided an average monthly benefit of $133.85 a month, according to the U.S. Department of Agriculture. That's up from $34.6 billion at the end of fiscal 2008, when recipients collected an average benefit of $102.19.

Much of what's driving the steep climb in enrollment is the nation's worst economic downturn since the Great Depression, when the food stamp program was created.  And that is the problem… Obama has no jobs program, no corporate or true government experience, and therefore there are no jobs so people are desperate and must apply for more and more entitlement programs and causes the need for children to stay on their parent’ medical insurance until age 26… instead of getting out on their own.

You wouldn’t guess that the nation’s economy is in the doldrums by looking at the activity on the floor of the Sands Expo & Convention Center in Las Vegas this week. This is the week of the annual SHOT Show, when tens of thousands of members of the firearms and outdoor sports industry make a pilgrimage to Las Vegas to attend the industry’s biggest trade event. Sponsored by the National Shooting Sports Foundation, or NSSF, SHOT stands for “shooting, hunting and outdoor trade.” It is where manufacturers, importers, dealers, wholesalers and distributors get together to examine wares, make connections and do business – lots of business.

As I’ve been making my way around the acres and acres of the exhibit hall, talking to old friends and meeting new folks, there are two things that are very clear: Business is good, but people are concerned about the future.

It has been suggested that Barack Obama should receive the title of Firearms Salesman of the Year for the past three years, but you find little interest in extending his tenure. Sentiment runs high (and high is an understatement) in favor of Mr. Obama being held to a single term.

Nonetheless, there is much concern about the Republicans’ ability to deliver a candidate who can defeat him. The consensus seems to be almost as opposed to Mitt Romney as they are to Obama. Romney’s enthusiastic support for an “assault weapons” ban when he was Governor of Massachusetts leaves gun owners mistrustful of him. Nor is the idea of a Republican-controlled Congress with Romney in the White House an especially reassuring prospect, since politicians tend to stand with their president.

Several people pointed toward the tragic murders in Tucson when Rep. Gabrielle Giffords was wounded and suggested that had Romney been president at that time, a ban on magazines over 10 rounds would almost certainly have been enacted. Republicans seem to excel at shooting themselves in the foot – particularly when they control both Congress and the White House – and the gun industry has noticed.

Support for Newt Gingrich seems higher, but still far from enthusiastic. Folks I spoke with felt that Gingrich had reneged on promises to work to repeal the Clinton “assault weapons” ban after gun voters had been so instrumental in sweeping Republicans into power in 1994. There is no question that Gingrich is saying all the right things to gun voters during the campaign, but we’ve heard him say the right things before. Even so, it is encouraging that he is making the effort to win over gun voters themselves and not simply kissing the rings of the high priests at the National Rifle Association. He has answered the Gun Owners of America surveys, and responded to queries from grassroots groups.

The most frequent comments I’ve heard about presidential candidates have been laments that Ron Paul couldn’t win the election. Paul is the most principled of the Republican candidates and holds the strongest views in support of the Second Amendment and citizens’ right to arms, but that favorable impression was almost universally dampened by a belief that he is unelectable. There were also concerns expressed about Paul’s positions on other issues, particularly the perception that he is an isolationist.

My perception is that this crowd has three main concerns about Dr. Paul: his electability, the speed with which he suggests he wishes to implement his aggressive agenda and the utter lack of support he would receive from both the Democrats and the Republicans in Washington. So far the Republican establishment continues to treat Paul and his increasingly popular libertarian views (which are much in line with the positions of the tea party) with disdain and dismissal rather than embracing and trying to co-opt those positions.

Listening to the talk here at SHOT, I am becoming more convinced that Paul could actually win the nomination if everyone who prefers him actually came out in support and voted for him rather than hedging their bets by playing the electability game.

