JPFO Alert: NY Gun Confiscation Underway

Manasquan, NJ -- Remember all those who denied that firearms confiscation as a result of New York's new gun laws was too "insane" to even consider?

That it was strictly in the realm of paranoid conspiracy theorists and the "it can’t happen here crowd"?

Those were and remain some of the standard replies to anyone who even thought about the possibility, let alone gave voice to it, despite the fact that Gov Cuomo and numerous other officials made public comments about such a plan, as I discussed in my article "Feinstein & Cuomo Admit Planning Australian Style Government Gun Buy Back" .

Elected Officials, the media, various Gun Control Groups and their zealous forced disarmament supporters, even some firearms owners themselves all insisted it was to crazy to even consider.

There's just one huge problem it is happening now in New York State!

It seems those that tried desperately to warn of such an insidious plot had hit the bullseye with their warnings after all. News came from multiple NY State based firearms enthusiast websites late Friday that confiscations of Pistol Owner ID Cards, as well as firearms and accessories has commenced in NY under the provisions of the horribly flawed, draconian and blatantly unconstitutional NY SAFE Act.

Those folks having their weapons and FID cards confiscated have been discovered to have been prescribed multiple different types of psychotropic drugs, such as those for Depression or Anxiety. These are known as SSRI ( Selective Serotonin Reuptake Inhibitors) class drugs and have the potential to cause serious and adverse side effects, something I wrote about extensively last week in an article that went viral in days and caused multiple Anti Gun and Progressive News Groups to initiate a concentrated denial of service hacker attack against Ammoland Shooting Sports News (see Daily KOS "Keeping Track Of The RKBA Crowd " http://tiny.cc/ug67uw), in an effort to keep the information from the public.

"John Doe, an upstanding professional with no outstanding criminal convictions and no history of violent action received a letter from the Pistol Permit Department informing him that his license was immediately revoked upon information that he was seeing a therapist for anxiety and had been prescribed an anxiety drug. He was never suicidal, never violent, and has no criminal history. The New York State Department of Health is apparently conducting a search of medical records to determine who is being treated for anxiety drugs and using this as a basis for handgun license revocation.

Now, before anyone trots out the old saw about how this is nothing more then a paranoid, unsubstantiated rumor on a "gun nuts" internet forum. I spoke to the Attorney of Record in this matter on the phone this morning and he confirmed that the above snippet is accurate and these cases are happening!

James Tresmond Esq confirmed in our conversation that the above mentioned case is occurring in Erie County NY, it is his client that has been effected, and as yet unknown sources have seen fit to take it upon themselves to share confidential medical records with NY State Officials without authorization, a massive HIPPA violation.

It seems these supposedly confidential records are then compared against a list of known NY pistol license holders and letters are sent out demanding their Pistol Owner ID Cards be surrendered, as well as any firearms and accessories.

This is an unprecedented violation of a Citizens 2nd, 4th, and 5th Amendment RIGHTS, brought to fruition by power and control hungry tyrants holding elected office who swore an Oath to uphold and defend the very rights they are now actively stripping from their constituents.

Moreover, the confiscation efforts underway in NY State have had another, albeit unintended effect. By undertaking this course of action, those in power have inadvertently pulled back the curtain on something they have suppressed from the Citizens for far to long, leaving them with precious little wiggle room to explain away their actions.

· Either they are acknowledging that there is in fact some sort of little reported link between the prescribing of psychotropic drugs and violent behavior, thus they are somehow, at least in their own minds "justified" in their actions to preempt someone from violence.

· Or, this is nothing more then a backdoor confiscation effort and massive abuse of governmental power unleashed on innocent Citizens.

Gun-Owning Feinstein Rolls Out Restrictive Gun-Control Bill For the Rest of Us… NRA Responds

Sen. Dianne Feinstein along with several fellow Democrats and a group of police officers and gun victims unveiled legislation Thursday that would restrict access to firearms, presenting an organized front in the face of opposition from the gun lobby. So How Do These Gun Totting Libs Justify Their Anti-Gun Stance and Legislation?

One by one, the California lawmaker and her co-sponsors said that a ban on certain semiautomatic weapons would help stop gun massacres. Many of bill’s sponsors are longtime gun-control advocates, and have become more determined to reinstate a ban on semiautomatic weapons deemed assault weapons after the December shootings in Newtown, Conn., that left 20 schoolchildren and six school staff members dead, as well as the alleged shooter and his mother.

“Our weak gun laws allow these mass killings to be carried out again and again and again,” Ms. Feinstein said.

