Sends letter to Attorney General Eric Holder about recent “SWAT-ting” incidents

WASHINGTON – Today, U.S. Sen. Saxby Chambliss, R-Ga., sent a letter to Attorney General Eric Holder regarding recent reports that several conservative political commentators have been targeted with harassing and frightening actions. Chambliss demanded that Holder examine these cases to determine if federal laws have been violated.

These dangerous hoaxes, also known as “SWAT-ting,” occur when a perpetrator contacts local police to report a violent incident at a target’s home. These callers are believed to utilize voice-over IP (VOIP) and other less-traditional telecommunications methods to make the call appear to come from the target residence and to hide the caller’s true identity.

In response, a dispatcher sends a SWAT team or other police unit in a heightened state of readiness to the unsuspecting target’s residence. Targets only learn of these false reports when a large police presence descends upon their homes.

In the letter, Chambliss states that “Any potentially criminal action that incites fear, seeks to silence a dissenting opinion, and collaterally wastes the resources of law enforcement should be given close scrutiny at all levels… Regardless of any potential political differences that may exist, threats and intimidation have no place in our national political discourse. Those who choose to enter into that political discourse should not have to worry about potential threats to their or their family’s safety.”

Dear Attorney General Holder:

I am writing with concern regarding recent reports that several members of the community of online political commentators have been targeted with harassing and frightening actions. Any potentially criminal action that incites fear, seeks to silence a dissenting opinion, and collaterally wastes the resources of law enforcement should be given close scrutiny at all levels.

According to these individuals’ reports, these dangerous hoaxes, also known as “SWAT-ting,” have a perpetrator contacting a local police department to report some type of violent incident at the home of the target. It is believed that these callers utilize some of the less traditional telecommunications methods, including voice over IP (VOIP) to make the call appear as though it is coming from the target residence and to better hide the true identity of the caller.

In response, a dispatcher then sends a large number of understandably anxious police units, in a heightened state of readiness, to the home of the still unsuspecting target. The first that the target or their unsuspecting family learns of this false report to law enforcement is when they are shocked to see an abnormal police presence descending on their residence.

The use of SWAT-ting as a harassment tool is apparently not new, but its use as a tool for targeting political speech appears to be a more recent development. During the last year, some of the more widely reported cases of SWAT-ting have taken place against blog operators across the country, including in Georgia. The emerging pattern is both disturbing and dangerous.

While these incidences are currently small in number, and have fortunately not led to any accidental physical harm, they are extremely concerning. The perpetrators appear to be targeting individuals who are vigorously exercising their First Amendment rights to political speech. As you know, these reported efforts to intimidate those who choose to enter the political forum and express their opinions are in conflict with the founding principles of our nation.

Regardless of any potential political differences that may exist, threats and intimidation have no place in our national political discourse. Those who choose to enter into that political discourse should not have to worry about potential threats to their or their family’s safety.

While I am certain that local law enforcement is reviewing each of these instances, I am asking you to please look into each of these cases as well to determine if any federal laws may have been violated. Future targets of SWAT-ting, whether engaged in political speech or not, may not be so fortunate as to escape physical harm.

Bloggers are being actively silenced by paid domestic terrorists. SWATting, the tactic of calling in phony emergency calls in order to have a SWAT Team dispatched to someone’s home, is on the rise and all you hear from the FBI is crickets, although they could stop this if they wanted to. Maybe a moan from some innocent blogger or his family who was just ‘accidentally’ gunned down might carry on the wind, but is more likely to be drowned out by the shredding of the Constitution.

BREITBART TOLD THE STORY JUST BEFORE HE DIED

In the last radio interview Andrew Breitbart ever gave, on Hugh Hewitt’s radio show, Breitbart talked about a new ruthless tactic used by thugs against political opponents:

[O]ne of the things they’ve done to people who have worked with me in the past, including an L.A. prosecutor, is to “SWAT.” That means that they’re spoofing phones, pretending to be somebody else’s phone, calling 911, and saying “I killed somebody” and then the person’s home is met with the guns drawn, the SWAT and the helicopters, in a horrifying act. It’s happened twice: once in New Jersey, once in Los Angeles, with an L.A. County . . . prosecutor who [is] associated with me.”