With the elections up in the air, it is surprising that this industry continues to be one of the few that is really doing well, and no one seems to be able to explain the sector’s strength. Since late in 2008 when it began looking likely that Obama was going to be the next president, sales of firearms and ammunition have gone through the roof. Some have attributed the boom to fears that Obama was going to institute new firearms regulations and that consumers felt they’d better buy what they could before new laws and regulations made it impossible. That was certainly a part of it, particularly in 2009 when no one knew what to expect from the new, liberal president. But this is 2012, Obama has shown little interest in stirring up the wrath of gun owners, and his time in office could soon be coming to a close. Still, firearms sales for this past December topped all previous records with over 600,000 transactions on Black Friday alone.

At a time when the U.S. economy teeters on the brink of collapse, unemployment remains in double digits and crime is at record lows, it would seem strange that an industry considered to be driven by wants rather than needs is doing so well.

Prices on basic handguns generally start at around $400 and go up from there, with many production guns priced well over $1,000 and specialized or custom guns running up in the $4,000-5,000 range or more. Prices on rifles are similar, with basic bolt actions starting around $400 and prices on the popular AR platform rifles running from around $1,000 to well over $4,000. Shotguns run an even broader spectrum, with some models priced around $200 and top-of-the-line Perazzis listed at close to $100,000.

The point is, this is not an inexpensive hobby, nor is there any single, stand-out factor driving the market. More significant is that the boom is not restricted to just firearms and ammunition, but includes hunting and camping gear, archery equipment, truck accessories, boots, ropes and pocket knives – not to mention the whole law enforcement sector, which is also well represented here at the show.

Personally I see the boom being driven by a combination of factors with fear of restrictions being significant, but not overriding. I think the additional exposure and cultural acceptance of firearms and hunting in recent years – from political threats and posturing, to the Fast & Furious debacle, to TV shows like “Top Shot,” “Sons of Guns” and the ever-growing cable hunting shows.

Another major factor is the number of young people who have been introduced to shooting in exotic locales like Iraq and Afghanistan. We saw a similar surge in interest in the shooting sports at the end of World War II and even after the Civil War, when Northern generals founded a shooting group called the National Rifle Association.

Whatever the reasons, Americans are rediscovering the fun and utility of guns and the shooting sports, and they are putting their hard-earned money into it. If you haven’t tried this fun and useful pastime, I would encourage you to give it a shot. The National Shooting Sports Foundation provides tremendous resources for anyone interested at www.NSSF.org, including places to shoot and a free introductory program called First Shots.

Thomas Jefferson recommended shooting as a worthwhile pastime for developing discipline and building character. It also serves to help keep people safe and our country free – not to mention bolstering the economy. If you already enjoy shooting, share it with a friend. Washington Examiner — On May 3, U.S. Attorney General Eric Holder testified before House Oversight and Government Reform Chairman Darrell Issa’s committee that he only learned about the government’s sale of weapons to Mexican drug cartels “in the last few weeks.”

But Big Government found a 2009 speech by Holder on the Department of Justice’s own website that proves the attorney general was well aware of Operation Gunrunner back in 2009:
The problem with Holder’s feigned ignorance is that he gave a speech in Cuernavaca, Mexico, on April 2, 2009, in which he boasted about Operation ‘Gunrunner” and told Mexican authorities of everything he was doing to insure its success.

When questioned by the media, Holder also denied knowing anything about Gunrunner:
“Holder’s office at first vehemently denied ATF has ever knowingly allowed weapons to get into the hands of suspected gunrunners for Mexico’s drug cartels,” CBS News investigative correspondent Sharyl Attkisson reported.

But at the arms trafficking conference in Cuernavaca, Holder not only acknowledged the program, he bragged that he was in the process of expanding it:

“Last week, our administration launched a major new effort to break the backs of the cartels. My department is committing 100 new ATF personnel to the Southwest border in the next 100 days to supplement our ongoing Project Gunrunner, DEA is adding 16 new positions on the border, as well as mobile enforcement teams, and the FBI is creating a new intelligence group focusing on kidnapping and extortion. DHS is making similar commitments, as Secretary Napolitano will detail.”

