Montanans Launch Recall of Senators Who Approved NDAA Military Detention – Updated

Well it is about damned time… When our representatives that took an oath to OBEY and protect the Constitution repeatedly break that oath by voting FOR laws or bills that anyone that understands the simple language in our Constitution, it is our Duty to remove them from office by any ethical and moral means available.

The Senate passed NDAA giving this president — and every future president — the power to order the military to pick up and imprison without charge or trial civilians anywhere in the world. Even Rep. Ron Paul (R-Texas) raised his concerns about the NDAA detention provisions during last night’s Republican debate. The power is so broad that even U.S. citizens could be swept up by the military and the military could be used far from any battlefield, even within the United States itself.

The worldwide indefinite detention without charge or trial provision is in S. 1867, the National Defense Authorization Act bill, which will be on the Senate floor on Monday. The bill was drafted in secret by Sens. Carl Levin (D-Mich.) and John McCain (R-Ariz.) and passed in a closed-door committee meeting, without even a single hearing

The Issue of Federal Official Recall Has Never Reached the Federal Courts

“Montana is one of nine states with provisions that say that the right of recall extends to recalling members of its federal congressional delegation, pursuant to Montana Code 2-16-603, on the grounds of physical or mental lack of fitness, incompetence, violation of oath of office, official misconduct, or conviction of certain felony offenses.” (SOURCE)

The operative language “violation of oath of office” applies here. We have nine states that can start a snowball of recalls to at least remove and ostracize or better convict these traitors to “we the people” and the nation.

The fact is, “we the people” can go further in the other 49 states by influencing our state U.S. Supreme Courts Grand Juries to subpoena these traitors, in their home states, to determine whether laws have been broken. We just need a few constitutional lawyers to get the ball rolling. No need for petitions or other legal mumbo jumbo. Once a grand jury has determined that laws have been broken, the trials can commence.

This is from a statement from Stewart Rhodes of Oathkeepers regarding Republican Denny Rehberg as a target of recall, who also voted for NDAA.

Here in Montana, while we will go after all three violators of the Bill of Rights, I will place special emphasis and "focus of effort" on Denny Rehberg, since he is so fond of wrapping himself in the flag and claiming to be defending the Constitution while his votes do the exact opposite. In that sense, Rehberg is much like John McCain and Lindsey Graham, two Republicans who, right along with Carl Levin and Joseph Lieberman, are leading a sustained and relentless assault on our Bill of Rights.

Moving quickly on Christmas Day after the US Senate voted 86 - 14 to pass the National Defense Authorization Act of 2011 (NDAA) which allows for the indefinite military detention of American citizens without charge or trial, Montanans have announced the launch of recall campaigns against Senators Max Baucus and Jonathan Tester, who voted for the bill.

Montana is one of nine states with provisions that say that the right of recall extends to recalling members of its federal congressional delegation, pursuant to Montana Code 2-16-603, on the grounds of physical or mental lack of fitness, incompetence, violation of oath of office, official misconduct, or conviction of certain felony offenses.

Section 2 of Montana Code 2-16-603 reads:

"(2) A public officer holding an elective office may be recalled by the qualified electors entitled to vote for the elective officer's successor."

The website Ballotpedia.org cites eight other states which allow for the recall of elected federal officials: Arizona, Colorado, Louisiana, Michigan, Nevada, North Dakota, Oregon, and Wisconsin. New Jersey's federal recall law was struck down when a NJ state judge ruled that "the federal Constitution does not allow states the power to recall U.S. senators," despite the fact the Constitution explicitly allows, by not disallowing ("prohibited" in the Tenth Amendment,) the states the power to recall US senators and congressmen:

"The powers not...prohibited...are reserved to the States...or to the people." - Tenth Amendment of the U.S. Constitution.

The issue of federal official recall has never reached the federal courts.

Montana law requires grounds for recall to be stated which show conformity to the allowed grounds for recall. The draft language of the Montana petitions, "reason for recall" reads:

"The Sixth Amendment of the U.S. Constitution guarantees all U.S citizens:

"a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed..."

The National Defense Authorization Act of 2011 (NDAA 2011) permanently abolishes the Sixth Amendment right to a jury trial, "for the duration of hostilities" in the War on Terror, which was defined by President George W. Bush as "task which does not end" to a joint session of Congress on September 20, 2001.