“Newtown is a call to action,” Senator Richard Blumenthal (D., Conn.) said, acknowledging that passing the bill “will be a hard fight.”

The initiative faces an uphill climb in Congress given opposition from Republicans and gun-state Democrats. The influential National Rifle Association said in a statement Thursday that “it’s disappointing but not surprising that she is once again focused on curtailing the Constitution instead of prosecuting criminals or fixing our broken mental health system. The American people know gun bans do not work and we are confident Congress will reject Senator Feinstein’s wrong-headed approach.”

The ban would target an estimated 158 specific weapons. The prohibition would also apply to other semiautomatic weapons with certain features, such as compatibility with detachable, large-capacity magazines. Under the measure, it also would be illegal to make, import or sell magazines that can accept more than 10 rounds.

“If they’re not in the stores, they can’t be bought,” said Rep. Carolyn McCarthy (D., N.Y.), who has a reputation as the loudest advocate for gun-control laws in the House. Her husband was killed and her son severely injured in a 1993 shooting.

Mindful of opposition, the Democrats said they don’t intend to take away guns from hunters and sportsmen.

Philadelphia Police Chief Charles Ramsey joined the press conference to throw his weight behind the legislation.

“Twenty children slaughtered at one time in a school house,” Mr. Ramsey said. “If the slaughter of 20 babies does not capture and hold your attention, then I give up because I don’t know what else will.”  Really?  So how come nothing that President Obama proposed in his gun control speech would have helped to prevent the shooting or the deaths?

NRA:  Feinstein Goes For Broke With New Gun-Ban Bill

Sen. Dianne Feinstein (D-Calif.)—author of the federal “assault weapon” and “large” ammunition magazine ban of 1994-2004—has announced that on the first day of the new Congress—January 3rd— she will introduce a bill to which her 1994 ban will pale by comparison. On Dec. 17th, Feinstein said, “I have been working with my staff for over a year on this legislation” and “It will be carefully focused.” Indicating the depth of her research on the issue, she said on Dec. 21st that she had personally looked at pictures of guns in 1993, and again in 2012.

According to a Dec. 27th posting on Sen. Feinstein's website and a draft of the bill obtained by NRA-ILA, the new ban would, among other things, adopt new definitions of "assault weapon" that would affect a much larger variety of firearms, require current owners of such firearms to register them with the federal government under the National Firearms Act, and require forfeiture of the firearms upon the deaths of their current owners. Some of the changes in Feinstein's new bill are as follows:

