Nancy Pelosi Lied About Enhanced Interrogations - Is Anyone Surprised?

Documents were just released:  The Director of National Intelligence just released a report stating that Nancy Pelosi was definitely briefed on EIT (Enhanced Interrogation Techniques) on 09/04/02.  She was briefed not only on what EIT’s were being considered, but which had and were being used.

If she lied about this, what else has she lied about?  Leadership you can trust…??

---------------------------------------------------------------------------------------------------------

Rep. Hoekstra: Nancy Pelosi is lying, Congress knew about the interrogations - April 23, 4:03 PM

The following is based on a press statement sent by the office of Rep. Pete Hoekstra to the National Association of Chiefs of Police.

"Obama should release the memo on the attacks prevented," said Congressman Pete Hoekstra (R-MI).

Director of National Intelligence Dennis Blair got it right last week when he noted how easy it is to condemn the enhanced interrogation program "on a bright sunny day in April 2009." Reactions to this former CIA program, which was used against senior al Qaeda suspects in 2002 and 2003, are demonstrating how little President Barack Obama and some Democratic members of Congress understand the dire threats to our nation.

George Tenet, who served as CIA director under Presidents George W. Bush and Bill Clinton, believes the enhanced interrogations program saved lives. He told CBS's "60 Minutes" in April 2007: "I know this program alone is worth more than the FBI, the Central Intelligence Agency and the National Security Agency put together have been able to tell us."

Last week, Mr. Blair made a similar statement in an internal memo to his staff when he wrote that "[h]igh value information came from interrogations in which those methods were used and provided a deeper understanding of the al Qa'ida organization that was attacking this country."

Yet last week Mr. Obama overruled the advice of his CIA director, Leon Panetta, and four prior CIA directors by releasing the details of the enhanced interrogation program. Former CIA director Michael Hayden has stated clearly that declassifying the memos will make it more difficult for the CIA to defend the nation.

It was not necessary to release details of the enhanced interrogation techniques, because members of Congress from both parties have been fully aware of them since the program began in 2002. We believed it was something that had to be done in the aftermath of the 9/11 terrorist attacks to keep our nation safe. After many long and contentious debates, Congress repeatedly approved and funded this program on a bipartisan basis in both Republican and Democratic Congresses.

Last week, Mr. Obama argued that those who implemented this program should not be prosecuted -- even though the release of the memos still places many individuals at other forms of unfair legal risk. It appeared that Mr. Obama understood it would be unfair to prosecute U.S. government employees for carrying out a policy that had been fully vetted and approved by the executive branch and Congress. The president explained this decision with these gracious words: "nothing will be gained by spending our time and energy laying blame for the past." I agreed.

Unfortunately, on April 21, Mr. Obama backtracked and opened the door to possible prosecution of Justice Department attorneys who provided legal advice with respect to the enhanced interrogations program. The president also signaled that he may support some kind of independent inquiry into the program. It seems that he has capitulated to left-wing groups and some in Congress who are demanding show trials over this program.

Members of Congress calling for an investigation of the enhanced interrogation program should remember that such an investigation can't be a selective review of information, or solely focus on the lawyers who wrote the memos, or the low-level employees who carried out this program. I have asked Mr. Blair to provide me with a list of the dates, locations and names of all members of Congress who attended briefings on enhanced interrogation techniques.

Any investigation must include this information as part of a review of those in Congress and the Bush administration who reviewed and supported this program. To get a complete picture of the enhanced interrogation program, a fair investigation will also require that the Obama administration release the memos requested by former Vice President Dick Cheney on the successes of this program.

An honest and thorough review of the enhanced interrogation program must also assess the likely damage done to U.S. national security by Mr. Obama's decision to release the memos over the objections of Mr. Panetta and four of his predecessors. Such a review should assess what this decision communicated to our enemies, and also whether it will discourage intelligence professionals from offering their frank opinions in sensitive counterterrorist cases for fear that they will be prosecuted by a future administration.

Perhaps we need an investigation not of the enhanced interrogation program, but of what the Obama administration may be doing to endanger the security our nation has enjoyed because of interrogations and other antiterrorism measures implemented since Sept. 12, 2001.

Rep Hoekstra, a congressman from Michigan, is ranking Republican on the House Permanent Select Committee on Intelligence.

"Empathy" Versus Law

Justice David Souter's retirement from the Supreme Court presents President Barack Obama with his first opportunity to appoint someone to the High Court. People who are speculating about whether the next nominee will be a woman, a Hispanic or whatever, are missing the point.

That we are discussing the next Supreme Court justice in terms of group "representation" is a sign of how far we have already strayed from the purpose of law and the weighty responsibility of appointing someone to sit for life on the highest court in the land.

That President Obama has made "empathy" with certain groups one of his criteria for choosing a Supreme Court nominee is a dangerous sign of how much further the Supreme Court may be pushed away from the rule of law and toward even more arbitrary judicial edicts to advance the agenda of the left and set it in legal concrete, immune from the democratic process.

Would you want to go into court to appear before a judge with "empathy" for groups A, B and C, if you were a member of groups X, Y or Z? Nothing could be further from the rule of law. That would be bad news, even in a traffic court, much less in a court that has the last word on your rights under the Constitution of the United States.

Appoint enough Supreme Court justices with "empathy" for particular groups and you would have, for all practical purposes, repealed the 14th Amendment, which guarantees "equal protection of the laws" for all Americans.

We would have entered a strange new world, where everybody is equal but some are more equal than others. The very idea of the rule of law would become meaningless when it is replaced by the empathies of judges.