I am that L.A. County prosecutor. And in this post, you’ll hear the hoax call that sent police to my house, pointing loaded guns at me.

And it just happened again to Erick Erickson of RedState for blogging on Kimberlin. Remember the names Ron Brynaert, Neal Rauhauser and Brett Kimberlin, because they are actively hunting conservative bloggers and terrorizing them. These same conservative bloggers are the clarions that let the rest of America know when tyranny is crushing the life out of our country. They are the last line of defense in news and they are being threatened at every turn with arrest and death. The Speedway Bomber is once again running in a tight, close-knit wolf pack these days and they have a taste for conservative bloggers.

This last week, Aaron Walker was hauled out of court in handcuffs for blogging against Kimberlin as well. It would appear that blogging is now a crime in some instances – so much for the Constitution.

Kimberlin has a long history of harassment and terrorism. And his backers and protectors have very deep pockets. You should not be surprised that he receives the backing of George Soros, Barbara Streisand, The Heinz Foundation and indeed, Barack Obama himself. I have at least two anonymous sources in Indiana who tell tales that would curdle your blood dating from 1978. I’ve also noticed that some in-depth articles on Kimberlin on the web are disappearing. Kimberlin blogs under the name ‘Expose Breitbart.’ Active efforts are on-going by others to connect him to even more crimes, specifically murder. In 1981 he was sentenced to 50 years for the Speedway Bombings and yet he is now free to terrorize those who would stand up against the Progressives.

Here’s a peek into the workings of Kimberlin from Mark Singer at The New Yorker in 1996:

ABSTRACT: A REPORTER AT LARGE about Brett Coleman Kimberlin… Writer completed and published a story on the eve of the last Presidential election, in which Kimberlin was described as an unlikely American political prisoner. The writer stands by this story, but also goes more into depth about why Kimberlin was in prison in the first place, and what it was he did to get there… He was 5’5″, and while in prison had become a competitive power lifter… He was released in Nov. 1993, aged 39… He had been sentenced to serve 50 years and had served 15… Writer tells about traveling with him on a Greyhound bus to his mother’s house in Washington, D.C…. Writer describes Kimberlin’s incarceration… He signed a contract to write a book about Kimberlin’s life. He agreed to cooperate, and in exchange he would receive a share of the book’s royalties. This venture was predicated on the idea that there was a richer story to tell than the one I had previously told. Looking back, I think we both assumed that we had the same story in mind–an assumption that now strikes me as both conspiratorial and naive… Who he was and where he’d been had begun to seem ambiguous; where he was now heading was impossible to predict. Verities that I had filed away as tangible and solid now struck me as hazy and transient. There were questions I could pursue endlessly, their answers growing yet more elusive. I knew for sure only that I was witnessing the middle passage of a long and strange American voyage… Tells about his career, beginning at 15, as a marijuana dealer… Tells how he was implicated by police in the murder of Julia Scyphers; her granddaughter, then aged 9-12 accompanied Kimberlin alone on vacations… Police theorized that Kimberlin had her murdered in order to stop her from blowing the whistle on his drug smuggling and relationship with her granddaughter… Tells about a string of bombings which perplexed the Scyphers’s area directly after the murder & which were later tied to Kimberlin… Kimberlin meanwhile was arrested on a marijuana smuggling charge & later convicted of the bombing spree as well as attempting to forge the Great Seal of the President of the United States… Tells about his time in prison as a model prisoner and a jailhouse lawyer… Tells how Kimberlin fought the bombing case all the way to the Supreme Court… Describes how Kimberlin claimed to have sold marijuana to Vice-Presidential candidate Dan Quayle while in prison… Tells about the opinions of people writer spoke to who described Kimberlin as a psycho…. Writer started a new file called “megalomania,” which included some of the things that he was picking up: that Kimberlin regarded the police as idiots; that, just before the Gulf War, be became convinced that his own interventions with the Iraqis could bring Saddam Hussein to his senses; that he grew irritated with Vincent Foster, Jr., when he committed suicide, because it might keep the Clinton Administration from focusing on his own case… Tells about Kimberlin’s attempt to become a pop icon… Writer grew weary of Kimberlin’s narcissism… Tells about Kimberlin meeting Dan Quayle at a book signing… Writer’s original story was an account of an individual’s civil rights abused by politicians and bureaucrats who were protecting their interests. I still stand by the essentials of that story. But the injustices it describes must stand alongside the history of injustices I kept discoveringof law, of humanity, of life: injustices that dwarfed this little man’s original complaints. And that story is true, too.