  • Reduces, from two to one, the number of permitted external features on various firearms. The 1994 ban permitted various firearms to be manufactured only if they were assembled with no more than one feature listed in the law. Feinstein’s new bill would prohibit the manufacture of the same firearms with even one of the features.
  • Adopts new lists of prohibited external features. For example, whereas the 1994 ban applied to a rifle or shotgun the "pistol grip" of which "protrudes conspicuously beneath the action of the weapon," the new bill would drastically expand the definition to include any "grip . . . or any other characteristic that can function as a grip." Also, the new bill adds "forward grip" to the list of prohibiting features for rifles, defining it as "a grip located forward of the trigger that functions as a pistol grip." Read literally and in conjunction with the reduction from two features to one, the new language would apply to every detachable-magazine semi-automatic rifle. At a minimum, it would, for example, ban all models of the AR-15, even those developed for compliance with California’s highly restrictive ban.
  • Carries hyperbole further than the 1994 ban. Feinstein's 1994 ban listed "grenade launcher" as one of the prohibiting features for rifles. Her 2013 bill carries goes even further into the ridiculous, by also listing "rocket launcher." Such devices are restricted under the National Firearms Act and, obviously, are not standard components of the firearms Feinstein wants to ban. Perhaps a subsequent Feinstein bill will add "nuclear bomb," "particle beam weapon," or something else equally far-fetched to the features list.
  • Expands the definition of "assault weapon" by including:
    • Three very popular rifles: The M1 Carbine (introduced in 1944 and for many years sold by the federal government to individuals involved in marksmanship competition), a model of the Ruger Mini-14, and most or all models of the SKS.
    • Any "semiautomatic, centerfire, or rimfire rifle that has a fixed magazine with the capacity to accept more than 10 rounds," except for tubular-magazine .22s.
    • Any "semiautomatic, centerfire, or rimfire rifle that has an overall length of less than 30 inches," any "semiautomatic handgun with a fixed magazine that has the capacity to accept more than 10 rounds," and any semi-automatic handgun that has a threaded barrel.
  • Requires owners of existing "assault weapons" to register them with the federal government under the National Firearms Act (NFA). The NFA imposes a $200 tax per firearm, and requires an owner to submit photographs and fingerprints to the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE), to inform the BATFE of the address where the firearm will be kept, and to obtain the BATFE’s permission to transport the firearm across state lines.
  • Prohibits the transfer of “assault weapons.” Owners of other firearms, including those covered by the NFA, are permitted to sell them or pass them to heirs. However, under Feinstein’s new bill, “assault weapons” would remain with their current owners until their deaths, at which point they would be forfeited to the government.
  • Prohibits the domestic manufacture and the importation of magazines that hold more than 10 rounds of ammunition. The 1994 ban allowed the importation of such magazines that were manufactured before the ban took effect. Whereas the 1994 ban protected gun owners from errant prosecution by making the government prove when a magazine was made, the new ban includes no such protection. The new ban also requires firearm dealers to certify the date of manufacture of any >10-round magazine sold, a virtually impossible task, given that virtually no magazines are stamped with their date of manufacture.
  • Targets handguns in defiance of the Supreme Court. The Court ruled in District of Columbia v. Heller that the Second Amendment protects the right to have handguns for self-defense, in large part on the basis of the fact handguns are the type of firearm “overwhelmingly chosen by American society for that lawful purpose.” Semi-automatic pistols, which are the most popular handguns today, are designed to use detachable magazines, and the magazines “overwhelmingly chosen” by Americans for self-defense are those that hold more than 10 rounds. Additionally, Feinstein’s list of nearly 1,000 firearms exempted by name (see next paragraph) contains not a single handgun. Sen. Feinstein advocated banning handguns before being elected to the Senate, though she carried a handgun for her own personal protection.
  • Contains a larger piece of window dressing than the 1994 ban. Whereas the 1994 ban included a list of approximately 600 rifles and shotguns exempted from the ban by name, the new bill’s list is increased to nearly 1,000 rifles and shotguns. Other than for the 11 detachable-magazine semi-automatic rifles and one other semi-automatic rifle included in the list, however, the list appears to be pointless, because a separate provision of the bill exempts “any firearm that is manually operated by bolt, pump, lever, or slide action.”

The Department of Justice study. On her website, Feinstein claims that a study for the DOJ found that the 1994 ban resulted in a 6.7 percent decrease in murders. To the contrary, this is what the study said: “At best, the assault weapons ban can have only a limited effect on total gun murders, because the banned weapons and magazines were never involved in more than a modest fraction of all gun murders. Our best estimate is that the ban contributed to a 6.7 percent decrease in total gun murders between 1994 and 1995. . . . However, with only one year of post-ban data, we cannot rule out the possibility that this decrease reflects chance year-to-year variation rather than a true effect of the ban. Nor can we rule out effects of other features of the 1994 Crime Act or a host of state and local initiatives that took place simultaneously.”

“Assault weapon” numbers and murder trends. From the imposition of Feinstein's “assault weapon” ban (Sept. 13, 1994) through the present, the number of “assault weapons” has risen dramatically. For example, the most common firearm that Feinstein considers an “assault weapon” is the AR-15 rifle, the manufacturing numbers of which can be gleaned from the BATFE’s firearm manufacturer reports, available here. From 1995 through 2011, the number of AR-15s—all models of which Feinstein’s new bill defines as “assault weapons”—rose by over 2.5 million. During the same period, the nation's murder rate fell 48 percent, to a 48-year low. According to the FBI, 8.5 times as many people are murdered with knives, blunt objects and bare hands, as with rifles of any type.

Traces: Feinstein makes several claims, premised on firearm traces, hoping to convince people that her 1994 ban reduced the (relatively infrequent) use of “assault weapons” in crime. However, traces do not indicate how often any type of gun is used in crime. As the Congressional Research Service and the BATFE have explained, not all firearms that are traced have been used in crime, and not all firearms used in crime are traced. Whether a trace occurs depends on whether a law enforcement agency requests that a trace be conducted. Given that existing “assault weapons” were exempted from the 1994 ban and new “assault weapons” continued to be made while the ban was in effect, any reduction in the percentage of traces accounted for by “assault weapons” during the ban, would be attributable to law enforcement agencies losing interest in tracing the firearms, or law enforcement agencies increasing their requests for traces on other types of firearms, as urged by the BATFE for more than a decade.