Barack Obama solves this contradiction, as he solves so many other problems, with rhetoric. If you believe in the rule of law, he will say the words "rule of law." And if you are willing to buy it, he will keep on selling it.

Those people who just accept soothing words from politicians they like are gambling with the future of a nation. If you were German, would you be in favor of a law "to relieve the distress of the German people and nation"? That was the law that gave Hitler dictatorial power.

He was just another German chancellor at the time. He was not elected on a platform of war, dictatorship or genocide. He got the power to do those things because of a law "to relieve the distress of the German people."

When you buy words, you had better know what you are buying.

In the American system of government, presidential term limits restrict how long any given resident of the White House can damage this country directly. But that does not limit how long, or how much, the people he appoints to the Supreme Court can continue to damage this country, for decades after the president who appointed them is long gone.

Justice John Paul Stevens virtually destroyed the Constitution's restrictions on government officials' ability to confiscate private property in his 2005 decision in the case of "Kelo v. New London"-- 30 years after President Ford appointed him.

The biggest danger in appointing the wrong people to the Supreme Court is not just in how they might vote on some particular issues-- whether private property, abortion or whatever. The biggest danger is that they will undermine or destroy the very concept of the rule of law-- what has been called "a government of laws and not of men."

Under the American system of government, this cannot be done overnight or perhaps even during the terms in office of one president-- but it can be done. And it can be done over time by the appointees of just one president, if he gets enough appointees.

Some people say that who Barack Obama appoints to replace Justice Souter doesn't really matter, because Souter is a liberal who will probably be replaced by another liberal. But, if no one sounds the alarm now, we can end up with a series of appointees with "empathy"-- which is to say, with justices who think their job is to "relieve the distress" of particular groups, rather than to uphold the Constitution of the United States.

The great Supreme Court justice Oliver Wendell Holmes is not the kind of justice who would have been appointed under President Barack Obama's criterion of "empathy" for certain groups.

Like most people, Justice Holmes had empathy for some and antipathy for others, but his votes on the Supreme Court often went against those for whom he had empathy and for those for whom he had antipathy. As Holmes himself put it: "I loathed most of the things in favor of which I decided."

After voting in favor of Benjamin Gitlow in the 1925 case of Gitlow v. People of New York, Holmes said in a letter to a friend that he had just voted for "the right of an ass to drool about proletarian dictatorship." Similarly, in the case of Abrams v. United States, Holmes' dissenting opinion in favor of the appellants characterized the views of those appellants as "a creed which I believe to be the creed of ignorance and immaturity."

By the same token, Justice Holmes did not let his sympathies with some people determine his votes on the High Court. As a young man, Holmes had dropped out of Harvard to go fight in the Civil War because he opposed slavery. In later years, he expressed his dislike of the minstrel shows that were popular at the time "because they seem to belittle the race."

When there were outcries against the prosecution of Sacco and Vanzetti in the 1920s, Holmes said in a letter, "I cannot but ask myself why this so much greater interest in red than black. A thousand-fold worse cases of negroes come up from time to time, but the world does not worry over them."

Yet when two black attorneys appeared before the Supreme Court, Holmes wrote in another letter to a friend that he had to "write a decision against a very thorough and really well expressed argument by two colored men"-- an argument "that even in intonation was better than, I should say, the majority of white discourses that we hear."

Holmes understood that a Supreme Court justice was not there to favor some people or even to prescribe what was best for society. He had a very clear sense of what the role of a judge was-- and wasn't.

Justice Holmes saw his job to be "to see that the game is played according to the rules whether I like them or not."

That was because the law existed for the citizens, not for lawyers or judges, and the citizen had to know what the rules were, in order to obey them.

He said: "Men should know the rules by which the game is played. Doubt as to the value of some of those rules is no sufficient reason why they should not be followed by the courts."

Legislators existed to change the law.

After a lunch with Judge Learned Hand, as Holmes was departing in a carriage to return to work, Judge Hand said to him: "Do justice, sir. Do justice."

Holmes had the carriage stopped. "That is not my job," he said. "My job is to apply the law."

Holmes wrote that he did not "think it desirable that the judges should undertake to renovate the law." If the law needed changing, that was what the democratic process was for. Indeed, that was what the separation of powers in legislative, executive and judicial branches by the Constitution of the United States was for.

"The criterion of constitutionality," he said, "is not whether we believe the law to be for the public good." That was for other people to decide. For judges, he said: "When we know what the source of the law has said it shall be, our authority is at an end."

One of Holmes' judicial opinions ended: "I am not at liberty to consider the justice of the Act."

Some have tried to depict Justice Holmes as someone who saw no need for morality in the law. On the contrary, he said: "The law is the witness and external deposit of our moral life." But a society's need to put moral content into its laws did not mean that it was the judge's job to second-guess the moral choices made by others who were authorized to make such choices.

Justice Holmes understood the difference between the rule of law and the rule of lawyers and judges.

There is a reason why the statue of Justice wears a blindfold. There are things that courts are not supposed to see or recognize when making their decisions-- the race you belong to, whether you are rich or poor, and other personal things that could bias decisions by judges and juries.

It is an ideal that a society strives for, even if particular judges or juries fall short of that ideal. Now, however, President Barack Obama has repudiated that ideal itself by saying that he wants to appoint judges with "empathy" for particular groups.

This was not an isolated slip of the tongue. Barack Obama said the same thing during last year's election campaign. Moreover, it is completely consistent with his behavior and associations over a period of years-- and inconsistent with fundamental principles of American government and society.

Nor is this President Obama's only attempt to remake American society. Barack Obama's vision of America is one in which a President of the United States can fire the head of General Motors, tell banks how to bank, control the medical system and take charge of all sorts of other activities for which neither he nor other politicians have any expertise or experience.

