Let us remember and honor all our presidents, but let us take a little time to remember our first president, George Washington, who took the job reluctantly because he realized the weight of the job as well as of the office itself.  He was the hero of the revolutionary war and was one of the Founding Fathers involved with the Declaration of Independence and the creation of the Bill of Rights and the Constitution.  Quite a difference from the man in the White House today who says he has a pen and a phone and believes he can do with them what he chooses!

New American: As he has promised for months, Senator Rand Paul (shown, R-Ky.) has filed a class-action lawsuit against the Obama administration, challenging the constitutionality of the National Security Agency’s dragnet collection of metadata.

In a press conference held Wednesday, the libertarian-leaning freshman senator announced that he was teaming with FreedomWorks and former Virginia attorney general Ken Cuccinelli in pursuing this “historic” lawsuit.

“There’s a huge and growing swell of protest in this country of people who are outraged that their records are being taken without suspicion, without a judge’s warrant and without individualization,” Paul said, standing outside the U.S. District Court for the District of Columbia.

In a statement made in a video defending the Fourth Amendment, Paul declares, "Our Founders never intended for Americans to trust their government."

Paul’s purpose in the lawsuit is to demonstrate that principle by holding the NSA and the rest of the intelligence community accountable for the constitutionality of their activities.

“I’m not against the NSA, I’m not against spying, I’m not against looking at phone records,” Paul said. “I just want you to go to a judge, have an individual’s name and a warrant. That’s what the Fourth Amendment says.”

In an interview with Politico, Paul indicated he believed there is no wiggle room when it comes to adhering to the standards set out in the Constitution regarding the process for searching and seizing information from citizens.

“Whether you breach the Fourth Amendment 20 percent of the time or 100 percent of the time, it’s still not the point,” he said. “The point is whether or not you still collect millions of people’s information with a single warrant.”

During an appearance on Fox News Sunday in June of last year, Paul announced plans to file a class action lawsuit against the Obama administration, demanding it provide legal justification for the recently revealed wholesale watching of millions of citizens not suspected of any crime.

“I’m going to be seeing if I can challenge this at the Supreme Court level,” Paul said, according to the show transcript. "I’m going to be asking all the Internet providers and all of the phone companies, ask your customers to join me in a class action lawsuit. If we get 10 million Americans saying, 'We don’t want our phone records looked at,' then somebody will wake up and say things will change in Washington," he added.

When asked by host Chris Wallace why he considered the NSA’s surveillance unconstitutional, Paul responded:

Well, you know, they're looking at a billion phone calls a day is what I read in the press and that doesn't sound to me like a modest invasion of privacy. It sounds like an extraordinary invasion of privacy. The Fourth Amendment says you can look at and ask for a warrant specific to a person, place and the items.

This is a general warrant. This is what we objected to and what our Founding Fathers partly fought the revolution over is they did not want generalized warrants where you could go from house to house with soldiers looking for things or now from computer to computer, to phone to phone, without specifying who you're targeting.

Specifically, the Fourth Amendment states that the “right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

While unapologetically spying on millions of Americans, the federal government makes no attempt to demonstrate that any of those whose phone records have been seized are suspected of committing some crime. It is a plain and simple violation of the Fourth Amendment in the hope of discovering something that one day might be found to qualify as suspicious. That is putting the cart of culpability before the horse of the Constitution, and the American people are right to insist that the president be held accountable.

As Senator Paul explained to Chris Wallace, “What I do in my private life is my private life. If you suspect me of a crime, have probable cause.”

How far are the citizens of this Republic willing to let the federal surveillance apparatus go toward constructing a Panopticon? At this accelerated rate of construction, how long until every call, every text, every e-mail, every online message, and every movement will fall under the all-seeing eye of federal overlords?