The Journal News Gets Guns after Aiding and Abetting Criminals

After The Journal News gave rapists, thieves and murderers a roadmap of the homes these criminals can target, they hired armed guards.

The Journal News published the names and addresses of residents in New York’s Westchester, Rockland and Putnam Counties who have pistol permits, thereby letting criminals know which homes to avoid… and which to target.

They did this to further their anti-2nd Amendment agenda. Now, in a stunning display of hypocrisy, they want guns around themselves for protection.

Their claim of receiving threatening messages was put to rest by the police who, after investigating, found no threats were made.

Alert: Sen. Diane Feinstein releases gun ban summary for 2013

Senator Diane Feinstein of California released her agenda for gun control on her official senatorial website. Here are the Senator’s words committing to a sweeping ban on guns:

Daily Caller: In January, Senator Feinstein will introduce a bill to stop the sale, transfer, importation and manufacturing of military-style assault weapons and high-capacity ammunition feeding devises.

  • Bans the sale, transfer, importation, or manufacturing of:
    • 120 specifically-named firearms
    • Certain other semiautomatic rifles, handguns, shotguns that can accept a detachable magazine and have one military characteristic
    • Semiautomatic rifles and handguns with a fixed magazine that can accept more than 10 rounds
  • Strengthens the 1994 Assault Weapons Ban and various state bans by:
    • Moving from a 2-characteristic test to a 1-characteristic test
    • Eliminating the easy-to-remove bayonet mounts and flash suppressors from the characteristics test
    • Banning firearms with “thumbhole stocks” and “bullet buttons” to address attempts to “work around” prior bans
  • Bans large-capacity ammunition feeding devices capable of accepting more than 10 rounds.
  • Protects legitimate hunters and the rights of existing gun owners by:
    • Grandfathering weapons legally possessed on the date of enactment
    • Exempting over 900 specifically-named weapons used for hunting or sporting purposes and
    • Exempting antique, manually-operated, and permanently disabled weapons
    • Requires that grandfathered weapons be registered under the National Firearms Act, to include:
    • Background check of owner and any transferee;

    • Type and serial number of the firearm;

    • Positive identification, including photograph and fingerprint;

    • Certification from local law enforcement of identity and that possession would not violate State or local law; and

    • Dedicated funding for ATF to implement registration

Senate Democrats Declare Water War

WEDNESDAY, JUNE 8, 2011  -  by NUNES STAFF

Last week, the House Natural Resources Committee held a hearing about the San Joaquin Valley Water Reliability Act. The bill, which is co-authored by valley Republicans Devin Nunes, Kevin McCarthy, and Jeff Denham, generated strong opposition from Democrat lawmakers but has the backing of a re-invigorated Republican Conference and its leadership.

Majority Whip Kevin McCarthy made a rare appearance at the subcommittee hearing in support of the bill and reminded his colleagues that Governor Brown had declared an end to California’s drought. He continued that California’s snow-pack had reached 165% this year but that farmers would not get 100% of their water. “That’s like a company having its best profits ever but telling its employees they will only get 80% of their paycheck,” said McCarthy. “That’s unacceptable.”

Nunes and his allies are seeking to achieve several major changes to the management of California’s water infrastructure. Their plan includes the restoration of a bipartisan agreement known as the Bay-Delta Accord. It also revamps the San Joaquin River restoration, replacing it with an economically responsible and environmentally feasible fishery— saving taxpayers a billion dollars.

Rep. John Garamendi (D-Walnut Grove), who had touted the Delta Accord as a model agreement in the 1990s, shifted position dramatically and equated it as a declaration of war with no hope of Senate passage. Shortly after the hearing, California’s Senior Senator Dianne Feinstein told the San Francisco Chronicle, "I strongly oppose this bill, which I believe is dramatic overkill."

During his opening statement, Garemendi decried the bill’s pre-emption of state law saying “this little piece of genius” would end collaboration between state and federal water projects. The bill “makes it virtually impossible,” he said. Westlands representative Tom Birmingham took aim at Garamendi’s interpretation of the bill and corrected him on historic and current operation of the projects. Federal law already pre-empts state law concerning project operations on the Trinity, he reminded the committee, and there was no similar outrage when that pre-emption occurred.

When asked about opposition from Senate Democrats, Nunes said he was disappointed but not surprised. “This is a declaration of war on the only meaningful plan before Congress to solve the San Joaquin Valley water crisis.” Nunes continued that if “California’s senators would change their tune if Congress imposed a 70% reduction on deliveries from Hetch Hetchy. Senator Feinstein would no doubt be happy to hand the City of San Francisco’s water over unconditionally since she thinks it will save the Delta.”