The Constitution of the United States gives no president, nor the entire federal government, the authority to do such things. But spending trillions of dollars to bail out all sorts of companies buys the power to tell them how to operate.

Appointing judges to the federal courts-- including the Supreme Court-- who believe in expanding the powers of the federal government to make arbitrary decisions, choosing who will be winners and losers in the economy and in the society, is perfectly consistent with a vision of the world where self-confident and self-righteous elites rule according to their own notions, instead of merely governing under the restraints of the Constitution.

If all this can be washed down with pious talk about "empathy," so much the better for those who want to remake America. Now that the Obama administration has a Congressional majority that is virtually unstoppable, and a media that is wholly uncritical, the chances of preventing the president from putting someone on the Supreme Court who shares his desire to turn America into a different country are slim or none.

The only thing on the side of those who understand this, and who oppose it, is time. Reshaping the Supreme Court cannot be done overnight, the way Congress passed a vast spending bill in two days.

Replacing Supreme Court justices is something that can only be done one at a time and at unpredictable intervals. What this means is that Senators who do not have enough votes to stop an Obama nominee for the High Court from being confirmed nevertheless have an opportunity- and a duty-- to alert the public to the dangers of what is being done.

This does not mean turning confirmation hearings into a circus or a kangaroo court with mud-slinging at judicial nominees, the way Robert Bork and Clarence Thomas were smeared. But it also does not mean taking the path of least resistance by quietly voting for people like Ruth Bader Ginsberg and Stephen Breyer, who treat the Constitution as a grant of arbitrary power to themselves, rather than a restriction of power on the government as a whole.

It is all too easy to say "a president has a right to appoint the kind of people he wants on the Supreme Court." He does. But that does not mean that those who don't have the votes to stop dangerous nominees from being confirmed are obliged to vote for them or to stand mute.

Since Justice David Souter is likely to be replaced by another liberal, it is all too easy to say that it is no big deal. But with all the indications already as to how the Obama administration is trying to remake America on many fronts, the time to begin alerting the public to the dangers is now.

Given the age and health of other Supreme Court justices, more replacements are likely during Obama's time in the White House. Time is an opportunity to mobilize public opinion and perhaps change the composition of the Senate that confirms judicial nominees.

But time by itself does nothing. It is what we do with time that matters.

Democrats Strip Arlen Specter of Committee Rank

Sen. Arlen Specter was unexpectedly stripped of his seniority Tuesday night in a humiliating blow from Democrats who earlier had welcomed the former Pennsylvania Republican’s defection from the GOP.

The move not only strips the five-term senator of his legislative clout but also hampers his ability to persuade voters he can still bring influence to issues in Pennsylvania as he approaches election there in 2010.

Specter lashed back Wednesday, strongly suggesting he had been betrayed.

In a statement released Wednesday afternoon, Specter said Senate Majority Leader Harry Reid, D-Nev., had promised him that his seniority would be preserved.

“Sen. (Harry) Reid assured me that I would keep my committee assignments and that I would have the same seniority as if I had been elected as a Democrat in 1980,” Specter said. “It was understood that the issue of subcommittee chairmanships would not be decided until after the 2010 election. Some members of the caucus have raised concerns about my seniority, so the caucus will vote on my seniority at the same time subcommittee chairmanships are confirmed after the 2010 election. I am confident my seniority will be maintained under the arrangement I worked out with Sen. Reid.”

Specter added that he would “continue to be a staunch and effective advocate for Pennsylvania¹s and the nation's priorities.”

The likelihood that Specter would lose a Republican primary prompted him to jump to the Democrats. Now, although President Barack Obama has promised to campaign for him, Specter could face a Democratic challenger in that party’s primary. After that, he may be up against former Gov. Tom Ridge, the state’s most popular Republican, in the general election.

The Senate vote stripping him of rank came after Specter made a huge faux pas against his new party when he told The New York Times Tuesday that he hoped Republican Norm Coleman wins the protracted court battle over the Minnesota Senate seat. Democrats want candidate Al Franken to prevail over Coleman so the party can attain a filibuster-proof majority of 60 in the Senate.

Politico reported that Specter has managed to alienate Democrats just a week after his much bally-hooed announcement.

"Since declaring himself a Democrat last Tuesday, Specter has defied Senate Majority Leader Harry Reid and the White House on virtually everything that’s come down the pike: the budget, mortgage reform, the Al Franken-Norm Coleman race, even President Barack Obama’s appointment of Dawn Johnsen to head the Justice Department’s Office of Legal Counsel," Politico reported. "All while quibbling over whether he said he’d be a 'loyal Democrat' — and insisting that he had an 'entitlement' to transfer his Senate seniority from one side of the aisle to the other."

Reid read a resolution on the Senate floor Tuesday making Specter the most junior Democrat on four of his five committee assignments. It stood in stark contrast to Reid's alleged promise that Specter would retain his seniority if he switched from the Republican to the Democratic party.

Specter serves on the Appropriations, Judiciary, Veterans Affairs, Environment and Public Works, and Special Aging committees. He had been the top Republican on the Judiciary Committee, which is preparing for hearings on a Supreme Court nominee to replace the retiring Justice David Souter.

When Republicans were in the majority, Specter chaired the confirmation hearings for Chief Justice John Roberts and Justice Samuel Alito. He now will have to wait in line to question the nominee, the Associated Press reported. Specter also was the top Republican on the subcommittee that funds the National Institutes of Health. The issue is a personal one for him because he has twice battled cancer.

The move came only a day after Specter boasted of the power he had through seniority to voters in Pennsylvania.