So Holder’s May 3rd denial appears to be refuted by his own words.”

Mexican authorities have repeatedly complained that most of the weapons used by drug cartels there — including Barrett rifles — are coming from the U.S. The ATF’s Fast and Furious probe allowed guns to be trafficked south of the border in an effort to nail high-level cartel operative /Eduardo Verdugo/Associated Press

Meanwhile, the guns that Obama and Holder allowed to “walk” to the drug cartels…some of which have killed 2 Border Patrol agents and dozens of Mexicans, are still showing up in all the wrong places ….like, Arizona crime scenes.

Our theory is that this was a Machiavellian move by the president and Attorney General Eric Holder to “gin up” public support for assault gun and other weapon controls.

This theory becomes even more compelling by the president’s own announcements this past week that he will “bypass Congress” to institute gun controls “of some kind” soon.
We are in a constitutional crisis with this administration. We have accessories to murder and obstruction of justice in the White House. Who will take action?

These guns “walked” into the hands of some of the most violent criminals in the world, and have been connected to the murders of two Border Patrol agents and several dozen Mexicans. Many innocent people have died to further the radical liberal gun-control agenda of the White House.

Barack Obama and Eric Holder should go to jail for this. Will the shameful, ideological American news media ever begin to cover this scandal?

Here we are thinking that there’s got to be a Watergate moment – the 18½ minutes of tape, Deep Throat, the Plumbers – to connect the final dot between the ATF’s Gunwalker scandal and Obama. Nope. Turns out, we just had to go back and watch some C-SPAN reruns, and there it was, straight from the Assistant US Attorney’s mouth. Obama Ordered ATF’s Gunwalker. Wow. I mean, so we’re clear, the U.S. AG’s office was bragging about Gunwalker as a part of Obama’s “get tough on the border” policy. Or to put it in terms that a Democrat can understand, “he was for it, before he was against it.” Um-hmmm. And he approved it before he tried to distance himself from it.

Get a satellite phone. it might not work well but it doesn't go through the internet. A ham radio wouldn’t be a bad idea either!

Plan on a war starting sometime between August and the end of year (2011), people might not be able to go to Israel for Beck’s event or any other reason.

Many feel this move on guns and the second amendment may accelerate the possibility of violence or even a war in the U.S.

If you don’t own a gun, plenty or ammo or a way to make it… now would be the time to think about how you plan to protect yourself, if the worst happens!

Don't plan on election in 2012. In fact don't plan on much for 2012 except hyperinflation. (And if there is one, you can bet that it won’t be fair… so remain vigilant!!)

Stock up on what you can now. Might not be able to later.

Agenda Behind Fast & Furious Gunrunner Program - NoisyRoom

While clear-thinking Americans can agree that Obama and Holder’s Justice Department made a fatal error in instituting “Operation Fast and Furious,” whereby thousands of weapons were knowingly placed in the hands of straw buyers who illegally crossed our southern border, few are asking why such a dangerous program was created.

There was a definite agenda and we need to go back to 2009, shortly after Obama was sworn in as President, to understand its origin.

At the start of the Obama regime, Obama and Hillary Clinton publicized that 90% of the guns used in crimes committed in Mexico came from the U.S. By April of 2009, FOX News had investigated this assertion and proved it was false. Only 17% – not 90% – of the weapons confiscated in Mexico were U.S. weapons.

Mainstream media did not report that Obama and Clinton’s claims were false and, instead, perpetuated the lie and the Obama administration moved forward with Operation Fast and Furious to make the lie a reality. To date, Obama has not been held to account for the false information he and his administration thrust forward for public consumption in 2009 and by the end of this article, you will see how this fits into a larger agenda with a purposeful outcome.

The Obama administration instituted their “bottom up” program – Fast and Furious. Their plan, aptly named, was designed to quickly and deliberately put as many U.S. weapons as possible into the hands of straw buyers who would bring them across the border into Mexico and into the hands of the drug cartels. This would ensure that when those weapons were retrieved and counted by Mexico’s law enforcement units, the numbers would then show a larger percentage of weapons coming from the U.S.