Feinstein transmitted her official opposition to the bill just days after attending a fundraiser at Harris Ranch, which is located in the San Joaquin Valley—only miles from water starved farmland. According to those in attendance, Feinstein committed to working on a solution. “I don’t see how anyone with valley interests in mind can trust them, which is why I have been talking to Senate Republicans,” said Nunes.

Nunes also sought to remind critics that there are many options on the table to gain passage of legislation and that he would be leveraging all of them to aid the San Joaquin Valley. This will undoubtedly keep the bill’s opponents on their toes. House Appropriators have already stripped funding for the San Joaquin River Settlement from the federal budget, a major blow to the plan which is already off schedule and underfunded.

Once lawmakers had completed their opening remarks, testimony was received from local water districts, as well as state and federal representatives. Obama and Brown Administration officials opposed the bill, maintaining their view that the Delta pumps were damaging the ecosystem, impacting a number of species including the smelt, salmon and killer whale. Administration officials also touted the importance of current policies, which they described as balanced, to protect the Delta ecosystem.

Advocates of H.R. 1837 were quick to note, however, that no new evidence was provided to support these conclusions. The disclosure of scientific evidence to support pumping restrictions was made necessary by a U.S. District Court ruling in May. The court determined that the government had failed to base its decisions on science and sent regulators back to the drawing table.

Kole Upton, a Madera farmer and former San Joaquin River Settlement negotiator, rejected Interior’s testimony that current policies were balanced and called for the replacement of the current river restoration plan as envisioned by H.R. 1837. Upton explained that farmers were being subject to a slow death due to water diversions and that broken promises related to the San Joaquin river deal convinced him to seek changes.

The Kern County Water Agency also offered testimony, indicating that H.R. 1837 would restore stability to the Delta and improve water supplies. The agency’s representative, James Beck, said that all water contractors, state and federal, would be protected under the proposed law— supporting Nunes’ contention that his goal is not to harm any water contractors. This testimony undermined one of the key arguments made by bill opponents, which suggest that a small minority would benefit under the bill.

When asked about the allegation that his bill would come at the expense of other water contractors and the environment, Nunes was dismissive. “They are attempting to deceive the public which is the only way they can survive. They think they can obstruct this legislation by dividing California’s embattled water districts and hiding their own financial interests. It won’t work.”

Nunes then described an alliance of convenience between environmental activists, a small number of Delta farmers and salmon fishermen, indicating that each will likely be represented at an additional hearing called by committee Democrats who are attempting to slow passage of the bill. “They have all benefited from the status quo. Delta farmers have been able to hide from reality on their islands, fishermen have filled their pockets with tax dollars, and radical environmentalists have assumed greater control over the state’s water,” said Nunes.

Delta farmers may fear the upending of current water management policies because those policies have to-date placed the financial and operational burdens for Delta restoration on others – primarily south of Delta water contractors. Under current law, little attention has been paid to this small but vocal group of farmers who enjoy unlimited access to the Delta’s fresh water supplies. During panel questioning, Rep. Jeff Denham underscored the uneven burden placed on water contractors by pointing out that San Francisco secures its water via pipeline from Hetch Hetchy, completely bypassing the Delta. This has allowed Bay Area activists to escape the consequences of their actions while forcing others to make sacrifices.

Similarly, elements of the west’s small sport and commercial salmon fishing industries have benefited from the status quo. The 1,722 permit holding fishermen collected hundreds of millions of federal tax dollars from 2007-2009. Nunes calls this money a payoff for their environmental activism, which was enacted under Democratic supermajorities. Several recipients made out with more than half a million dollars, with 213 fishermen walking away with six figure checks. And while some have claimed that the industry is 100% unemployed, regulators documented deliveries of sardine, mackerel, anchovy, squid and other species, effectively refuting the allegation that salmon fishermen are unable to work.

Nunes says that despite controversy generated by these groups, House leaders remain unfazed. A markup and full House consideration will likely follow this summer. Meanwhile, San Joaquin Valley residents have benefited from significant exposure beyond the greater Central Valley. The region’s water crisis has been highlighted nationally and is followed by the Fox News Channel’s Sean Hannity and others. In 2009, the Wall Street Journal opined that Central Valley farmers are California’s new endangered species. This prognosis may change if House Republicans succeed.

Federally Created Dust Bowl in CA – Another Test Crisis ??