"My senior position on Appropriations has enabled me to bring a lot of jobs and a lot of federal funding to this state," Specter said at a town hall meeting on Monday, according to CNN.

Over and over, CNN reported, Specter made a point of telling an auditorium filled with medical faculty and staff about the hundreds of millions of dollars he delivered to the Keystone State, thanks to the power he's accumulated in his 29 years in the Senate.

"Pennsylvania has a big interest in my seniority, a big interest," he said.

Speaking on NBC's "Meet the Press" Sunday, Specter said that it's an "entitlement" for him to retain his seniority on those committees.

"I was elected in 1980. I think that's not a bribe or a give for something extraordinary," he said. "I'll be treated as a Democrat as if I was elected as a Democrat."

Specter could have a chance to reclaim his seniority on influential committees such as the Appropriations and Judiciary Committees after the 2010 midterm elections, Democrats have suggested.

Perhaps realizing the consequences his Coleman remarks, Specter quickly changed his tune. He told Congressional Quarterly on Tuesday that he would like to see more Democratic members elected in the 2010 midterms.

"In the swirl of moving from one caucus to another, I have to get used to my new teammates," Specter said. "I’m ordinarily pretty correct in what I say. I’ve made a career of being precise. I conclusively misspoke."

But Democrats have not only stripped Specter of his clout, they’ve used his defection from the GOP to attack his former party colleagues. In a new Web ad from the Democratic National Committee, they parody the TV show “Survivor to highlight "the continued disunity" within the GOP.

The final result is that Arlen Specter has betrayed the party that supported him for decades, only to be apparently betrayed by the party that seduced him to defect.

Obama Team: Yes to Interrogation Memos, No to 'Flyover' Pictures

Amazing… Flyover photos that scared New Yorkers and cost the American taxpayer $328,000+ are classified now, but Interrogation Memos that could harm our troops, hamper future terrorist interrogation, and thereby could endanger all Americans are declassified and released…  As quoted in the New York Times, “The sole purpose of the secret photo-op, which sent thousands of New Yorkers running for cover, was to take new publicity shots of the presidential jet over the city.”  HMMMM…???  M~

Barack Obama and his team in Washington sure have a strange way of promoting full disclosure, openness, and transparency in government. Give them an opportunity to trash the previous administration and those who worked for our national security, and they are all for it. But, ask them to come forward with pictures and a full explanation of a so-called public relations assignment, and they clam up.

In a pathetic display of both arrogance and indifference to America's safety and peace of mind, we see in two events everything we need to know about Obama. Just look at how differently he and his team handled the release of CIA interrogation memos and how they are handling the non-release of photos taken during their flyover photo op in New York City.

As many of you know, Obama decided last month to release previously classified memos which detail the interrogation techniques used in questioning terrorists. (Yes, I still use the word "terrorist" at GOPUSA.) The release of these memos was stunning in that it serves absolutely no useful purpose other than to make America less safe and to allow Obama to continue his message that America is bad.

I discussed the memos at length in my post Mr. Obama... How far would you go to save an American life?, and I came to one conclusion: It was strongly believed that certain high-ranking terrorists knew of another large-scale terror plot against the United States. Traditional interrogation methods were unsuccessful against these three terrorists, so they (and only they) were subjected to waterboarding. The result was that they produced information on a plot to fly at least one airliner into a building in Los Angeles. This plot, known as the Second Wave, would have certainly resulted in the loss of hundreds or thousands of American lives.

However, Obama apparently feels differently. He could have stated his case and his opinions without releasing the memos, but instead of just making a point, he'd rather see American security jeopardized and the careers and private lives of those involved suffer.

As noted in an AP story running on GOPUSA, although the attorneys responsible for approving the interrogation techniques used to obtain the information on the Second Wave will not face criminal charges, they will likely face professional sanctions.

Officials conducting the internal Justice Department inquiry into the lawyers who wrote those memos have recommended referring two of the three lawyers ... to state bar associations for possible disciplinary action, according to a person familiar with the inquiry. The person, who spoke on condition of anonymity, was not authorized to discuss the inquiry.

The person noted that the investigative report was still in draft form and subject to revisions. Attorney General Eric Holder also may make his own determination about what steps to take once the report has been finalized.

Now, let's contrast these actions with the Obama team's handling of the idiotic and suspicious "flyover" that was approved in which the 747 used as Air Force One and a few F-16s flew ridiculously close to buildings in Manhattan... causing a panic. Under the pretense of a "photo op," the aircraft flew close enough to send a chilling reminder to people of the events of September 11, 2001.

In case you missed the video:

YouTube - Air Force One Flyin Low Over New York Caused Panic HD

Apparently, the photo-op cost the American taxpayers $328,835. The administration was looking for a good pic of Air Force One with the Statue of Liberty in the background. However, as FOXNews.com reports, the general public was not warned in advance, even though it is obvious that this could cause a panic.

Now, the White House is saying it will not release the photos taken during the flyover. When asked about the photos during Tuesday's White House press briefing, spokesman Robert Gibbs, first tried to joke about it, saying, "I've watched CNN -- I didn’t notice a lack of archival material from that flight."

When pressed about the photos taken from inside the aircraft, Gibbs responding by adding, "I don't know where those are." The White House spends over $300k on photos, and not only will they not release them to the public, but they don't know where the photos are? What is going on here?

In the New York Post story referenced by FOXNews.com, an Obama aide told the paper, "We have no plans to release them." The report added: "The photos have not technically been 'classified,' a White House aide said, but they are being kept from public view."

So, this is the way the Obama administration works: Release secret interrogation memos but withhold wasteful taxpayer-funded promotional pictures. Can someone please explain that one to me?