Congressman Darrell Issa (R-CA) has held congressional hearings on Fast and Furious and released redacted emails which described the following (emphasis added), as reported by Jordy Yager at The Hill:

“In one of the emails, released by Rep. Darrell Issa (R-Calif.), with the subject heading “Director’s questions,” the supervisor of the “Fast and Furious” operation wrote to the assistant special agent in charge of Phoenix field operations with an Internet Protocol address for one of the video monitoring units in a gun store which was authorized to sell guns to the suspects.

The emails seem to indicate that ATF acting director Kenneth Melson had asked for this information. “With this information, acting Director Melson was able to sit at his desk in Washington and – himself – watch a live feed of the straw buyers entering the gun stores to purchase dozens of AK-47 variants,” said a Republican committee statement…

In another email dated March 10, 2010, the assistant special agent in charge of the Phoenix field operations wrote to the supervisor of the “Fast and Furious” operation and said, “Not sure if you know, but Mr. Melson and Mr. Hoover are being briefed weekly on this investigation and the recent success with [redacted] so they are both keenly interested in case updates.”

Prior to release of the emails, ATF’s letters to legislators denied that they were selling these weapons to straw buyers and in fact they “made every effort to prevent weapons from ending up in Mexico.”

However, the truth is documented (emphasis added) by Dave Workman at The Examiner, who has been reporting on this story for over four months since David Codrea (National Gun Rights Examiner) and Mike Vanderboegh (independent blogger) first uncovered the program:

“Operation Fast and Furious was an off-shoot of the larger Project Gunrunner, conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives. This controversial operation allowed an estimated 2,000-2,500 guns to “walk” into Mexico as ATF field agents were repeatedly ordered to “stand down” by their supervisors.”

“ATF agents have shared chilling accounts of being ordered to stand down as criminals in Arizona walked away with guns headed for Mexican drug cartels. With the clinical precision of a lab experiment, the Justice Department kept records of weapons they let walk and the crime scenes where they next appeared. To agents’ shock, preventing loss of life was not the primary concern.” — Congressman Darrell Issa

“The Issa/Grassley report, The Department of Justice’s Operation Fast and Furious: Accounts of ATF Agents, contains some chilling revelations:

Highlights of the report include:

· The supervisor of Operation Fast and Furious was “jovial, if not giddy, but just delighted about” walked guns showing up at crime scenes in Mexico according to an ATF agent. (p. 37)

· Another ATF agent told the committee about a prediction he made a year ago that “someone was going to die” and that the gunwalking operation would be the subject of a Congressional investigation. (p. 24)

· The shooting of Congresswoman Gabrielle Giffords created a “state of panic” within the group conducting the operation as they initially feared a “walked” gun might have been used. (p. 38)

· One Operation Fast and Furious Agent: “I cannot see anyone who has one iota of concern for human life being okay with this …” (p. 27)

· An ATF agent predicted to committee investigators that more deaths will occur as a result of Operation Fast and Furious. (p.39)

· Multiple agents told the committee that continued assertions by Department of Justice Officials that guns were not knowingly “walked” and that the DOJ tried to stop their transport to Mexico are clearly untruthful. (p. 45-50)”

Quick re-cap – Obama, Clinton and Holder deliberately instituted Operation Fast and Furious for the sole purpose of increasing the number of U.S. weapons that “walked” into Mexico. Remember some of the facts:

· ATF agents were repeatedly told to “stand down” as the guns “walked;”

· The supervisor of this operation was “jovial” and “just delighted” when “walked” guns appeared at crime scenes in Mexico;

· No one had “one iota of concern for human life;” and

· “Acting Director Melson was able to sit at his desk in Washington and – himself – watch a live feed of the straw buyers entering the gun stores to purchase dozens of AK-47 variants.”

