According to attorney Gary Kreep, President of the United States Justice Foundation (USJF), this season is no different, as Senate Majority Leader Harry Reid (R-NV) is preparing to fast track through the Senate a bill that has Constitutionalists like Kreep very concerned.

Last week, Kreep was already on his toes, sending red-alert announcements about House Bill H.R. 3261 that would allow the Department of Justice to essentially investigate and prosecute those who are “dishonest” on the Internet—a power Kreep argues is “ripe for government abuse.”

Now, after learning from his Washington insiders that Reid has planned a snap final vote on the Senate version of this bill immediately upon returning from holiday break, Kreep has shifted his Paul Revere warning run into overdrive. He explains:
“This bill (S. 968) is disguised as a measure to stop online piracy. However, there are already plenty of laws on the books to protect copyrighted material on the Internet. This is an Internet takeover bill, pure and simple.

This measure will give Eric Holder and Barack Hussein Obama the power to ‘police’ the Internet, “sanitize” web searches and shut down anti-Obama websites.

Just one ‘complaint’ from a liberal activist, or a government agent, that you are indirectly violating an obscure copyright rule, and your website could be fined huge sums, and it could be blacklisted.
Meanwhile, the left-wing mainstream media companies are campaigning all out for this bill, too. They want the government to shut down all the blogs, political forums, and independent news sites, so that they, once again, have a monopoly on the news you and I are allowed to see.”

ABOUT GARY KREEP:
A 1972 graduate of the University of California at San Diego with a Bachelor of Arts Degree in Economics, Mr. Kreep graduated from the University of San Diego School of Law in 1975 with a Juris Doctor. He passed the California State Bar Examination on his first try, and started practicing law in 1975.

He has been in private practice since that time, both as a sole practitioner and as the sole owner of a small law firm, employing as many as three attorneys and ten staff members. Mr. Kreep co-founded the UNITED STATES JUSTICE FOUNDATION (USJF) in 1979 with two other California attorneys. Since that time, he has served as the President and Executive Director of USJF.

As part of the Obama administration’s campaign to promote transparency, the White House announced today it intends to eliminate the public’s access to half of the federal government’s websites within the next year.

The White House said there are nearly 2,000 websites operated by the federal government, which it said confuses people.

Really…? Are you that confused?  What it means is It likely will include websites like the EPA, FDA, and NASA and there will be less information about radiation, food, and space for sure.

“With so many separate sites, Americans often do not know where to turn for information,” the office of Vice President Joseph Biden Jr. said in a statement. “The administration will immediately put a halt to the creation of new websites. The administration will also shut down or consolidate 25% of the 2,000 sites over the next few months and set a goal of cutting the number of separate, standalone sites in half over the next year.”

It called the campaign of winnowing access to government web sites part of the president’s campaign “targeting duplication and waste.” The administration did not give an estimate of how much money it believes could be saved by halving the government’s Internet sites.

A White House official defended the move, saying it will actually improve access.

White House New Media DirectorMacon Phillips has said previously that the government doesn’t need, for example, multiple web sites dedicated to invasive plan.

In a statement, Mr. Obama said, “as we work to tackle the budget deficit, we need to step up our game. No amount of waste is acceptable — not when it’s your money; not at a time when so many families are already cutting back.”

Mr. Biden hosted an event at the White House Monday to announce he is taking on a new role holding the Cabinet accountable for cutting waste in their agencies.

White House officials didn’t say how the administration will determine which web sites to cut. But the president is creating an 11-member “government oversight and accountability board,” comprised of current executive branch officials, “to help federal agencies improve their performance.”

UN mulls internet regulation options

WikiLeaks sparks push for tighter controls.

The United Nations is considering whether to set up an inter-governmental working group to harmonise global efforts by policy makers to regulate the internet.

Establishment of such a group has the backing of several countries, spearheaded by Brazil.

At a meeting in New York on Wednesday, representatives from Brazil called for an international body made up of Government representatives that would to attempt to create global standards for policing the internet - specifically in reaction to challenges such as WikiLeaks.

The Brazilian delegate stressed, however, that this should not be seen as a call for an "takeover" of the internet.

India, South Africa, China and Saudi Arabia appeared to favor a new possible over-arching inter-government body.

However, Australia, US, UK, Belgium and Canada and attending business and community representatives argued there were risks in forming yet another working group that might isolate itself from the industry, community users and the general public.

"My concern is that if we were to make a move to form a governmental-only body then that would send a very strong signal to civil society that their valuable contribution was not required or was not being looked for," an un-named Australian representative told the meeting.

Debate on the creation of a new inter-governmental body stemmed from a UN Economic and Social Council resolution 2010/2 of 19 July.

The resolution invited the UN Secretary-General "to convene open and inclusive consultations involving all Member States and all other stakeholders with a view to assisting the process towards enhanced cooperation in order to enable Governments on an equal footing to carry out their roles and responsibilities in respect of international public policy issues pertaining to the Internet but not of the day-to-day technical and operational matters that do not impact upon those issues."

Much debate concerned the meaning of "enhanced cooperation" and whether a new inter-governmental body was required. Participants also debated the roles of existing organizations - such as the Internet Governance Forum, ICANN and the ITU.