Democrat Proposes Jail Time for 'Hostile' Bloggers

Wow… What happened to Freedom of Speech and Freedom of the Press??

We know that the government is becoming more and more audacious in its attempts to control our lives and regulate our speech and whatever it thinks we're thinking (see the newest iteration of the federal Hate Crimes law), so a new story from Wired should come as no surprise. Looks like Democratic Rep. Linda Sanchez, Calif., is ready to throw mean-old bloggers in the hoosegow.

From the Wired report:

Proposed congressional legislation would demand up to two years in prison for those whose electronic speech is meant to “coerce, intimidate, harass, or cause substantial emotional distress to a person.”

Instead of prison, perhaps we should say gulag.

The proposal by Rep. Linda Sanchez, D-Los Angeles, would never pass First Amendment muster, unless the U.S. Constitution was altered without us knowing. So Sanchez, and the 14 other lawmakers who signed on to the proposal, are grandstanding to show the public they care about children and are opposed to cyberbullying.

The bill, HR 1966, is available to read here.

UPDATE: In case the Thomas link to HR 1966 doesn't work, here's the portion of the text of the bill that would actually change the U.S. Code.
SEC. 3. CYBERBULLYING.
(a) In General- Chapter 41 of title 18, United States Code, is amended by adding at the end the following:
`Sec. 881. Cyberbullying
`(a) Whoever transmits in interstate or foreign commerce any communication, with the intent to coerce, intimidate, harass, or cause substantial emotional distress to a person, using electronic means to support severe, repeated, and hostile behavior, shall be fined under this title or imprisoned not more than two years, or both.
`(b) As used in this section--

`(1) the term `communication' means the electronic transmission, between or among points specified by the user, of information of the user's choosing, without change in the form or content of the information as sent and received; and
`(2) the term `electronic means' means any equipment dependent on electrical power to access an information service, including email, instant messaging, blogs, websites, telephones, and text messages.'

HOW OBAMA'S SOCIALISM WORKS

President Obama's vision of the future is, apparently, an economy guided, steered and -- when the occasion demands -- commanded by the federal government. Some of the companies will remain private. Washington will take others over. But all will look to the White House, as to an orchestra conductor, for signals as to how and when and where to proceed. (Sounds like a blend of socialism and fascism).

This summary is the vision that emerges from the Chrysler bailout.

Whether or not one believes the claims of attorney Thomas Lauria (I do) that the investment bank Perella Weinberg Partners was strong-armed by the administration, the fact remains that the four firms that accepted the piddling offer of 29 cents on the dollar are all awash in Troubled Asset Relief Program (TARP) money.

Citigroup, Morgan Stanley, Goldman Sachs, and JPMorgan Chase all dutifully approved the offer from Washington, while Perella Weinberg reportedly held out for 50 cents. Did the combined $90 billion the four compliant firms owed Washington in TARP funds make a difference in their passive acquiescence? You bet it did.

They shouldn't have said yes. Clearly, Obama was not about to pull the trigger, which would have sent tens of thousands of autoworkers straight into unemployment. Politically, he would have had no choice but to cough up the $4.5 billion loan the feds just gave Chrysler with or without a debt settlement. The political pressures that have always operated on this Democratic president are still there and still in play.

Knowing the ultimate vulnerability of the administration position, any investment bank that was looking out for its clients would have demanded more than 29 cents. But Citigroup, Morgan Stanley, Goldman Sachs, and JPMorgan Chase all had a higher calling -- they had to appease King Barack I. To its credit, Perella Weinberg put its investors first.

But this little vignette shows exactly what the new rules of the game will be under this administration. It won't be Soviet-style socialism or Reaganesque capitalism. The system will more resemble the Japanese arrangement where MITI, the Ministry of Trade and Industry, informally guided companies and told them what to do. In Japan, a nod usually suffices to command. In the United States, one has to use a hammer. But the result will be the same: compliant capitalism.

Companies will not look out for their shareholders or their employees or even their customers so much as watch the smoke signals from Washington to decide what to do. The markets won't control decisions. Washington will.

The same balance of government control and nominal private ownership is evident in the mortgage rescue plan and the efforts to rekindle consumer lending. It will be manifest in the cap-and-trade legislation and in the priority that the administration will accord to green lending and job creation.

The strong-arming that obviously led up to the Chrysler deal will also be typical of the Obama industrial policy. When the chips are down, JFK's pressure on U.S. Steel to lower its prices in 1962 will be the model for the Obama years. While terrorists need not fear any violation of their constitutional rights, CEOs of Fortune 500 companies will not be so fortunate.
At the core of the new policy will be the simple assumption that Washington knows best.

But it doesn't. The stagnation of the Japanese economy in the past 20 years is eloquent testimony to the fact that government usually gets it wrong. Sometimes it makes the wrong decision because it fails to anticipate the market (as Japan did when it downplayed laptop computers and stressed mainframes). More often (as is normal in Japan), it is so in the thrall of special interests that it ends up articulating a consensus of those who would divide up the pie among them.

One way or another, the government usually runs the economy into the ground, as it will under King Barack I.

Urgent Message from Christopher Ruddy & Dick Morris

    Israel Calls Up Missile Reservists

    Sunday, May 3, 2009 10:46 PM

Israel has called up its air force reservists to sharpen their skills on Arrow and Patriot anti-missile systems in case of a conflict with Iran, The Jerusalem Post reported Sunday.

The fear is that any conflict with the Islamic fundamentalist state would result in missiles being shot into Israel, which has weathered missile attacks from Iraq, Hezbollah and Hamas over the last two decades.