So you see, this is not the average run-of-the-mill leftie… This is a very dangerous psychopath who is actively stalking bloggers such as Stacy McCain of The Other McCain who is now in hiding trying to protect his family after blogging about this monster. So far, he has called for the arrest of Karl Rove, Andrew Breitbart, Chamber of Commerce head Tom Donohue, Massey Energy Chairman Don Blankenship and other high-profile public figures. But his most recent hits include Aaron Walker, Patterico, Liberty Chick, Stacy McCain and Erick Erickson.

Fox News sheds light on his financial dealings:

A review of tax filings for Kimberlin’s blogs, “Velvet Revolution” and “Justice Through Music,” raises troubling questions about whether his “nonprofit” operations are dedicated to public activism — or are just a new facade for a longtime con artist.

Though neither website publicly reveals Kimberlin’s role, tax and corporate documents show that he is one of four directors who incorporated the Velvet Revolution, and that he is the registered agent for the tax-exempt, non-stock company, which is registered at his mother’s house in Bethesda. In 2008, the last year for which tax records are available, Velvet Revolution took in $83,000 in gifts and contributions.

Kimberlin is also one of two incorporators of Justice Through Music, as well as a $19,500-a-year employee of the non-profit, whose purpose is to “shed light on some of the injustices of the world through music” and which took in more than $550,000 in contributions in 2008.

Kimberlin has raised millions in the last few years to fuel his terror campaigns. He is partial to lawsuits, but violence is his forte. And, in my opinion, he bears an uncanny resemblance to Bill Ayers. Psychos of a feather…

But as digging continues on Kimberlin, more and more weird facts (yet to be verified) keep popping up. His folks owned a health food store in Broad Ripple, a village in Indianapolis. With money from his family, he opened a vegetarian/health food store in Broad Ripple, which is a village located in the north part of Indy. His father was an attorney I understand. Another tidbit says that he lived in Russia for some time. Not sure if he attended university there, but it is said that he owned a Jolt Cola franchise there. As I said, no verification yet, so if anyone has details on this let me know. I’m also hearing whispers about those who are protecting Kimberlin. Very interesting whispers indeed. More uncorroborated tips include a penchant for impersonating law enforcement and drug dealing. His home was raided for bomb making materials, but all that were found were illicit drugs which the warrant did not cover at the time – another fact that should be looked into. There are also whispers of a connection to Tony Rezco – still needs verification. Whatever is found and verified, it looks like a lot of powerful people looked the other way because of intimidation, extortion and blackmail. We will let you know as more facts come to light.

A special thank you goes to Michelle Malkin who has the courage and the determination to unite the blogosphere against Kimberlin and his ilk.

One wonders why this is not all over the major media outlets. Only Fox News has covered it so far with the help of major talk show hosts such as Glenn Beck. If the silencing of the clarions continues, there will soon be no voice to warn Americans of the tyranny that is descending. We must all surely stand together or we will hang separately.

Austin Steals Elderly Veteran’s House for Crime of Having Fallout Shelter

The city of Austin, Texas, was looking for an excuse to steal Joe Del Rio’s modest home. It found one – it insisted he had a “bunker” beneath the house.

Actually, it was a fallout shelter built during the Cold War, something millions of Americans were encouraged to build by the federal government, beginning in 1961 under the Community Fallout Shelter Program.

The city began its theft by sending the code enforcement team to Mr. Del Rio’s home early one Saturday morning in May of 2010. After the retired Air Force reservist, Vietnam veteran, and former state employee put on some clothes and opened the door, he was rushed by an Austin Police SWAT team. He was detained and interrogated over a period of ten hours.

Neighbors were told to evacuate and the home was searched for more than four hours as emergency personnel staged units nearby. Cops found several weapons and 55-gallon drums they considered suspicious. There was nothing sinister about the drums and the legal weapons were returned to Del Rio after the cops examined them.