Those who voted Aye on December 15th, 2011, Bill of Rights Day, for NDAA 2011 have attempted to grant powers which cannot be granted, which violate both the spirit and the letter of the Constitution and the Declaration of Independence.

The Montana Recall Act stipulates that officials including US senators can only be recalled for physical or mental lack of fitness, incompetence, violation of the oath of office, official misconduct, or conviction of a felony offense. We the undersigned call for a recall election to be held for Senator Max S. Baucus [and Senator Jonathan Tester] and charge that he has violated his oath of office, to protect and defend the United States Constitution."

Montana residents William Crain and Stewart Rhodes are spearheading the drive. Mr. Crain is an artist. Mr. Rhodes is an attorney, Yale Law School graduate, and the national president of the organization Oath Keepers, who are military and law enforcement officers, both former and active duty, who vow to uphold their Oath to the US Constitution and to disobey illegal orders which constitute attacks on their fellow citizens. Rhodes said:

"These politicians from both parties betrayed our trust, and violated the oath they took to defend the Constitution. It's not about the left or right, it's about our Bill of Rights. Without the Bill of Rights, there is no America. It is the Crown Jewel of our Constitution, and the high-water mark of Western Civilization."

Rhodes noted that:

"Two time Medal of Honor winner Marine General Smedley Butler once said "There are only two things we should fight for. One is the defense of our homes and the other is the Bill of Rights." Time to fight. "

Butler famously ended his career as a Marine General by touring the country with his speech and book denouncing war, "War is a Racket."Butler confessed that he had spent most of his life as a "high class muscle man for Big Business, for Wall Street and the bankers...a racketeer, a gangster for capitalism..."

Eighteen states at present have recall laws, most of which do not apply to federal officials. For these and other states to recall federal officials, state legislatures would have to first pass or amend such laws.

Rising on the House floor to oppose the bill based on the military detention provisions for Americans, Rep. Tom McClintock said before the House vote:

" today, we who have sworn fealty to that Constitution sit to consider a bill that affirms a power contained in no law and that has the full potential to crack the very foundation of American liberty."

Vermont Senator Bernie Sanders said in opposing the final NDAA:

”This bill also contains misguided provisions that in the name of fighting terrorism essentially authorize the indefinite imprisonment of American citizens without charges.”

And in a New York Times op-ed piece by two retired four-star U.S. Marine generals, Charles Krulak and Joseph Hoar, Krulak and Hoar said that "Due process would be a thing of the past."

Montana would be the first recall drive to be launched as a result of the vote for the NDAA military detentions provisions. A number of Facebook pages appeared after the passage of the bill from locations across the country.

Hatch, Senators raise concerns over UN Treaty impact on second amendment

WASHINGTON  – U.S. Senator Orrin Hatch (R-Utah) joined his colleague Senator Jerry Moran (R-KS) and 43 other Senators in expressing grave concern about the dangers posed to Second Amendment rights by the United Nations’ Arms Trade Treaty. In a letter to President Obama and Secretary of State Hilary Clinton, the 45 senators (now up to 57 signers… do not have full list of names yet)  said they would oppose ratification of an Arms Trade Treaty that in any way restricts the rights of law-abiding American gun owners. This is enough to block the treaty from Senate passage, as treaties submitted to the U.S. Senate require approval of two-thirds of Senators present to be ratified.

“Our Second Amendment is non-negotiable,” said Hatch.  “We don’t need a bunch of bureaucrats at the United Nations dictating our liberties and freedoms.  This Treaty should not be ratified and I will fight it tooth and nail.”

In the letter, the senators wrote: “As the treaty process continues, we strongly encourage your Administration to uphold our country’s constitutional protections of civilian firearms ownership.  These freedoms are not negotiable, and we will oppose ratification of an Arms Trade Treaty presented to the Senate that in any way restricts the rights of law-abiding U.S. citizens to manufacture, assemble, possess, transfer or purchase firearms, ammunition and related items.”

“As we have for the past 15 years, the NRA will fight to stop a United Nations Arms Trade Treaty that infringes on the Constitutional rights of American gun owners,” said Chris W. Cox, executive director, NRA Institute for Legislative Action. “This letter sends a clear message to the international bureaucrats who want to eliminate our fundamental, individual right to keep and bear arms. Clearly, a U.N. Arms Trade Treaty that includes civilian arms within its scope is not supported by the American people or their elected U.S. Senators. Sen. Moran is a true champion of our freedom. We are grateful for his leadership and his tenacious efforts on this issue, as well as the 44 other senators who agree with the NRA’s refusal to compromise on our constitutional freedoms.”