The reservists are spending one day a week on duty to sharpen their skills. The decision to call up operators of the Arrow and Patriot systems was made last year by head of the IAF's Air Defense Division Brig.-Gen. Daniel Milo.

Arrow operators prepare for Iranian threat

Air Force reservists who operate the Arrow and Patriot missile defense systems have recently begun spending one day a week on duty to sharpen their skills, amid fears that in a conflict with Iran, dozens of long-range missiles would be fired at Israel, The Jerusalem Post has learned.

The decision to call up operators of the Arrow and Patriot systems was made last year by head of the IAF's Air Defense Division Brig.-Gen. Daniel Milo.

Until then, only pilots were called up for one day of reserve duty a week following their discharge from mandatory service.

"We are working hard to be ready for the Iranian threat," a top IAF officer said. "We are preparing for barrages, split warheads and other surprises and therefore we need to retain a high operational level by everyone, including reservists."

Soldiers from the Air Defense Division who are on study leave are also spending one day a week at the unit.

"They come once a week to simulate different scenarios," the officer explained.

The scenarios that are drilled include the firing of large barrages at Israel from different countries at once, and the need for the operator to decide which missile to intercept first and at what stage of its flight.

"There are difficult dilemmas that the operators face when it comes to missile defense," the officer said.

Last month, the IAF held its 17th test of the Arrow 2 interceptor, shooting down a missile mimicking an Iranian Shihab ballistic missile.

Later this year, the IAF will hold an unprecedented and massive exercise with the US military to jointly test three different ballistic missile defense systems, including the Israeli-made Arrow and the American THAAD and Aegis, which will be brought specially to Israel for the exercise.

The high-powered American X-Band radar, deployed in the Negev Desert in late 2008 as a farewell gift from former President George W. Bush, participated in the recent Arrow test and tracked the incoming target.

Military sources said that it was capable of providing "several minutes" of warning from when a missile is launched from Iran and until it is supposed to land in Israel.

Meanwhile, L'Express reported Sunday that IAF fighter jets recently conducted a drill above the Strait of Gibraltar in preparation for a possible attack on Iran's nuclear facilities.

According to the French newspaper, the exercise, held some 3,000 kilometers from Israel, included a mid-air refueling drill.

“Iranian chief of staff announces the “destruction of Israel within eleven days”

Propaganda? probably, but still a bit chilling that he’d put a number on it.

    This is from Jihadwatch:

A strange and ominous report from a German publication.

Here is my rough translation of “‘Zerstörung in elf Tagen’: Iran bedroht Israel,” by Ulrich W. Sahm inn-tv.de, May 3 (thanks to The Total Collapse):

Iran has for the first time announced the destruction of Israel with a concrete goal. Israeli television showed an interview with the Iranian chief of staff General Attalah Salihi. He announced the “destruction of Israel within eleven days.”The Arabia expert Oded Granot explained: “Never have we heard so clear and open an announcement from Iran.” President Mahmoud Ahmadinejad has again and again announced the destruction of Israel in a general manner and as a political goal, but never so concretely and with a date, as did Salihi. Granot has not discovered why the destruction of Israel should happen in eleven days….

Corrections to my translation welcome. - John Infiledesto – Infidels Are Cool

    Protecting Pedophiles?

During a House Judiciary Committee meeting on the Hate Crimes Prevention Act of 2009 (which recently passed the House), Republican Congressman Steve King offered up an amendment to exclude pedophiles from being a protected category under the legislation.

Every single Democrat voted it down.

(If you remember from last week’s Hannity’s America, we reported Democratic Congresswoman Debbie Wasserman Schultz attacked Republican Congressman Tom Rooney for offering an amendment to include veterans as a protected class in the bill.)

Do you think pedophiles should be included in the hate crime bill?

    Obama's Green-house of Cards

Watch "Glenn Beck" weekdays at 5 p.m. ET on FOX News Channel

On Monday, the Dow Jones Industrial Average gained 214 points on better than expected housing reports.

Phew! Looks like we are starting to turn things around.

But here's the one thing: We are rebuilding our economy as another house of cards on a new pile of sand.

China is now the real Bank of America, but unfortunately the only thing worse than China buying our debt, is China notbuying our debt. And that's what is happening. China has drastically cut their purchase of our bonds, which is a lot like your bank cutting up your credit card.

Yet instead of us sitting back and saying, '"Maybe this is a sign that I should start managing my finances a little better," we lie to ourselves that we just go out and find another card.

Our government has sold us the lie that spending is the same as investing and they're leading by example. A hundred billion here, 500 billion there — what's the difference? The average American now has five credit cards and the average American household has over $10,000 in credit card debt.

Even the media plays along. A recent Forbes.com article titled "10 Things to Buy Before the Economy Improves" talks about buying a house, a car, toys, diamonds, furniture, televisions and women's clothing all while prices are allegedly so low.

Yet whenever I ask the experts — economists, professors, even politicians — how we pay for all of this, I'm met with either silence or an expression that roughly translates into: "Oh silly Glenn, don't you worry, there are very smart people figuring all of that out right now."

In other words: No one has an answer. And if you think you have the answer send me an e-mail and I will give you national TV time to explain it. But man, it better make sense!

I know that people seem to think conservatives want government spending to be zero, but that's a lie. I believe in investing in America, but it has to be in projects that can reshape us back into world leaders. You want to spend a trillion on a Manhattan Project to develop a new clean, cheap source of energy? So long as that money stays here in America — sign me up.

Rupert Murdoch, the head of the company that owns FOX News Channel, recently said that we are in a time when, "nations will be redefined." I completely agree, but instead of redefining ourselves the way we did after World War II, we're running right back to the pile of sand.