Authorities accused Del Rio of having a bunker beneath his house. “The code officers went out to investigate it and the individual was fairly cooperative and showed them what he had been working on, which turned out to be a multi-level underground structure,” Doug Matthews, director of communications for the City of Austin, told the Statesman.

Matthews said the city “had some concerns about the structural integrity of the building and the contents of what was down there,” but this turned out to be a pretext for what would come – not only the wholesale theft of the house, but also socking Del Rio with a bill for $90,000 after the city sued him and then poured 264 tons of concrete into the “bunker” and put up a fence around the perimeter. It yanked the meter off the house, making it uninhabitable.

But this was not the end of Mr. Del Rio’s nightmarish ordeal. The city then condemned the house and took possession of it without paying a single cent in compensation. The elderly Vietnam War veteran was handed over to Adult Protective Services since he is a senior citizen and made homeless, thanks to the government of Austin.

“In my opinion, they wanted my property to start with, and this was a way to take my property away from me,” Del Rio said this week. “The ordeal they put me through was unnecessary. I’ve gotten the runaround. I think they want the property. Condemning it is a cheap way to get it.”

I just got a message from a friend in Arizona "we have a 'situation' here outside Bisbee. A rancher who's house is within yards of a major immigrant pass has been beaten and nearly killed by the Bisbee Police. i am not sure they even have jurisdiction where he is. They confiscated all his weapons. I have asked him to write a statement, but after that, not sure where to go what to do. If you have any suggestions... It is my thinking that he has been targeted for the proximity of his land. He is elderly. During the beating one officer grabbed and tugged on his pacemaker. he was hospitalized overnight. They refuse to give him a receipt for the 7 weapons they took. They threw him to the ground when he was asked to come out of the house and he did so - in a t shirt and shorts, barefoot"

Cassie McSasserson OK this is the story "I will tell all I know. I am not yet sure how far he wants to go with this. He has been badly frightened. I would not want to go ahead without his permission.
What he told me last night (I was there fixing his computer) is that (obviously if you could see his property) he owns a major thourofare from Mexico to Naco and Bisbee. He said it is the best path because he owns a ravine that goes to the border. he has never hurt anyone, is elderly and ill.

Well, last week, a Coyote (human not animal) was bringing a bunch across and were giving his 30-yr-old daughter a very hard toime, driving by slow, looking in windows and all. So, he went out with his AK47 and popped a few into the air to get them to go away. The Coyote called the police and they sent a SWAT team. He said between 6 and 10 cop cars pulled in and speakered to him to come out of the house unarmed. He came out in a t-shirt, shorts and no shoes. They grabbed him, threw him on the ground, mashed his head into the gravel and started pounding on his pacemaker. Sorry I do not recall what he told me they were saying to him. They skinned his knees (he has photos) and cut up his head near where he has previously had a stroke - that scared him they were pounding on the part of his head where he had had a stroke, and were pounding on his pacemaker and grinding him into the dirt. They then went into his house - he says without permission or even ASKING and confiscated 6-7 weapons. They took him to Police dept. were he started to look really bad and so they took him to the hospital, where he was kept overnight. The next day, from the hospital he called and asked about a ride back (small town we have no public transport or taxi - he would have had to walk 10 miles home) they said no and that they didn't have to give him a receipt for his weapons. That is where I came in the picture - a few days later.

When I was at his place last night, I saw 5 illegals within 200 yards of his house. But also when I was there and he was telling me the story, he broke down and cried 3 times during the telling. Also as I was there, he would drop little bits of info so it is hard for me to put it all together. I told him I would help him if he wanted, that he has to write out a statement of every detail and I would get it to people. He at that point was ready to commit suicide, I thought. He is a recovering alcoholic and has started drinking over this so it was really hard for me to get the story. They have fucked this man up.
I asked him how many illegals has he turned in over the years, and he told me about 200 and that BP Border Patrol, always thank him. Then... as I was leaving, he tells me that if he calls BP from his house phone, they don't answer anymore. If you could see where his property lays, you would think as I do, they just want his property and will kill him to get it.