In October of 2009 at the U.N. General Assembly, the Obama Administration reversed the previous Administration’s position and voted for the U.S. to participate in negotiating the Arms Trade Treaty, purportedly to establish “common international standards for the import, export, and transfer of conventional arms.” Preparatory committee meetings are now underway in anticipation of a conference in 2012 to finalize the treaty. A treaty draft has not yet been produced.

Dear President Obama and Secretary Clinton:

            As defenders of the right of Americans to keep and bear arms, we write to express our grave concern about the dangers posed by the United Nations’ Arms Trade Treaty.  Our country’s sovereignty and the constitutional protection of these individual freedoms must not be infringed.

            In October of 2009 at the U.N. General Assembly, your administration voted for the U.S. to participate in negotiating this treaty.  Preparatory committee meetings are now underway in anticipation of a conference in 2012 to finalize the treaty.  Based on the process to date, we are concerned that the Arms Trade Treaty poses dangers to rights protected under the Second Amendment for the following reasons.

            First, while the 2009 resolution on the treaty acknowledged the existence of “national constitutional protections on private ownership,” it placed the existence of these protections in the context of “the right of States to regulate internal transfers of arms and national ownership,” implying that constitutional protections must be interpreted in the context of the broader power of the state to regulate.  We are concerned both by the implications of the 2009 resolution and by the hostility to private firearms ownership manifested by similar resolutions in previous years—such as the 2008 resolution, which called for the “highest possible standards” of control.

            Second, your Administration agreed to participate in the negotiation only if it “operates under the rule of consensus decision-making.”  Given that the 2008 resolution on the treaty was adopted almost unanimously—with only the U.S. and Zimbabwe in opposition—it seems clear that there is a near-consensus on the requirement for the “highest possible standards,” which will inevitably put severe pressure on the United States to compromise on important issues.

            Third, U.N. member states regularly argue that no treaty controlling the transfer of arms internationally can be effective without controls on transfers inside member states.  Any treaty resulting from the Arms Trade Treaty process that seeks in any way to regulate the domestic manufacture, assembly, possession, transfer, or purchase of firearms, ammunition, and related items would be completely unacceptable to us.

            Fourth, reports from the 2010 Preparatory Meeting make it clear that many U.N. member states aim to craft an extremely broad treaty.  A declaration by Mexico and other Central and South American countries, for example, called for the treaty to cover “All types of conventional weapons (regardless of their purpose), including small arms and light weapons, ammunition, components, parts, technology and related materials.”  Such a broad treaty would be completely unenforceable, and would pose dangers to all U.S. businesses and individuals involved in any aspect of the firearms industry.  At the 2010 Meeting, the U.S. representative twice expressed frustration with the wide-ranging and unrealistic scope of the projected treaty.  We are concerned that these cautions will not be heeded, and that the Senate will eventually be called upon to consider a treaty that is so broad it cannot effectively be subject to our advice and consent.

            Fifth, and finally, the underlying philosophy of the Arms Trade Treaty is that transfers to and from governments are presumptively legal, while transfers to non-state actors (such as terrorists and criminals) are, at best, problematic.  We agree that sales and transfers to criminals and terrorists are unacceptable, but we will oppose any treaty that places the burden of controlling crime and terrorism on law-abiding Americans, instead of where it belongs: on the culpable member states of the United Nations who have failed to take the necessary steps to block trafficking that is already illegal under existing laws and agreements.

            As the treaty process continues, we strongly encourage your Administration to uphold our country’s constitutional protections of civilian firearms ownership.  These freedoms are not negotiable, and we will oppose ratification of an Arms Trade Treaty presented to the Senate that in any way restricts the rights of law-abiding U.S. citizens to manufacture, assemble, possess, transfer or purchase firearms, ammunition, and related items.

The question must be which 43 Senators did not sign this letter and support the United Nations’ Arms Trade Treaty?  They, Obama, Hillary and anyone in the House who does not support of Constitution, Bill of Rights and especially the Second Amendment must be go!!

NO HEALTHCARE TALKS UNTIL GOVERNMENT- RUN HEALTHCARE IS D.O.A. AND OFFICIALLY OFF THE TABLE!

REQUEST BY REPUBLICANS - THEY ARE ON TO OBAMA'S INTENTIONS!