Senator Paul thinks now is the time to derail this “long train of abuses” and he believes that the American people have the will and the way to do so. Citing the successful defeat of a pair of recent legislative attempts to pierce the veil of Internet privacy, Paul thinks that those events prove that popular resistance can provide a pathway toward ending the NSA’s snooping, as well.

The bills referred to by Paul are the Cyber Intelligence Sharing and Protection Act (CISPA) and the Stop Online Piracy Act (SOPA). Both acts were defeated in Congress, although many of their provisions were enacted as part of other bills or through executive orders.

Speaking of the popular uprising that led to the defeat of these measures, Paul told Wallace, “If we can have that again — people by the millions coming out and saying, 'Look, I want to be part of a class action suit that says to the government, let's hear this at the Supreme Court level. Are you allowed to look at phone records even though there's no probable cause that I'm related to a crime?' — I think we'll put an end to this.”

The Justice Department sees things differently, of course.

In a statement published by Politico, a Justice Department spokesman said, “We remain confident that the Section 215 telephone metadata program is legal, as at least 15 judges have previously found.”

Although he’s been promoting the idea since late last year, perhaps Senator Paul chose to file the suit now in light of recent favorable court rulings.

In December, for example, a federal judge ruled that the NSA’s dragnet collection of information on all phone calls likely violates the Constitution. In a 68-page Memorandum Opinion issued on December 16, Judge Richard J. Leon of the U.S. District Court for the District of Columbia ruled that the NSA’s unwarranted surveillance of telephone calls is prohibited by the Fourth Amendment’s protections against unreasonable searches and seizures.

The suit that was the subject of Leon’s ruling was filed by Larry Klayman, the founder of Freedom Watch. In a statement published by WND, Klayman reached out to the senator-turned-plaintiff, welcoming him to the fray.

“I invite Sen. Paul to join our ongoing class actions, as they have already proven to be successful in large part — given Judge Leon’s unconstitutionality ruling. The other plaintiffs and I are pleased that Paul also is fighting to slay the NSA express,” Klayman wrote.

Donations to help pay the legal expenses associated with pursuing Senator Paul’s complaint are being collected at defendthefourth.com and constitutiondefensefund.com, a website managed by FreedomWorks.

“Any money donated through the petition page on www.ConstitutionDefenseFund.com will be going towards the legal costs of this suit,” FreedomWorks spokeswoman Jacqueline Bodnar said, as reported by Politico. “We expect this case to go all the way to the Supreme Court, so it’s going to be expensive.”

While Senator Paul’s efforts are to be commended, the federal judiciary is not empowered in the Constitution to be the arbiter of what is or is not constitutional. 

Furthermore, the Supreme Court has demonstrated repeatedly that it cannot be relied upon to rein in the other branches of the federal government.

The best answer to the NSA’s wholesale violations of the Fourth Amendment is state and local actions refusing to cooperate with the organization’s surveillance activities, whether through bills nullifying federal acts permitting the programs or through measures cutting off vital utilities from NSA facilities.

TheBlaze: Wallbuilders founder and Historian David Barton has officially announced his support for a convention of states. The historian, who contemplated a Senate bid late last year, has spoken of the subject in the abstract before. But now that a convention is growing increasingly possible, Barton is “confident that this is the correct course of action.”

Though a convention of states has not been held since the nation’s founding, it has grown increasingly popular as a response to what many see as overreach from the federal government. Through Article V of the U.S. Constitution, states can propose amendments to the Constitution if two-thirds of states submit applications for such a convention. In December, nearly 100 state lawmakers gathered at Mount Vernon, Va., to discuss the process. On Tuesday, the Georgia state Senate became the first state legislative body to pass the current “constitution of states” application by a vote of 37-17.

We have not come to this conclusion lightly,” Barton and “Wallbuilders Live” co-host Rick Green said in a letter to Glenn Beck Monday. “Like many of our conservative friends, we initially avoided this constitutionally-specified process due to a fear of what might occur, or what could happen. But after years of research and studying the founders’ original intent for this amendment process — and after years of witnessing an unconstitutional reshaping of our federal government — we are both confident that this is the correct course of action.”