Why did Obama, Clinton and Holder do this? It’s obvious to even the most casual observer; they did this to further the propaganda they pushed in early 2009 – that the U.S. has a gun problem because “90%” of the confiscated weapons in Mexico are coming from the U.S. – in order to justify more aggressive restrictions on gun ownership in the U.S.

Keep in mind that when the operation was created in 2009, the Obama administration had not anticipated that it would be exposed. The Democrats had a majority in both the House and Senate and any investigation would have had to have been brought forward by their own party – which Obama, Clinton and Holder knew would not happen. But there were several things they didn’t anticipate:

Marxists will always tell you that the ends justify the means. Creating the very problem they can claim they’re prepared to solve isn’t a new tactic for Progressives, but this is only part of the story.

Congressman Issa will fail the American people if he stops short and fails to investigate and determine the true purpose of Operation Fast and Furious. To say that it was a dumb program and needs to stop will miss the true agenda behind the creation of the operation in the first place.

While the “bottom up” Operation Fast and Furious continued, so too has Obama’s “top down” operation – the United Nations (UN) Small Arms Treaty.

Did you know that the UN has an Office for Disarmament Affairs? Did you know the Obama administration has been working closely with the UN and firmly supports the UN Small Arms Treaty, which Obama and Clinton fully intend to thrust upon America?

As I reported on April 18, 2011 in the article “THE GLOBALISTS’ TAKEOVER OF AMERICA: Part 3 – WEAKEN MILITARY & CIVILIAN DEFENSE”…

“In addition, the globalists (including Obama and Hillary Clinton) intend to enact the Small Arms Treaty which will restrict gun ownership for American citizens under the UN Office for Disarmament Affairs. Harm our soldiers and disarm our citizens and America is ripe for attack and invasion on our own soil. Couple the Small Arms Treaty with the President’s Executive Order granting international police (INTERPOL) full immunity on American soil, along with the National Civilian Security Force that Obama has been creating, and the clear and present danger to America is obvious.

The danger to America is reinforced by Eric Holder’s DOJ secretly arming Mexico’s drug cartel to put American citizens at greater risk in border-states, and Obama arming radical Islamists in Libya to put American soldiers at greater risk under UN control in Libya.”

If the Obama administration’s agenda isn’t yet clear, despite the facts from emails, testimony, investigations, reports and the links in this article, add the fact that during the Operation Fast and Furious hearings, Mike Lillis at The Hill reported what ensued when ATF Special Agent, Peter Forcelli, stated the following (emphasis added):

“I think perhaps a mandatory minimum one-year sentence might deter an individual from buying a gun,” Forcelli said.

He was responding to a question from Rep. Carolyn Maloney (D-NY), who said the current penalties are so weak that they discourage state prosecutors from pursuing straw-purchase cases. Forcelli agreed the current penalties do little to intimidate straw purchasers.

That brief exchange prompted Issa to intervene.

“We’re not here to talk about proposed gun legislation,” Issa said…

Maloney defended her line of questioning, saying she was “trying to figure out why … prosecutors often decline these gun cases.”

Rep. Elijah Cummings (Md.), the senior Democrat on the oversight panel, also questioned Issa’s authority to mute Forcelli.”

Then Paul Helmke, President of the Brady Campaign to Prevent Gun Violence, reinforced the fact that it’s really about gun control when he said in a statement on Wednesday:

“It’s also critically important that we examine why our gun laws are so weak that they make trafficking so easy in the first place.”

No mention was made by the Democrat representatives or by Paul Helmke that the Obama administration is aiding and abetting the transfer of U.S. weapons into Mexico via a program they designed, implemented and oversaw – complete with “acting Director Melson who was able to sit at his desk in Washington and – himself – watch a live feed of the straw buyers entering the gun stores to purchase dozens of AK-47 variants,” and “ATF field agents were repeatedly ordered to “stand down” by their supervisors.”