CA Central Vally Despair flows as fields go dry and unemployment rises

In a state that is virtually bankrupt… the number one on the list of American states ready to fail, while having the eighth largest economy and largest population in the Country, how could the Federal government allow, no order, the water turned off to the San Joaquin Valley to save a minnow??

In July, Alana Semuels for the Los Angeles Times wrote:

MENDOTA, CALIF — Water built the semi-arid San Joaquin Valley into an agricultural powerhouse, the breadbasket of America. Drought and irrigation battles now threaten to turn huge swaths of it into a dust bowl.

Farmers have idled half a million acres of once-productive ground and are laying off legions of farmhands. That's sending joblessness soaring in a region already plagued by chronic poverty.

Water scarcity looms as a major challenge to California's $37-billion agricultural industry, which has long relied on imported water to bloom. The consequences of closing the spigot are already evident here in rural Fresno County, about 230 miles north of Los Angeles. Lost farm revenue will top $900 million in the San Joaquin Valley this year, said UC Davis economist Richard Howitt, who estimates that water woes will cost the recession-battered region an additional 30,000 jobs in 2009.

Standing in a parched field in 104-degree heat, valley farmer Joe Del Bosque pointed to cracked earth where tomatoes should be growing. He didn't bother this year because he can't get enough water to irrigate them. He's cultivating only about half of the cantaloupe and asparagus that he did in 2007. He has slashed his workforce, and his bills are mounting.

"We can't survive at 10% of our water," said Del Bosque, 60, a white cowboy hat, long sleeves and jeans protecting him from the blistering sun.

CONGRESS CREATED DUST BOWL?

With the unemployment on the rise in the state, 11.5 percent for May (2009), Governor Schwarzenegger last Friday afternoon activated the California Disaster Assistance Act for Fresno County and called for the federal government to make a federal disaster declaration for the county.

But this declaration unlike those used in response to the destruction caused by natural disasters is in response to providing temporary supplemental assistance to local governments and non-profit organizations that supply food and other aid to those who are impacted by the drought statewide. The order also waives the one-week waiting period for unemployment insurance.

Driving through the Central Valley, specifically along Interstate 5, the impact from the combination of the three years of drought is very noticeable as many fields lie fallow and signs dot the former farm lands claiming you are viewing a 'Congress Created Dust Bowl.' Studies estimate that as of May, the lack of water in the San Joaquin Valley, California's Central Valley has cost 35,000 jobs and $830 million in farm revenue.

Dead and Dying–California’s Central Valley Dust Bowl

We took a drive this week from Sacramento to Los Angeles, and had an eye opening experience. Down the entire length of the 5 freeway, we saw not the green luscious fields of produce or green orchards laden with fruit, but dusty dead and dying orchards. Rows after row, acres after acre, miles after mile of them, perfectly formed, perfectly helpless… lifeless.

By way of explanation, these signs dotted the dusty dry roadside: “Congress Created Dust Bowl. Thank You Sacramento!”

California’s orchards aren’t getting a drop of water this year despite the best rainfall in three years and five reservoirs filled to over capacity?!?

There’s no doubt that we’re in a drought, but why the sudden drop in water availability only for farmers? Are the politicians in Sacramento more concerned about the plethora of city votes than the small handful of agricultural ones? We will all be paying for Sacramento’s blunder. The Central Valley provides up to 8% of the nation’s fresh produce.

Watching the staggering waste makes your heart ache. We had to pull over and take pictures. The contrast from the past green was stark—it takes 30 years to build an orchard to full production! Almonds, walnuts, citrus… Why do we have green lawns in the rest of the state while these resources, food for the nation, are left to die?

Just the other day (Nov 19, 2009), my husband made the drive north from Orange County to San Jose. He said the sight was devastating!! No crops, no green, just a dust and dirt in every direction as far as the eye can see... two full months after Sean Hannity (see below) California Representatives and others held a rally for awareness of the problem.

Politics and Drought In California from NPR (Sept 2009)

A few weeks ago, Ty and Janet Lompa were doing the unthinkable: cutting down 110 acres of walnut orchards. That’s roughly 10,000 trees and a third of their entire acreage.

“It takes 30 years to get ‘em here,” says Janet Lompa, “and about a minute and a half to knock ‘em down.”

Ty Lompa helped plant many of these trees with his father, and they used to water the orchard with flood irrigation from the project built by the federal government. But when water started to become an issue, “we immediately switched over to micro-irrigation,” says Lompa. “So we have absolutely no runoff.”