Barton and Green said the Constitution “specifically furnishes each part of government ‘with constitutional arms’ for its own ‘effectual powers of self-defense.’”

“One such arm of self-defense that the Constitution gives to the states is an Article V Convention of States,” they wrote. “For states to refuse to use this tool would be like going into a street fight, but refusing to use one of your biggest and most effective weapons. And it is illogical to consider the use of any constitutional provision as a threat to the Constitution. It makes as much sense as violating the free-market system to save it, or breaking health care to fix it.”

Speaking about the letter on his radio program Wednesday, Beck said a convention of states “must happen.”

He acknowledged that he was wary of the process before, but, having done his homework, now stands by figures like Mark Levin and Barton who are advocating the convention.

“This was why Article V of the Constitution was written,” Beck said. “[The Founding Fathers] knew there would come a time where you’ve used every other lever, and [those in Washington] will not cede their power.”

Beck called a convention of states “your right and your responsibility.”

IRS’s Lerner Bombshell, Treasury Department Secretly Drafted New Rules To Restrict Activity of Conservative Groups… Yet Pres Obama Says No Smidgen of Corruption

The Daily Caller: The Obama administration’s Treasury Department and former IRS official Lois Lerner conspired to draft new 501(c)(4) regulations to restrict the activity of conservative groups in a way that would not be disclosed publicly, according to the House Committee on Ways and Means.

The Treasury Department and Lerner started devising the new rules “off-plan,” meaning that their plans would not be published on the public schedule. They planned the new rules in 2012, while the IRS targeting of conservative groups was in full swing, and not after the scandal broke in order to clarify regulations as the administration has suggested.

The rules place would place much more stringent controls on what would be considered political activity by the IRS, effectively limiting the standard practices of a wide array of non-profit groups.

“Don’t know who in your organizations is keeping tabs on c4s, but since we mentioned potentially addressing them (off -plan) in 2013, I’ve got my radar up and this seemed interesting…,” Treasury official Ruth Madrigal wrote in a June 14, 2012 email to Lerner and others obtained by Ways and Means and provided to The Daily Caller.

Ways and Means chairman Rep. Dave Camp blasted the off-the-record plan during a hearing Wednesday with IRS commissioner John Koskinen, and called for the administration’s newly proposed 501(c)(4) rules to be halted until criminal investigations into the IRS targeting scandal are complete.

“If Treasury and the IRS fabricated the rationale for a rule change it would tend to raise questions about the integrity of the rule-making process,” Camp said.

“I want to be perfectly clear – this committee will fight any and all efforts to restrict the rights of groups to organize, speak out and educate the public, just as unions are allowed to do so.  We will get to the bottom of this, and I expect the IRS to produce – quickly – the outstanding documents the committee has requested,” Camp said.

“I believe the IRS has a long way to go in restoring its credibility.  But, you can take a first step by complying with this committee’s request and stopping all action against 501(c)(4) groups until the appropriate investigations are completed.”

The new rules define more previously acceptable activities by nonprofit groups as prohibited “candidate-related political activity.” Communications and activities including voter registration drives and publishing voter guides, among others, are now classified as political activity. Grants and donations that 501(c)(4)’s give to other nonprofits are now subject to new record-keeping and increased scrutiny to prevent the money’s use for broadly-defined political activity.

The rules were “drafted in a manner, in my view, to shut down tea party groups” Rep. Camp said earlier this week.

New IRS commissioner Koskinen said that the rules should “put to rest all of the issues surrounding applications for tax-exempt status.”

But Madrigal’s email to Lerner proves that the regulations were being developed long before the IRS needed to publicly put anything “to rest.”

At least 292 conservative groups were subjected to unfair targeting between 2010 and 2012, against six liberal groups that were allegedly given similar treatment.