The agenda behind Operation Fast and Furious is only one piece of a larger operation to diminish and ultimately extinguish the 2nd Amendment rights of law-abiding Americans. The 2nd Amendment, as ratified by the States, reads:

A well regulated militia being necessary to the security of a free State, the right of the People to keep and bear arms shall not be infringed.

Wyoming Adopts 'Constitutional Carry' of Firearms

An important step was taken yesterday in Wyoming toward restoring the constitutionally protected right of Americans to keep and bear arms, as that state became the second in less than a year to enact legislation affirming the right of its citizens to carry a concealed firearm without a special government-issued license. Following adoption in the state Senate, the vote of the House in the Wyoming legislature approved the bill by a vote of 48–8 several weeks ago, and Gov. Matt Mead (photo, left) signed it into law on March 3.

The right to carry a concealed firearm without a special license issued by the state is often referred to as “constitutional carry.” Wyoming is now the fourth state in the Union that recognizes constitutional carry, joining Alaska, Arizona, and Vermont. Prior to Wyoming’s action, Arizona was the most recent state to adopt constitutional carry; Governor Jan Brewer signed the legislation in April of last year, and it went into effect a few months later, on July 29.

It appears that the trend toward “constitutional carry” is likely to continue, with several states weighing adoption of measures similar to that which became law today in Wyoming. An article from the Associate Press declares that “Similar bills are pending in states including Colorado, Minnesota, Montana, New Hampshire, South Carolina, and Utah. A bill has been introduced in Kentucky but hasn’t advanced while another was introduced for discussion in Idaho.”

In the aftermath of the Tucson tragedy, organizations opposed to Second Amendment-defined rights attempted to exploit the deaths and injuries that occurred when Jared Loughner allegedly attempted to murder Rep. Gabrielle Giffords (D-Ariz.) However, the fumbling efforts of Pima County Sheriff Clarence Dupnik to politicize the tragedy appears to have backfired on the gun control lobby: rather than scaring the populace into surrendering more of their rights for the illusion of security, January 2011 gun sales surged 9.7 percent over the same month the previous year—an increase which builds on a trend in gun purchases since November 2008.

Undoubtedly, there are several factors are behind the movement at this time to restore more of the constitutionally recognized right to keep and bear arms to the people of the United States. Economics and a greater perceived need to be responsible for one’s own defense are among those factors. In the words of the AP article:

The push to expand permit-free carry of concealed guns is coming from people demanding the freedom to protect themselves in tough economic times without the requirement to pay for state permits, National Rifle Association spokesman Andrew Arulanandam said.

“It’s an organic movement,” Arulanandam said. “I think certainly we are leading the charge — I’m not hiding behind it. A lot of this is organic in the sense that it comes from people realizing that when something bad happens, it’s up to them to defend themselves and their loved ones. And when something bad happens, instant responders are better than ‘first responders.’”

Another factor in the push to expand the right of self-defense in the direction of the liberty enumerated in the Bill of Rights is the sense that many Americans have that their liberties have been steadily eroded for many years. The same concerns that animated Tea Party activists and other constitutional conservatives are active in the movement for constitutional carry. People who neglect the exercise of their constitutional rights may soon find those rights have been usurped by the State. First in Arizona and now in Wyoming, the people are pushing back.

Feds sneaking around Congress to regulate firearms

The Bureau of Alcohol, Tobacco, Firearms, and Explosives, or ATF, has a long history of excess and overreaching … and they're at it again.

Using exaggerated reports of gun smuggling from the U.S. into Mexico as their justification, the agency has filed for an emergency regulation requiring gun dealers to keep track of their customers and file special reports to ATF whenever a customer purchases more than one semi-automatic rifle within any 5-day period. Such special reporting is already required for multiple sales of handguns and has proven to be thoroughly useless as a law enforcement tool.

ATF's requested regulation – which is unconstitutional, violates a statutory prohibition against firearms registration schemes and was obviously filed as an "emergency" simply as a means of bypassing Congress – would be "temporary," meaning that it would have to be renewed in four or five months, and is said to only apply to gun dealers in states bordering Mexico, though the regulation, as submitted, seems to be missing that specific limitation.