The Obama administration says we are going to rebuild our economy on "green" jobs and it's not just talk. The stimulus bill has more than $20 billion for investment in a "cleaner, greener economy" and another $500 million for "green" job training. And the Obama administration is predicting it will create or save 5 million green jobs in 10 years.

Sounds terrific, until you start to look at those pesky things called "facts."

Durango, Colorado has bought all of their electricity for their government buildings from wind farms for the past two years. Problem is that it costs so much they'd have to lay someone off to stay "green." They've now gone back to coal.

Instead of blindly pouring cement into this new pile of sand, maybe we should take notice of what's happened to other countries that have tried the things we're suddenly so excited about:

"Cap and trade"? A failure in Europe.

The Kyoto Treaty? A failure almost everywhere around the world.

And "green jobs"? Well, for how that's worked out in real life, just look to Spain.

Green Stimulus Money Costs More Jobs Than It Creates, Study Shows

President Barack Obama exits Air Force One. (AP Photo)
(CNSNews.com) - Every “green job” created with government money in Spain over the last eight years came at the cost of 2.2 regular jobs, and only one in 10 of the newly created green jobs became a permanent job, says a new study released this month. The study draws parallels with the green jobs programs of the Obama administration.

President Obama, in fact, has used Spain’s green initiative as a blueprint for how the United States should use federal funds to stimulate the economy. Obama's economic stimulus package, which Congress passed in February, allocates billions of dollars to the green jobs industry.

But the author of the study, Dr. Gabriel Calzada, an economics professor at Juan Carlos University in Madrid, said the United States should expect results similar to those in Spain:

"Spain’s experience (cited by President Obama as a model) reveals with high confidence, by two different methods, that the U.S. should expect a loss of at least 2.2 jobs on average, or about 9 jobs lost for every 4 created, to which we have to add those jobs that non-subsidized investments with the same resources would have created,” wrote Calzada in his report: Study of the Effects on Employment of Public Aid to Renewable Energy Sources.

Obama repeatedly has said that the United States should look to Spain as an example of a country that has successfully applied federal money to green initiatives in order to stimulate its economy.

“Think of what’s happening in countries like Spain, Germany and Japan, where they’re making real investments in renewable energy,” said Obama while lobbying Congress, in January to pass the American Recovery and Reinvestment Act. “They’re surging ahead of us, poised to take the lead in these new industries.”

“Their governments have harnessed their people’s hard work and ingenuity with bold investments — investments that are paying off in good, high-wage jobs — jobs they won’t lose to other countries,” said Obama. “There is no reason we can’t do the same thing right here in America. … In the process, we’ll put nearly half a million people to work building wind turbines and solar panels; constructing fuel-efficient cars and buildings; and developing the new energy technologies that will lead to new jobs, more savings, and a cleaner, safer planet in the bargain.”

Included in the stimulus package, for example, was $4.5 billion to convert government buildings into high-performance
    green buildings.

According to the Calzada’s study, Spain is a strong example of the government spending money on green ideas to stimulate its economy.

“No other country has given such broad support to the construction and production of electricity through renewable sources,” says the report. “The arguments for Spain’s and Europe’s ‘green jobs’ schemes are the same arguments now made in the U.S., principally that massive public support would produce large numbers of green jobs.”

But in the study’s introduction Calzada argues that the renewable jobs program hindered, rather than helped, Spain’s attempts to emerge from its recession.

“The study’s results show how such ‘green jobs’ policy clearly hinders Spain’s way out of the current economic crisis, even while U.S. politicians insist that rushing into such a scheme will ease their own emergence from the turmoil,” says Calzada. “This study marks the very first time a critical analysis of the actual performance and impact has been made."

Pat Michaels, professor of environmental sciences at the University of Virginia and senior fellow in environmental studies at the Cato Institute, a free market group,  told CNSNews.com that the study’s conclusions do not surprise him. He added that the United States should expect similar results with the stimulus money it spends on green initiatives.

“There is no reason to think things will be any different here,” Michaels said.  “In the short run you have to ask who is doing the hiring, and in the long run how efficient is it to have people serving technology such as windmills. We are creating inefficiencies.”

Michaels also said he was not surprised by the study’s finding that only one out of 10 jobs were permanent.

“That doesn’t surprise me,” said Michaels. “When we see how imperfect wind energy is and how expensive it is to maintain -- I think many of those jobs will become impermanent here in the U.S. as well.”

Senior creditors: Chrysler deal violates 5th Amendment

If the Obama administration expected the senior creditors of Chrysler to fold their tents under political pressure, they may have gotten a rude shock today.  Thomas Lauria, who accused the White House of threatening the creditors withn humiliation at the hands of the White House press corps, has filed a motion to halt the administration’s machinations on behalf of the UAW in the Chrysler bankruptcy.  Lauria and his allies claim that the Obama administration has violated the Constitution in their bid to devalue the senior creditors’ holdings on behalf of junior creditors, and have some precedent to support the allegation.

The heart of the argument starts on page 8 (via HA commenter Outlander):

III. The Taking of Collateral through a Direct or Indirect Use of TARP Authority is Unconstitutional.

    13. The Treasury Department relies on TARP as the purported authority to justify the disparate treatment under the 363 Sale, even though TARP was enacted after the Senior Lenders’ liens on the Debtors’ property were already in place. The Supreme Court long ago recognized, however, that a secured creditor’s interest in specific property is protected in bankruptcy under the Fifth Amendment. Louisville Joint Stock Land Bank v. Radford, 295 U.S. 555, 594 (1935). That case involved a Depression-era statute that was intended to help bankrupt farmers avoid losing their land in mortgage foreclosure. The statute in Radford provided that the bankrupt debtor could achieve a release of the security interests either (i) with the lender’s consent, purchasing the property at its then appraised value by making deferred payments for two to six years at statutorily-set interest rates; or (ii) by seeking from the bankruptcy court a stay of the proceedings for up to five years during which time the debtor could use the property by paying a rent set by the court, which payments would be for the benefit of all creditors, with a purchase option at the end of that period. Id. at 856-57.