“They are both over-broad and under-inclusive,” said Foley & Lardner LLP partner Cleta Mitchell on the new rules.

“They’ve taken everything that 501(c)(4) organizations do in the normal course of business and proposed to convert that all to candidate-related activity, even if a candidate is never mentioned.”

Mitchell said that the rules are being “rushed through” for political purposes.

“The objective is to get the rules in place before the 2014 election,” Mitchell said.

Hmmmm… Remember the O’Reilly-Obama pre-Super Bowl interview just last weekend where the President said there was not a smidgen of corruption involved in the IRS situation where conservative groups were targeted?

OBAMA:  I do not recall meeting with him in any of these meetings that are pretty routine meetings that we had.
O’REILLY:  OK, so you don’t — you don’t recall seeing Shulman, because what some people are saying is that the IRS was used…

O’REILLY:  — at a — at a local level in Cincinnati, and maybe other places to go after…
OBAMA:  Absolutely wrong.

OBAMA:  Bill, we do — that’s not what happened.  They — folks have, again, had multiple hearings on this.  I mean these kinds of things keep on surfacing, in part because you and your TV station will promote them.

If there isn’t a smidgen of corruption, why was Obama’s new #IRS Chief apologizing… and perhaps already lying?

Then on Wednesday, 02.05.14, the new chief of the U.S. Internal Revenue Service, John Koskinen (74), a lawyer with little tax experience but with a reputation as a troubleshooter, apologized and promised that one of his priorities is to restore public trust in the IRS on the one hand but played down the IRS scandal as a minor issue with a handful of conservative political groups as if the matter was minor and settled (which it isn’t) on the other hand… just as new of the Lerner off-plan has emerged.

It has also come to light that virtually the first thing Koskinen did after taking office as IRS Commissioner was to give out $62 million in bonuses to boost moral among IRS workers… Really?  How about the moral of average Americans and those who have been targeted by the IRS with audits and delays of approval for their 501(c)(4)? Sounds a lot like same old same old to me?!?

Is it me… or does something just not ring true here? 

Happy Birthday, President Reagan

Today marks the birthday of Ronald Wilson Reagan, 40th president of the United States of America.

Reagan became president when the United States was in a period of great stress, just after the tenure of Jimmy Carter. Inflation and interest rates were in double digits and unemployment was close to 7%, taxes were at an all time high, America's foreign policy and international prestige were reeling from the Iranian hostage crisis, severe cutbacks in defense and successful Soviet penetration all over the world.

Worse than that, Americans seemed to have lost confidence in themselves and in the country's greatness.

Reagan squared his shoulders, rolled up his sleeves and got to work. He cut government, cut taxes, and oversaw the creation of 16 million new jobs and economic growth at 3.5 % per year. He rebuilt America's military. He was unafraid to call the Soviet Union an evil empire, or to challenge them directly so that their evil empire crumpled into the dust of history.

He left America safer, stronger and wealthier than it was when he came, which is the most you can ask of a president. In simple terms, he was a singularly decent man who honored both himself and the nation he served.

He gave us confidence in ourselves again, reminded us of who we are and that we are a country singularly blessed by G-d's providence. He inspired us as a nation. And he did it with grace, charm, wit and style, and with a sunny optimism that reached out to the best in us.

If ever a president deserved a national holiday to honor him, President Reagan does.

He was by no means perfect, as he would doubtless be the first to say. But in Ronald Reagan, we have an example of what real leadership is, an example especially needed today.

Happy Birthday, Mr. President...We Miss You!!!

** And let us remember this conservative yet practical leader in the upcoming elections of 2014 and 2016.  Reagan's old and proven formula was to unite behind the most conservative and principled candidate(s) available, and to make sure he or she knew that 2-years, let alone 10-months, isn't that far away. It won't be perfect, but it will even put RINO’s who survive on notice that times have changed!!