The IGF - an organization that informs the UN but makes no decisions - is running close to the end of a five-year mandate, due to expire at ?the end of the year.

The likes of ISOC, ICANN and more recently the World Information Technology and Services Alliance (WITSA) have recently expressed concerns [PDF]? that a working panel to decide on the future of the IGF has been limited to representatives from member-states.

"Australia is a very strong supporter of the Internet Governance Forum," the unidentified Australian UN representative said at the New York meeting this week. "That is very much due to the multi-stake-holder approach of the IGF. It is an inclusive process."

Australia's Department of Broadband, Communications and the Digital Economy said that Australian Government welcomed the resolution of the Second Committee of the United Nation General Assembly (UNGA) to extend the Internet Governance Forum (IGF) for a further five years.

The DBCDE said it would like to see the organisation retain an open and participatory membership.

"Australia has always supported the participation of civil society and the private sector in the IGF and regards their participation as being integral to the IGF's success," a spokesman told iTnews.

McCain Moves to Block FCC's Net Neutrality

U.S. Sen. John McCain has introduced legislation that would block the Federal Communications Commission from creating new net neutrality rules, on the same day that the FCC took the first step toward doing so.

McCain on Thursday introduced the Internet Freedom Act, which would keep the FCC from enacting rules prohibiting broadband providers from selectively blocking or slowing Internet content and applications. Net neutrality rules would create "onerous federal regulation," McCain said.

The FCC voted Thursday to begin a rulemaking process to formalize net neutrality rules. The rules, as proposed, would allow Web users to run the legal applications and access the legal Web sites of their choice. Providers could use "reasonable" network management to reduce congestion and maintain quality of service, but the rules would require them to be transparent with consumers about their efforts.

The new rules would formalize a set of net neutrality principles in place at the FCC since 2005.

McCain, an Arizona Republican, called the proposed rules a "government takeover" of the Internet that will stifle innovation and depress an "already anemic" job market in the United States. McCain was the Republican challenger to President Barack Obama in the 2008 election, and Obama has said net neutrality rules are among his top tech priorities.

McCain protested the FCC's proposal that wireless broadband providers be included in the rules. The wireless industry has "exploded over the past 20 years due to limited government regulation," McCain said.

"Today I'm pleased to introduce the Internet Freedom Act of 2009 that will keep the Internet free from government control and regulation," McCain said. "It will allow for continued innovation that will in turn create more high-paying jobs for the millions of Americans who are out of work or seeking new employment. Keeping businesses free from oppressive regulations is the best stimulus for the current economy."

It's unclear whether the legislation would pass. Democrats, who generally support net neutrality rules, have majorities in both the Senate and the House, but in recent days, more than 70 House Democrats have written the FCC expressing concern over net neutrality regulations.

Elsewhere, reaction to the FCC's decision was mixed.

Supporting net neutrality rules:

"Network neutrality protects the fundamental rights of Americans in using the Internet and accessing content, applications, and services of their choice. A well-reasoned network neutrality policy also ensures a level playing field for companies large and small as they create an online presence, and will continue to foster the entrepreneurial innovation found not only in corporate office suites, but in college dorms across the country." — Statement from Sens. Byron Dorgan, a North Dakota Democrat, and Olympia Snowe, Maine Republican.

"It is clear to us that at the end of the proceeding, consumers and innovators will benefit from an open and nondiscriminatory Internet. As a result, the economy will benefit in the future, as it did in the past, from the stability of an Internet that grants equal opportunity to all to participate in an open Internet environment." —Gigi Sohn, president of Public Knowledge, a digital rights group.

"This is a down payment on creating a digital democracy. Today's vote to begin the process of requiring nondiscrimination ensures, among other things, that large internet providers will be unable to block or throttle speech from competitors or those who disagree with them. The nondiscriminatory environment in which the Internet was developed fostered unprecedented opportunities for political and artistic expression." Andrew Jay Schwartzman, president and CEO of the Media Access Project, a media reform and digital rights group.

Opposed to net neutrality rules:

"I remain concerned ... that the FCC is poised to take intrusive action into a well-functioning Internet ecosystem without either the demonstrated need or clear legal authority to do so. I know of no empirical evidence suggesting that the openness of the Internet that we all value is under threat today, or is likely to be under threat tomorrow. In the absence of evidence of market failure or demonstrable consumer harms, the costs of government intervention are more likely to outweigh the benefits." — Barbara Esbin, a senior fellow at the Progress and Freedom Foundation, a free-market think tank.

"As the FCC's Broadband Task Force said recently, it could take $350 billion to build next-generation broadband across America, and most of that money will have to come from the private sector and companies like Comcast. We continue to hope that any rules adopted by the commission will not harm the investment and innovation that has made the Internet what it is today and that will make it even greater tomorrow." — David Cohen, executive vice president at Comcast

"I understand there is a regulatory revival climate in Washington under the Obama administration, but the FCC's launch of a rulemaking proceeding to adopt new Internet regulations stands out as an example of a proposed regulation in search of a problem that will then search for a solution to address the non-problem. At the FCC meeting, there was absolutely no evidence presented by the FCC's staff of any market failure or pattern of marketplace abuses. It is risky business for regulators to mess with a technologically dynamic environment that is working well for American consumers and the economy." — Randolph May, president of the Free State Foundation, a free-market think tank.