He kept telling me that the SWAT team acted as if it was a Drill or a training thing. He said it was surreal, and he feels as if he has been raped. he has not yet decided how far he wants to go, or if he should try to sell, or what but the property has been in his family for generations - his family is one of two or three in the area that originally settled here. I promised to talk to him tomorrow as I still have more computer works to do and so i will see where he is, then. But as I was leaving and I told him i would help him if he wants to fight, he sort of perked up and said yes, I want to fight. But tonight, at my neighbors for dinner he had a mini-stroke or something and we rushed him home. I think really, he is scared to death and thought he was alone until i showed up and said I would help, if he wants it. I think he needs to write out the statement and get it to me as he promised, and we go from there..."

  1. The basic mission for which the police exist is to prevent crime and disorder.
  2. The ability of the police to perform their duties is dependent upon public approval of police actions.
  3. Police must secure the willing co-operation of the public in voluntary observance of the law to be able to secure and maintain the respect of the public.
  4. The degree of co-operation of the public that can be secured diminishes proportionately to the necessity of the use of physical force.
  5. Police seek and preserve public favor not by catering to public opinion but by constantly demonstrating absolute impartial service to the law.
  6. Police use physical force to the extent necessary to secure observance of the law or to restore order only when the exercise of persuasion, advice and warning is found to be insufficient.
  7. Police, at all times, should maintain a relationship with the public that gives reality to the historic tradition that the police are the public and the public are the police; the police being only members of the public who are paid to give full-time attention to duties which are incumbent on every citizen in the interests of community welfare and existence
  8. Police should always direct their action strictly towards their functions and never appear to usurp the powers of the judiciary.
  9. The test of police efficiency is the absence of crime and disorder, not the visible evidence of police action in dealing with it.

These principles listed above may have been Sir Robert Peel’s principles. However, the Metropolitan Police’s founding principles and, de facto the founding principles of all other modern (post 1829) UK police forces, was summarized by Sir Richard Mayne (the first commissioner) in 1829 in the following terms:

  1. To prevent crime and disorder, as an alternative to their repression by military force and severity of legal punishment.
  2. To recognize always that the power of the police to fulfil their functions and duties is dependent on public approval of their existence, actions and behavior and on their ability to secure and maintain public respect.
  3. To recognize always that to secure and maintain the respect and approval of the public means also the securing of the willing co-operation of the public in the task of securing observance of laws.
  4. To recognize always that the extent to which the co-operation of the public can be secured diminishes proportionately the necessity of the use of physical force and compulsion for achieving police objectives.
  5. To seek and preserve public favor, not by pandering to public opinion; but by constantly demonstrating absolutely impartial service to law, in complete independence of policy, and without regard to the justice or injustice of the substance of individual laws, by ready offering of individual service and friendship to all members of the public without regard to their wealth or social standing, by ready exercise of courtesy and friendly good humor; and by ready offering of individual sacrifice in protecting and preserving life.
  6. To use physical force only when the exercise of persuasion, advice and warning is found to be insufficient to obtain public co-operation to an extent necessary to secure observance of law or to restore order, and to use only the minimum degree of physical force which is necessary on any particular occasion for achieving a police objective.
  7. To maintain at all times a relationship with the public that gives reality to the historic tradition that the police are the public and that the public are the police, the police being only members of the public who are paid to give full time attention to duties which are incumbent on every citizen in the interests of community welfare and existence.
  8. To recognize always the need for strict adherence to police-executive functions, and to refrain from even seeming to usurp the powers of the judiciary of avenging individuals or the State, and of authoritatively judging guilt and punishing the guilty.
  9. To recognize always that the test of police efficiency is the absence of crime and disorder, and not the visible evidence of police action in dealing with them.

In a broad sense these principles were continued to be taught until the time of Sir Robert Mark when he introduced his little “blue book” in the 1970’s:

To these ends all the efforts of police must be directed. Mark does go on though to make the point that the above is done with the consent of the public and is not done by way of imposing on the public.

Since Sir Robert Mark every commissioner has had his own set of “principles”, for instance Sir Peter Imbert had “The Plus Program” and so on.

Notwithstanding the generality of my last comment, poster versions of Sir Richard Mayne’s principles could still be seen within the Met Police Training school as late as the early 1990’s (for historical purposes).