But the Lompas’ farm relied entirely on federal water — they have no groundwater of their own. They can keep part of their orchard alive with water they carried over from last year, but the rest can’t be saved.

“You can’t leave trees in the field and just let ‘em die,” Ty Lompa says. “You’re gonna get bugs, you’re gonna get disease, so they have to come down.”

The Lompas are furious because they blame government, not nature, for the death of their trees. And Janet Lompa tells her four children that “the politicians gave it all to the fish” when they ask why there’s no water.

Politics Takes Control

Farmers throughout this region echo the sentiment that politics, not the drought, is the problem. Most of California gets its water from a huge estuary called the Delta, where two big rivers join in the center of the valley. But so much water was being pumped out of the Delta that a tiny smelt there, an endangered species, is disappearing. So late last year, a federal judge ruled that the amount of water being delivered to the south had to be sharply cut back.

In April, in a sweltering tin shed in the middle of the Westland’s water district, about 200 farmers gathered to hear what Tom Birmingham had to say about the crisis. Birmingham is the executive director of the irrigation district. Yes, the drought is a problem, he says, but he believes the much bigger problem is that court ruling.

“Since mid-February, as a result of that biological opinion, we’ve lost approximately 300,000 acre-feet of water. It’s floated out the Golden Gate.”

That means it was given to the fish.

“The state of California has gone from 15 million people when these projects were built 50 years ago, to almost 30 million,” Gary Coehlo says. “And we haven’t added one bit of water, storage, conveyance, dams — anything. Now, the need for water has become greater, and they’re gonna dry us up,” adds Tony Coehlo.

Does any of this make sense?? Would the Federal government really shut off water and cause a dust bowl? Could it really take months and months to hold hearings until one of the major food production areas in America is destroyed? Could a bankrupt State and Federal Government really choose to add thousands upon thousands of people onto the unemployment and welfare rolls? Could a bankrupt State and failing Federal government really choose to cut off a major food supply, causing increases in the cost of groceries to a public that is facing somewhere between 10 and 20% unemployment… on purpose?

I have heard 5 television hosts in the past 3 days say they fear that the government's plan is to put the American People and America itself into such dire straights that they will beg the government… and then the United Nations to help us and takeover… Have we really become that lethargic and dumbed down that we are willing to let that happen?

Have you ever heard of and checked the information on Agenda 21 – a treaty signed, brought back and implemented under Presidents George W. Bush and Bill Clinton?? If you haven't I suggest you do your homework quickly!!

Update (Sept 2009): After Sean Hannity's visit, rally and coverage, Senators DeMint and McCain went to the matt to bring water back to the central valley of California. Who stopped them? California Senators Boxer and Feinstein… and was certainly prompted by Speaker Pelosi.

Conservative talk show host Sean Hannity travelled to California’s Central Valley to help bring national attention to the on-going water crisis.

Water activists say after nearly a dozen marches and protests, it’s time to try something different, so last Thursday Hannity broadcasted his national show from a dry, dirt field west of the Fresno/Kings County line.

The Federal government has cut off water to the bread basket of America and refuses to turn it back on.

Since Hannity’s visit Senators DeMint and McCain drafted legislation to get the water flowing…

U.S. Senate to California Farmers: Drop Dead

Demonstrating once again the moonbat priorities of the Democratic Senate majority, the Senate has voted to screw over hundreds of thousands of farmers and endanger our national food supply for the sake of a two-inch fish that probably isn't endangered anyway.

Because of the ruling of Moonbat Judge Oliver Wanger, millions of gallons of freshwater that could be growing crops and providing livelihoods to hundreds of thousands of people are washing uselessly into the sea. Farmers are facing bankruptcy and tens of thousands are out of work.

California's dingbat senators Dianne Feinstein and Babs "Ma'am" Boxer stood by and did nothing to correct this insanity. It took a Republican from South Carolina, Jim DeMint, to try and rescue California's farmers by proposing an amendment to restore water to the farmers in the San Joaquin valley. Guess what? Senate Demoncrats... including both dingbat senators from California... voted it down. And Speaker of the House Nancy Pelosi has interfered to keep the water turned off several times before.

Feds shut off water to California farms in controversial effort to help threatened species

A farming town in California claims that it may disappear due to the United States federal government shutting off water pumps, though the government states the actions are necessary to save several marine species.