TO ALL SENATORS:

The People have spoken JUST SAY NO to talks or at least the onset of negotiations until the existing bills for government takeover of healthcare are scrapped!!!!!

You may have to attend the meeting and bring your ideas, but you need to stand your ground and insist the process starts from scratch. Perhaps bringing along piles of letters like these will help Obama see that as usual, he has misread the will of the people??

The majority of Americans want nothing to do with the government takeover of healthcare, commonly known as ObamaCare!!!

We want sensible bipartisan corrections to our present system of healthcare. We do not want a government takeover and creation of an entire new system.

Most Americans ‘want’:

All the bills floating around, passed or not, by the House or Senate involving or related to HC scrapped. They also want hidden provisions for the bills that were hidden in other legislation reversed.

(a.) Comprehensive Tort Reform

(b.) Portable Health Insurance allowing all HC insurance companies to be sell in all 50-states and all Americans to be able to shop around and purchase insurance from any of those companies.

(c.) A stop to exclusion for previous conditions by insurance companies.

(d.) An investigation and serious overall to stop fraud and waste by insurance companies, Medicare, Medicaid and Veterans and Reservation Health Services.

(e.) Natural, holistic and alternative procedures and meds to be included in the system (which are generally cheaper and often times a long term solution).

(f.) Other logical non-freedom stealing or non-government involved related programs, revisions and common sense reform that we elect and trust you to give us.

(g.) A simplified overhaul of the system we have that is overhauled in a transparent way and posted online for everyone to read, at every phase, for a minimum of 5-days before a vote.

Most Americans do not want’:

(a.) Government controlled or government run healthcare in any form or version over and above what we already have in the programs mentioned above in (d.)

(b.) Major reductions in healthcare services for seniors

(c.) A centralized medical record database of health records that are either controlled by or the federal government has access to.

(d.) Illegal aliens covered by any government programs or funds other than true necessary emergency room services.

(e.) Any special deals, especially for Andy Stern and the unions.

***We also do not want: the government telling us, our doctors or our families which services we may have and when we are too old to have them. We do not want the government having access to our medical records, financial records or our bank accounts. We do not want our records put on RFID chips that are injected into us. We do not want government representatives having the right to show up at our homes and intercede with the way we raise our children to any greater extent than they already are for emergency situations. In fact we do not want most of the things that are or have been written into the various ObamaCare Bills.

The majority of Americans want you to stand up for us against the Progressives in Congress and in the White House and stop this takeover of American Healthcare and we in turn will support you for re-election.

Please do not fall into the trap that is being set for you by Obama/Reid/Pelosi. After all the secretive deals and negotiations plus the total lack of transparency to develop bills they cannot pass with their supermajority they now intend to feature you as obstructionists and the party of NO.

BUT ‘JUST SAYING NO’ TO BIPARTISAN NEGOTIATIONS UNTIL THE OBAMACARE BILLS ARE SCRAPED IS THE RIGHT THING TO DO AND WHAT THE AMERICAN PEOPLE WANT YOU TO DO!!

IF OBAMA REALLY CARED ABOUT THIS COUNTRY HE WOULD BE FOCUSING ON JOBS, STARTING OVER ON HEALTHCARE REFROM WITHOUT BEING ASKED, ABANDONING CAP AND TRADE AND GETTING SOME REAL ADVICE ON FOREIGN POLICY.

MOST PEOPLE FEEL OBAMA’S GOAL IS TO DESTROY AMERICA AND I WOULD HOPE THAT YOU REALIZE THIS BY NOW, OR AT LEAST CONSIDER IT.

Obama cannot be trusted; he is just doing this upcoming meeting for show. He does not respect you the GOP and non-progressive sensible moderate Democrats and Independents or the American people… especially the American People.

JUST SAY NO. HE DOESN'T DESERVE ANY RESPECT AND HE IS LOST HIS CREDITABILITY WITH THE AMERICAN PUBLIC. AS I HAVE SAID BEFORE YOU STAND UP AND SAY NO AND WE WILL CONTINUE TO SUPPORT YOU LIKE WE HAVE DONE IN NJ, NY, AND NOW MA AND ALL ACROSS THE COUNTRY.

THE PEOPLE OF AMERICA ARE AWAKE AND AWARE OF MR. OBAMA'S AGENDA, AND WE ARE ALL COMMITTED IN GETTING THIS COUNTRY BACK ON TRACK AND SO SHOULD EACH AND EVERYONE OF YOU!!!