At this point the proposed regulation is awaiting approval from the White House Office of Information and Regulatory Affairs. Political observers will recall that OIRA is headed by President Obama's old friend Cass Sunstein, who famously advocated for the abolition of all hunting and for the extension of legal rights – including the right to have a court-appointed attorney – to animals.

While Mr. Sunstein is an attorney and college professor specializing, in part, in constitutional law, his record shows that his Constitution does not include the Second Amendment. It is expected that Sunstein's office will approve ATF's Emergency Regulation by the first week of January unless there is immediate and vehement objection from members of Congress and the public.

In the late '70s, shortly after my late father, Neal Knox, took over the NRA's lobbying efforts, ATF leaders attempted to expand their power by implementing a regulatory scheme requiring that gun manufacturers add a government-defined 13-digit serial number to every gun and that dealers report detailed information, including that new serial number, to ATF for every sale. Records of those sales, guns, and purchasers were to be stored in ATF computers. It was gun registration, pure and simple. The scheme might have slipped through had it not been for the heightened visibility of ATF due to Dad's efforts and his immediate sounding of the alarm when the proposal was introduced.

Congress had upon numerous occasions debated the idea of a federal gun registration law and had rejected the idea on each occasion. For ATF to decide to bypass Congress and implement such a registration scheme via regulation was rightly perceived as an affront by many members of Congress, and their indignant response was to remove some four million dollars from the agency's operating budget (the amount ATF said they expected to spend on the scheme.)

That overreach, along with egregious abuses of honest gun dealers by the ATF led to the introduction of the McClure-Volkmer Firearms Owners Protection Act to repeal some of the more onerous and confusing sections of the Gun Control Act of 1968.

It is to be hoped that current members of Congress will have a similarly indignant response to ATF's overreaching in this instance, as here again the agency is trying to implement by regulation something which the Congress has considered and rejected in the past.

Rights opponents will argue that rights activists like me are overly sensitive and unyielding in our positions and that we reactively oppose any firearms regulations regardless of how benign or effective they may be. There will be an inclination to accept ideas like this and then place the burden of proof upon rights advocates to explain why it's a bad idea.

Really, the burden of proof belongs to those who wish to interfere with our rights. It is up to ATF to show the legal authority to institute this proposed regulation and that it does not violate the spirit or intent of any existing law. It is also up to the ATF to show that their proposed regulation will be effective and productive as a means of fighting illegal gun trafficking.

The fact is that ATF can present no such evidence in support of their idea, just the suggestion that the proposal sounds reasonable and might be of use. That's not good enough.

It is overreaching for an agency to follow after Congress and enact regulations where Congress has refused to enact laws, especially where Congress considered and discarded those exact actions.

It is extra-legal for an agency to ignore statutory limitations barring the collection or archiving of information about gun purchasers, not to mention limitations under the Paperwork Reduction Act forbidding unnecessary increases in paperwork burdens.

The multiple-sales reporting scheme claims to be aimed at keeping guns out of Mexico, but it fails on that point as well.

First, it will have little effect on gun smuggling in Mexico, for smugglers familiarize themselves with the laws they are breaking. They will easily avoid ensnaring themselves in such an obvious trap.

Second, while the actual number of guns that arrive in Mexico from the USA is impossible to determine, we know that the number being reported is inflated since the ATF only traces those guns selected by the Mexican authorities. There is strong evidence that American civilian gun shops are only one of many sources of guns in Mexico, and a minor one at that. Pictures of confiscated arms in the Mexican press routinely include grenades, rocket launchers and heavy machine guns, arms that aren't in the U.S. civilian inventory.

Finally, the proposed multiple-sale scheme places a significant burden on dealers and puts them at increased risk of prosecution for clerical errors if they fail to detect a repeat buyer in a timely fashion.