In July 2009, action by the Federal Bureau of Reclamation to protect threatened fish stopped irrigation pumping to parts of the California Central Valley causing canals leading into Huron, California and the surrounding areas and the farms that rely on them to lose their primary irrigation source. Unemployment has reached 40% in some areas as the farms have dried up.

California Governor Arnold Schwarzenegger stated the action is putting the fish “above the needs of millions of Californians.”

Highlighting the city’s plight, Huron Police Chief Frank Steenport stated, “A year from now, [Huron] may not be here.”

In an interview on Tuesday, comedian Paul Rodriguez, the mother of whom owns a farm in the area, criticized the actions of the government and called for President Barack Obama to review the decision. “This used to be an almond orchard. Now all that is left is firewood.”

Laura King Moon, assistant general manager of the State Water Contractors, a nonprofit association of 27 public agencies from across California that purchase water from the government under contract, said “these cuts are crippling on our people and businesses — especially in the Central Valley where farmers are being forced to fallow their land and workers are being laid off. Rather than piecemeal restrictions, we need to balance the needs of the environment and the needs of people with a collective plan for the Delta.”

The National Marine Fisheries Service, an agency within the National Oceanic and Atmospheric Administration, states the water pumping inside central California threatens several marine species. In the Huron area, the delta smelt is specifically targeted.

In defense of the actions, Rod McInnis, the southwest regional director for NOAA’s Fisheries Service stated, “What is at stake here is not just the survival of species but the health of entire ecosystems and the economies that depend on them. We are ready to work with our federal and state partners, farmers and residents to find solutions that benefit the economy, environment and Central Valley families.”

Delta Smelt

Delta smelt, Hypomesus transpacificus, are slender-bodied smelts, about 5 to 7 cm long, of the Osmeridae family. They have a steely blue sheen on the sides and seem almost translucent. Smelts live together in schools and feed on zooplankton (small fishes and invertebrates). One female may lay from 1,400 to 1,800 eggs. Mature unfertilized eggs are about 1 mm.

Habitat

Delta smelt are currently endemic to the Sacramento Delta, California, where it is distributed from the Suisun Bay upstream through the Delta in Contra Costa, Sacramento, San Joaquin, Solano and Yolo counties. The delta smelt is a pelagic (live in the open water column away from the bottom) and euryhaline species (tolerant of a wide salinity range). They have been collected from estuarine waters up to 14 ppt (parts per thousand) salinity.

Life cycle

Most delta smelt live one year and die after their first spawning (semelparous). Delta smelt spawning occurs in spring in river channels and tidally influenced backwater sloughs upstream of the mixing zone (saltwater-freshwater interface). The Sacramento and San Joaquin rivers then transport the delta smelt larvae downstream to the mixing zone, normally located in the Suisun Bay. Young delta smelt then feed and grow in the mixing zone before starting their upstream spawning migration in late fall or early winter.

Delta smelt are preyed upon by larger fish, especially striped bass and largemouth bass which are invasive species in the Sacramento Delta.[1]

Delta smelt used to be a common fish in the Sacramento - San Joaquin rivers estuary. The population is much smaller than historically and the species was listed in 1993 as threatened under the California Endangered Species Act (CESA) and Federal Endangered Species Act (FESA) (Federal Register 58:12863; March 5, 1993). Critical habitat was listed for delta smelt on December 19, 1994 (Federal Register 59:65256). In 2008, the California Fish and Game Commission moved to uplist delta smelt to endangered under CESA.

Court protection

On August 31, 2007, California Federal Judge Oliver Wanger of Federal District Court protected the rare declining fish delta smelt by severely curtailing human use water deliveries at San Joaquin-Sacramento River delta from December to June. [2] It should be noted that these are the pumps at the Banks Pumping Plant that send water to Central and Southern California for agricultural and residential use. As a result of this ruling, large portions of the heavily-agricultural western San Joaquin Valley have been denied water allocations used for farmland irrigation. This, in conjunction with the persistent drought affecting the region, has caused large amounts of farmland to become fallowed.

The Obama Administration and the radicals in Washington are consistently testing the American People: the TARP and Stimulus swindles, the Patriot Act, Net Neutrality, the Hate Crimes Bill Stuck in with another Bill, the House passing Cap and Trade, the PelosiCare Bill, just the other day HC rationing the announcement that now mammograms are not needed until age 50 and then every other year, no longer securing our borders, taking away our rights... one by one, ludicrous gun laws, even Fed Income Tax (there is nothing in the Constitution that allows Federal Income Tax or Federal Healthcare). If we let it go, allow it, or don't remove the officials responsible... we lose - they win!