    14. Justice Brandeis noted that the “essence of a mortgage” is the right of the secured party “to insist upon full payment before giving up his security [i.e., the property pledged].” Radford, 295 U.S. at 580. In invalidating the statute, the Court stated that “[t]he bankruptcy power . . . is subject to the Fifth Amendment,” and that the pernicious aspect of this law was its “taking of substantive rights in specific property acquired by the bank prior to the act.” Id. at 589-90 (emphasis added). Thus, Congress could not pass a law that could be used to deny to secured creditors their rights to realize upon the specific property pledged to them or “the right to control meanwhile the property during the period of default.” Id. at 594. That is precisely what the Treasury Department would have Chrysler do here, with respect to the Chrysler Non-TARP Lenders’ property rights that were acquired prior to the enactment of TARP.

    15. Relying on purported authority provided by TARP, the Treasury Department is demanding that Chrysler’s assets be stripped away from the coverage of the Senior Lenders’ liens – thereby impairing the rights of the Senior Lenders to realize upon those assets – so that those assets may be put in New Chrysler and used to the benefit of unsecured creditors in this proceeding, who will then be paid much more than the Senior Lenders. But, even assuming that TARP provides the Treasury Department with authority to provide funding to the Debtors and impose the transfer of collateral away from the Senior Lenders, TARP was enacted long after the Senior Lenders contracted with the Debtors and received senior liens on the Debtors’ property. Radford specifically disallowed the use of a law to retroactively alter existing liens on property.

    16. Here, the proposed sale of the Debtors’ assets will leave the Senior Lenders with a diluted pool of assets and no further interests in the operating assets covered by their specific liens. The Constitution forbids this application of a law retroactively to undercut the Senior Lenders’ pre-existing property rights in favor or inferior creditors.

    17. Finally, that the Treasury Department would take these unconstitutional actions to help the United States address difficult economic times is not an answer. Indeed, the same justification was expressly rejected in Radford, where Justice Brandeis noted that a statute which violated secured creditors’ rights, but which was passed for sound public purposes relating to the Great Depression, could not be saved because “the Fifth Amendment commands that, however great the nation’s need, private property shall not be thus taken even for a wholly public use without just compensation.” Id. at 602.

    18. What is really striking here is that what is being proposed by the Sale Motion would strip the Collateral away and allow it to be put to use as new capital in New Chrysler for the benefit of existing and other creditors – even though the Chrysler Non-TARP Lenders have been given no opportunity to realize upon that Collateral to the point of full repayment ahead of at least $14 billion of selectively identified unsecured creditors.

One might think that a Constitutional scholar like Barack Obama would have already known that, but either this precedent escaped him or he doesn’t care about it at all.  Brandeis acted to uphold contract law, especially in the face of a government interest in paying off politically-connected unsecured creditors ahead of the senior creditors.  There is no other reason for Brandeis to make that decision, as only government could insert itself into the contractual relationship during a bankruptcy proceeding — just as Obama has done with Chrysler.

Lauria’s argument seems very compelling here, especially given Brandeis’ rather clear assertion that bankruptcy proceedings have to fall within the 5th Amendment — and that government can’t implement a taking to satisfy its own arbitrary aims by ignoring the relationship of the creditors to the default.  We’ll see whether the court rebukes Obama.

Time Magazines 100 - The World's Most Influential People

In the annual TIME 100 issue, Time Magazine attempts do the impossible: name the people who most affect our world, or have in the previous year, including:  leaders, revolutionaries, builders, titans, artists, entertainers, heroes, icons scientists, writers and thinkers... even some villains.

time 100 walkup tout 2009 barack obama angelina jolie

In a stunning result, the winner of the third annual TIME 100 poll and new owner of the title World's Most Influential Person is moot. The 21-year-old college student and founder of the online community 4chan.org, whose real name is Christopher Poole, received 16,794,368 votes and an average influence rating of 90 (out of a possible 100) to handily beat the likes of Barack Obama, Vladimir Putin and Oprah Winfrey. To put the magnitude of the upset in perspective, it's worth noting that everyone moot beat out actually has a job.

Since moot launched 4chan.org in 2003, the site has given birth to Internet memes as diverse as Lolcats and Rickrolling. 4chan averages 13 million page views a day and 5.6 million visitors a month; by some estimates it is the second largest bulletin board in the world.

See the world's most influential people in the 2009 TIME 100.

For proof of moot's influence on the Web, one need look no further than the TIME 100 poll results. While Filipino boxer Manny Pacquiao got a larger vote total (20,391,818), the runner-up for the title of World's Most Influential Person, Malaysian politician Anwar Ibrahim, received a mere 47 on the influence scale. Moot denies knowing about any concerted plan by his followers to influence the poll, though TIME.com's technical team did detect and extinguish several attempts to hack the vote. (See the full results here.)

Undoubtedly, many people will question moot's worthiness of the title World's Most Influential Person. TIME.com managing editor Josh Tyrangiel says moot is no less deserving than previous title holders like Nintendo video-game designer Shigeru Miyamoto (2007) and Korean pop star Rain (2006). "I would remind anyone who doubts the results that this is an Internet poll," he says. "Doubting the results is kind of the point."
